At this time would anybody like to come up and address the Town Board on any issue as it appears on the agenda? Peter Terranova, Peconic PETER TERRANOVA: Good evening, Peter Ten'anova from Peconic. I come before you tonight to speak about resolution number 816. I realize on the agenda that the resolution this evening was to be tabled but I am sure it is going to come up in a subsequent Town Board meeting and if I am unable to attend that meeting, I want to have my comments entered for the record. Earlier this year I came before the Board to request that the existing deteriorating and dilapidated fence around the Goldsmiths beach parking lot be replaced. The fence was installed by the town some 40 years ago. Scott, you said at the time that if the fence was on town property, it would be taken care of. Now while the fence on the south side of the parking lot may be a few inches off the mark, the fence on the west side down to the high tide water mark is on town property. But regardless, the entire fence was installed by the town to separate the public parking area and boat launching ramp from private property. At the time, you know we had the October 6, 2009 Page 4 Southold Town Board Meeting Minutes discussion and the Board stated that they had no money to affect repairs or replacements to the fence and we accepted that. So some emergency repairs on the south side of the fence, to that fence, were made by the residents of Peconic sound shores. Now I understand that the funds for projects like this that are addressed in resolution 816 comes from the parks and playground fund, which is separate from the town's general fired. And at the time, this, I believe generously funded. And this resolution tells me that we have the money in that fund and that the town is willing to spend it on projects to improve the parks and playgrounds of the Town of Southold of which Goldsmiths Inlet beach is one of the most popular. So tonight I respectfully request that this resolution, prior to a vote, be expanded to include the replacement of the fences on the south and west side of the parking lot and beach down to the high tide water mark and the installation of guard rails on the north side of the lot, similar to what is proposed down at McCabe's beach because we have a similar problem with SUV's and four wheelers driving on the beach. They have it at McCabe's beach, we understand that is a problem, so it seems to me that we can expand this and take care of both McCabe's beach and the Goldsmiths Inlet beach with the required fencing to improve the appearance, improve the safety, okay, and generally upgrade the facilities that we have in the town. Thank you very much. SUPERVISOR RUSSELL: Sure. I have to tell you that police calls don't indicate the problem at Goldsmiths that they do at McCabe's. We get police calls regularly for beach traffic, vehicles, on the beach at night at McCabe's. This is come after a cumulative look at the ongoing problems over the years. If you are getting that traffic then I urge you and your community members to call the police department at night because cars are not permitted on the beach. We just don't see that type of volume coming from that. That is why McCabe's and incidentally, it came in at far much more money than we were willing to spend, which is why that resolution got tabled. But we were responding to years of evaluation and the ongoing concerns of the community with beach traffic at night. MR. TERRANOVA: I have personally called the police, okay, about cars driving on the beach, okay? Generally speaking we don't bother the police because by the time they are able to respond because they have more pressing matters, okay, the cars are gone. Okay? Tom Foster and I personally, personally, had to take an individual, okay, and threaten to call the police. He in turn, called the police department and said, here I am parked on the beach, is it legal? And they said no. And finally he left because I said either you can do it the easy way or the hard way. Last year, my wife and I woke up to have a car parked right in front of our home on the beach. Okay? And I don't want to tell you what they left on the beach. Okay? So... COUNCILMAN KRUPSKI: This is a family show. Come on now. MR. TERRANOVA: Right. I understand what you are saying but before any money, any money, even dollar one, whether the project is worthwhile or not, I will leave it up to you to decide. Okay, before any money is spent on a fence that doesn't even exist, we have fences around the Goldsmiths Inlet parking lot, okay, which you have said Scott yourself, is a real problem, they are dilapidated, they are rotted .... SUPERVISOR RUSSELL: What I said was we would address it and addressing it means October 6, 2009 Page 5 Southold Town Board Meeting Minutes perhaps removing them. Again, the timber rail, guardrail at McCabe's and if we need one at Goldsmith's we will certainly address that to Vincent and the rest of his committee to evaluate and gladly price that out as well, the idea is to keep traffic off the beach. It is not to separate public from private property. We generally don't fence off public property. It is not the town's most important mission to try to create lines of demarcation between public and private property. That is for private homeowners to do. MR. TERRANOVA: When the town bought the property, the parking lot down at Goldsmith's Inlet beach that used to be private property, when they bought it, okay, they established a 25 foot easement and agreed that that 25 foot easement would keep the parking lot, off, set back from the private property. In addition, they built the fence along the west side of the boat launch ramp because that is a public boat launch ramp to keep people on the boat launch ramp and from driving on private property as well as protecting the dunes. That is a town interest. Those are ecological dunes, the sand, there is sea grass there that helps stabilize the beach. Okay. we have got a real problem there with cars coming down, sometimes they park three, four wide on something that should only be one car wide. And it is destroying the natural habitat of the area. Now, you can just walk down there or drive down there and you can see the condition. SUPERVISOR RUSSELL: I am down there a lot. Like I said, if there is a problem with beach traffic, with cars on the beach, we will certainly refer the idea of a timber rail to Vincent and his committee. MR. TERRANOVA: I respectfully, again, request, since I have been before this Board on more than one occasion to ask that the situation be addressed. Okay? I see now that money is being talked about being spent, okay, on another beach, okay, that has perhaps a similar problem. Now earlier this year I came before the Town Board, you told me the town had no money to do this. That tums out not to be the case because you have money in the parks and playground fund for purposes just like this. And you are willing to entertain the thought, whether it is $4,000, $5,000, $13,000, you are willing to entertain the thought of spending that money for a project like this. Our project is no less worthy. That is my request to the town and I respectfully request that this resolution be modified to include improvements to the fencing down at Goldsmith's Inlet. Thank you. COUNCILMAN ORLANDO: Now Peter, before you run, I would like to make a comment. I can see the need and the purpose of that north and south fence on the private property to the, on the west side. The same fence that we are putting up, the guardrail at McCabe's, can never be put up on Goldsmith's because of the ongoing dredging maintenance every year. You saw the equipment we bring down there that goes on the beach. If we put that up there on the north side, we would never be able to access for our ongoing dredging. So that would be an issue. MR. TERRANOVA: Well... COUNCILMAN ORLANDO: That particular fence. MR. TERRANOVA: It would not be difficult for one section of the fence, the guardrail fence October 6, 2009 Page 6 Southold Town Board Meeting Minutes okay, to be attached with lag bolts and all you would have to do is go and take out those lag bolts and take out that one section .... SUPERVISOR RUSSELL: We have got a long meeting and what I will say, I will refer the idea of a timber rail to them. The issue of repairing that fence I won't support now and I won't support five weeks from now. I will refer that to them although I don't think that is in their bailiwick either as a parks and rec committee. Timber rail is a separate issue. MR. TERRANOVA: Thank you, sir. BE IT ENACTED by the Town Board of the Town of Southold as follows: Purpose - In order to provide for the health, safety and welfare of the citizens of the Town of Southold, the Town Board finds it necessary to enact these limited parking restrictions on Champlin Place in Greenport. II. Chapter 260 of the Vehicle and Traffic Code of the Town of Southold is hereby amended as follows: § 260-8. Parking prohibited at all times. The parking of vehicles is hereby prohibited at all times in any of the following locations and at any other location where signage indicates "no parking": Name of Street Side Location Champlin Place South In Greenport, on the be, th South sides of Champlin Place from the intersection with Main Street, easterly for approximately 160 feet. III. I am going to vote no and the reason I am voting no is I haven't been convinced by anyone that no parking was needed at all. COUNCILMAN ORLANDO: My vote is yes, for the one side, the south side for no parking for 160 feet. COUNCILMAN KRUPSKI: When this came up, I took a look at it, last week I attended the Transportation Committee meeting to get further clarification and after that meeting I took a look at it again. And I agree with Councilman Ruland, I just, I don't like to see, there are so many small businesses in this town that use the shoulder, either the state road or the side road for their business as parking, including the post offices and I hate to see this happening and it has got nothing to do with the current owner or the current business because if it is business zoned there is going to be someone there in 10 years or 50 years, there is going to be someone else having a business there and so I just think we have to be careful about these things and I vote no. COUNCILMAN WICKHAM: I vote yes and I note that it is unanimously recommended by our Transportation Commission and by our Highway Superintendent. SUPERVISOR RUSSELL: Since everybody is commenting, I will too. Councilman Wickham came up with a solution today that I thought was fair and addressed all party's, which was to declare no parking on the south side of the street ensuring that you won't have the situation that the cars will be parked on both sides, thus narrowing the ingress and egress of that street. I think that is a fair resolution to that issue and I am supporting that. Droskoski. Said property is identified as part of SCTM #1000-18.-4-7.1. The address is 28105 NYS Route 25. The property is located in the R-80 zoning district and is at the northwesterly intersection of NYS Route 25 and Browns Hill Road in Orient, New York. Page 12 The exact area of the acquisition is subject to a Town-provided survey acceptable to the Land Preservation Committee and the property owner. The easement will be acquired using Community Preservation Funds. This project is eligible for partial funding from an awarded grant from the United States Department of Agriculture - Natural Resources Conservation Service (USDA-NRCS). The purchase price is $75,500 (seventy-five thousand five hundred dollars) per buildable acre for the 194- acre easement plus acquisition costs. The purchase price is subject to a provision that the landowner satisfies and agrees to any and all Federal requirements imposed in connection with the awarded grant from USDA-NRCS. The property is listed on the Town's Community Preservation Project Plan as property that should be preserved due to its agricultural value. This is something that is, I think it is really, it could be very dangerous if people don't realize there are certain boundaries that are being proposed here to be sewered in Mattituck and there are different lines on the map and I think the lines could possibly change in the future because once you start to sewer, put sewer systems in Southold Town, you only have to ask other areas where they have sewer systems how are they working out and how do you like them and who is paying for them? Because those are the big questions and sometimes you get a lot of unintended consequences from increased development and really high associated costs for maintenance and obviously construction, from these systems. So this is something the Town Board is being, this isfft saying the Town Board supporting a sewer system in Mattituck. My name is Dennis Yuen and I am the program director for the Peconic Community Council, Inc. otherwise known as the PCC, a local not for profit 501 c 3 and coordinator for the Maureen's Haven homeless outreach program. For those who are not familiar with the Maureen's Haven program which operates under the auspices of PCC, the Maureen's Haven program offers a three-pronged approach to assisting those who are homeless and those on the verge of homelessness. Our homeless outreach program is beginning its 8th year and each year we have collaborated with the many houses of worship on both the north and south forks, asking them to open their doors in the evening night to provide safe, warm, temporary housing to the homeless October 6, 2009 Page 38 Southold Town Board Meeting Minutes of the five east end townships. In Southold Township, our participating houses of worship are St. Agues RC in Greenport, Southold Presbyterian, Mattituck Presbyterian, First Universalist of Southold, Sacred Heart RC in Cutchogue, Our Redeemer Episcopal and Advent Lutheran both in Mattituck, Orient Congregational and St. Peter's Lutheran in Greenport. Peconic Community Council is responsible for the screening and transportation of the homeless each night to and fi.om the different houses of worship which provide their facilities to house our guests during the cold winter months. We currently maintain screening locations for our homeless guests in Greenport, Riverhead and Hampton Bays. Last winter, our toughest of the last seven winters, we served 185 individuals over the course of the season, with 80% of them originating from the north fork. The Maureen's Haven program served an average of 37 homeless per night, running 160 nights last winter, with a pool of over 1200 volunteers working 7 nights a week from November 1 to April 1. We actually extended our season eight more days because of the freezing temperatures in April. The equivalent of almost 6,000 beds were made over the course of the long season. Every evening, the guests were provided a hot dinner and fellowship by members of the many different communities. The churches also provided the guests with other basic health services and personal amenities, plus breakfast and a bagged lunch when they departed the next morning. The second prong of the Maureen's Haven is the HopeLine which is a toll free hotline (1-877-727-6820) and walk in center for those in imminent need of assistance. Multi-service referrals to community agencies are provided by HopeLine staff to provide assistance to the homeless and those on the brink of becoming homeless. The Kay Kidde achievement center offers clients several paths to empowerment: GED preparation classes, computer training classes, resume writing, job searching skills and dress for success sessions. The mission of the Achievement Center is to empower individuals in the community who are facing multiple barriers to employment and housing, enabling attainment of their fullest potential to become self-sufficient and independent members of the community, thereby breaking the cycle of poverty. We have a close working relationship with the North Fork Spanish Apostolate, the Salvation Army and CAST and also network with the many health and human services agencies on the north fork who help spread the word about our services. There are very few options for the homeless here on Long Island during the bitter cold winter months. We contact them, in the woods, at their make-shift homes, on the streets, and give them an option, a place to escape the deadly cold. They depend on Maureen's Haven and truly appreciate the efforts of our church and community volunteers. It is my hope that the Town of Southold, through your Community Block Grant program will help defray the cost of transporting these guests to and from the north fork churches each day. I am requesting a $10,000 grant from the Town of Southold Block Grant program to provide this vital service to our guests. We need the continued support of the Town of Southold, along with the other east end townships, to continue to provide this invaluable outreach program to the homeless within all of our communities. MELISSA SPIRO, LAND PRESERVATION COORDINATOR: Hi, good evening. I am Melissa Spiro, the land preservation coordinator for the Town. As read into the record, this heating is for the town's purchase of development rights easement for agricultural purposes on approximately 17.5 acres on the 22.5 acre farm. I would like to note for the record that Eric Keil is a member of our Land Preservation Committee and he is also one of the property owners. Eric has not participated in any part of this discussion on this project. The farm contains prime agricultural soils worthy of protecting for continued agricultural use. The farms to the east and the west are preserved farms and the preservation of this farm will add to the existing block of preserved farms, making the block over 100 acres of preserved land. The landowners are reserving from the easement area approximately five acres fronting on the Main Road, they intend to go before the Planning Board for an open development subdivision for an additional residential lot within the area reserved from the easement. There is already an existing house there. The open development subdivision is a subdivision meeting the requirements of a conservation subdivision whereby the landowner goes before the Planning Board for sketch plan approval now and goes before the Town Board for approval for the right to seek future approvals for the creation of lots in the future. Basically it is a way to preserve, in this case, 75% of the property or at least 75% of the property now and for the landowner to seek final approval for the lots in the future, in accordance with the conservation subdivision regulations. The Planning Board and the Town Board will each be holding separate hearings for that open development subdivision. The negotiated purchase price of $67,000 per acre is in accordance with an appraisal which was done specifically for that property. The purchase will be completed using Community Preservation funds and as noted, we have applied for and received a grant award for just over $530,000 from the New York State Ag and Markets for this particular project. The Land Preservation Committee and I are both in support of this project and recommend that the Town Board proceed with the resolution to purchase this easement. Of course, as we always note, you cannot proceed with preservation without the landowners and I wholeheartedly thank the landowners, I don't know if they are in the audience, for allowing us the opportunity to both apply for the state grant and to preserve this valuable farmland. Would anybody like to James Spanos, Greenport October 6, 2009 Page 41 Southold Town Board Meeting Minutes JAMES SPANOS: I would like to address the Town Board, I would like to revisit the Champlin Place decision and I can understand why some of the Board members decided to vote no and because of the small businesses but I can also understand the other side, Mr. Harris is concerned on public safety and if we visit different business, especially farm stands in the area, I am concerned about public safety. I see farm stands operating at full capacity, cars coming in and out of there like it is a pit stop at the Indianapolis 500 and it is ridiculous. And I am sure people walk on eggshells before they address this issue because of, let's just keep it at that. I mean, them are some political powers that own a lot of farm stands around here and up and coming politicians that these issues are never addressed and brought to the Board. And I would like somebody to speak on this issue. COUNCILMAN WICKHAM: I want to ask a question first. You are aware of exactly what we passed tonight? MR. SPANOS: I am aware of it and I would like to know how it came to the table. It usually comes to the table because of a few complaints and a lot of these complaints are anonymous complaints by neighbors and that is my issue. If a couple of neighbors have a problem, they put in anonymous complaints at the building department and it goes up the ladder and I don't think that is correct. If somebody has a problem with a neighbor, they should address the neighbor face to face and say look, I have a concern about this instead of putting these anonymous letters in, coming up, smiling in your face like everything is fine and next thing you know, they get on the horn and make their complaints. It is not American. As a matter of fact, this country was built on Judeo-Christian values that we should honor our neighbors and communicate with our neighbors and that is not what is happening. COUNCILMAN WICKHAM: We can understand that and sympathize with that but I think that those of us who voted for the resolution tonight felt that we were providing some protection for those who are operating a business on that road and yet we were also taking care of public safety. MR. SPANOS: I agree with you on that concept and there were a few people that voted no completely and they didn't want to address this issue because there were other issues that would arise on other businesses and I am addressing them, Mr. Wickham. COUNCILMAN WICKHAM: I see. MR. SPANOS: And I would like people to, if they are going to focus on public safety, I would like all the businesses to go under the microscope and people to step up to the plate and say, hey, this place is being ran very unsafe, let's address it. Let's not just point the fingers at a few of us. And I know you are stepping down, I respect you very much, Mr. Wickham, and I thank you for stepping up to the plate last week and coming up with the half the street to be left free and I admire everybody on the Board for respecting of Mr. George Papamichael's business and allowing him to operate on that site but there are still public safety issues throughout the town that are being ignored. And all I am saying is, we just need to look at the full spectrum and not just single out a few people because of a few anonymous complaints. And if we are going to do these things, even when it comes to any complaints, my issue is why can't these complaints be in October 6, 2009 Page 42 Southold Town Board Meeting Minutes writing and signed by the neighbor? Why can an anonymous complaint come into the building department and send somebody from the building department off on a wild goose chase? And why are these, if there is any substance to these complaints and I can bring one up and I will bring it up with Mr. Russell in private. But there is a lot of complaints that are rumors and people act on them. And it is just not, it is not American like. It is small town gossip that goes around. People act on these complaints without any substance. So if we are going to address public safety, we need to, or any complaints on the building department, we need to do it fairly and throughout like, for everybody. So equal treatment for everybody. And that is the only way to do it. There is something else I wanted to address, and that is the issue on, one moment please because it was pretty important. Of different members in the building department being able to purchase properties and subdivide them or politicians being able to do this. It seems that it is a conflict of interest. When a member of the building department or a politician is able to buy a parcel of land and get it subdivided a lot easier than let's just say one of the average folk that had a parcel of land of their own, it seems like a conflict of interest to me and other townships do not allow it and I am wondering why this township allows it? SUPERVISOR RUSSELL: I am unaware of any town on Long Island that would deny the right of a member of the building department or any worker who works for Southold or an elected official to not buy land and subdivide it under the code and the zoning that is required. I am unaware of any such prohibition throughout any town on Long Island, never mind New York State. That being said, provided everything is up and dealt with openly and honestly with those reviewing and discretionary boards, I don't see why there should be a prohibition from someone doing that. MR. SPANOS: Well, I will give you a for instance. There is property out in Orient Point that people have been trying to subdivide for a long time and if it is easier for a local politician to get it subdivided and the original owner being pressured out of it because of not being able to communicate or get things done with the building department, that is considered strong arming in my book. SUPERVISOR RUSSELL: I would agree, I just don't know anything of which you referenced. You use the word politician, I don't know if you are talking about members of this Board, I don't know. MR. SPANOS: I don't get into specifics, I heard and hearsay and that is a lot of small town politics, there is a lot of hearsay. I am going to leave it at that, I am not going to point any fingers. If I have some concrete evidence of an incident that happened of this nature, I will address it in writing to you, Mr. Russell. SUPERVISOR RUSSELL: Okay. MR. SPANOS: And I will leave it at that. Thank you very much. And I wanted to touch base with, I was hoping Mr. Harris was here today because today we worked together and it was a great experience working with Mr. Harris. He, there was a lot of work being done at the station and he also was very kind and helped me fix the existing apron there and I want to thank him October 6, 2009 Page 43 Southold Town Board Meeting Minutes very much, he is a very kind man and he understands the working class. And I just want to thank him again. COUNCILMAN RULAND: I would like to respond to your comments, if you don't mind. I want it to be very clear, the reason I voted no was because I wasn't convinced there should be no parking on either side. That was my only point. The vehicle and traffic law prohibits parking within 15 feet of any intersection, whether there is a sign there or not. That is a New York State law. So if someone parks right at the intersection, sign or no sign, they can be ticketed. Many communities have the yellow curb painted there so that it is identified but it doesn't have to be. And while it is true the Transportation Commission made a recommendation, I was not convinced that the people who live on the street needed to lose the parking for 160 feet on both sides. The compromise that came forth was probably a reasonable compromise but I still didn't believe that the people who live on that south side are going to be restricted from parking for 160 feet. That is the only reason. The only reason. MR. SPANOS: Thank you very much. And I spoke to George about how you addressed it last week and you were against the parking and I can see why Mr. Krupski voted no and he understands small businesses. So it is just, if we are going to look at public safety, we need to look at the wide spectrum. I agree with small businesses, they should operate freely and I appreciate the decision you came up with today. Thank you. SUPERVISOR RUSSELL: I just want to comment, if the up and coming politicians was a reference to me at all, I have been here for 19 years and I am about this far away from being a retread and a has been, so, you know. Okay. Would anybody else like to address the Town Board? Hugh? I am sony, Eric. Hugh Switzer, Peconic HUGH SWITZER: Hugh Switzer from Peconic. I just want to thank the Town Board again for your support of Goldsmiths Inlet in going through with that grant. We all appreciate it very much. I also wanted to acknowledge the very fine work, the hard work and the high quality work that the Planning Department, in particular Mark Terry, is doing. Eric Keil, Mattituck ERIC KEIL: Eric Keil, resident of Mattituck. I just wanted to bring a couple of things to the Town Board's attention since I was here tonight. One is at the end of Duck Pond Road in Cutchogue, during the course of about the last nine months or so, some construction was going on, on the beach, some building of some bulkheads and so forth, and the contractor who was doing the work did a great deal of damage to town property and I don't know if the Town Board is aware of it or not. If any of you haven't been down there, I would urge you to go take a look October 6, 2009 Page 44 Southold Town Board Meeting Minutes at the condition of the guardrail and the road end. There was a great deal of, well there was sort of a rock berm at the end of the street to catch road run off and so forth. That material was removed so that a large excavator could get down on to the beach and the contractor did not restore it when they left the beach. They also didn't restore the guardrail to the condition it was in prior to the construction work. In addition to that, as a resident of Mattituck, I have noticed a great many people ignoring the one way traffic on Old Sound Avenue in front of the Mattituck Presbyterian church and I have witnessed on a couple of occasions beverage tracks coming out of the municipal parking lot and instead of turning right and following the flow of traffic turning left and immediately turning right out onto the Main Road, a couple of times almost causing an accident. Now I am not sure what could be done about this but I also wanted to make the Town Board aware of that and it happens quite often. Also, some people who are not familiar with the area don't see the, where Westphalia connects to Old Sound Avenue, they don't notice that it is becoming one way and they proceed up to the street to the, you know, right out to the Main Road. It is possible that maybe a guardrail or something else could be done there because it is easy to miss if you don't know the community. So those were just a couple of things that I wanted to, while I was here, bring up. So, thank you very much. SUPERVISOR RUSSELL: I just, quickly address the issue of Duck Pond. Actually the owner of the property, it is an electrical union membership, has actually already reached out to us and we are discussing having drainage installed there. That was a rock revetment there at the road end but it was a terrible area of erosion, so we are talking and discussing with them the possibility of installing drainage there that will hopefully work. But thank you. MR. KEIL: It was actually a neighbor to the west who was having work done to their bulkhead. It wasn't the electrical workers union. SUPERVISOR RUSSELL: Oh, it wasn't, because I know we granted access them for the hotel. Oh, so this is residential property? MR. KEIL: It was a residential property. SUPERVISOR RUSSELL: Okay. Thanks for bringing that to our attention then. Okay, thank you. I wasn't aware of that. MR. KEIL: One last thing, if possible, there is also, I happen to walk the beach there a lot on my lunch break and I understand that the town has had a problem with people dumping municipal waste in the town's trash cans which are intended for beach goers and so forth, and in most places around town at this time of year the town removes the cans, while I understand why the town is doing that, it does cause a great deal of municipal trash to just be dumped and if you go down to Duck Pond Road right now, I am sure you will find that there are some garbage bags down there, and it would, I think, it is in the interests of the town to foot the bill for taking the trash away and leave the cans there throughout the winter season. That is my point of view. SUPERVISOR RUSSELL: Thank you. Would anybody else like to address the Town Board? Lori Salmon, Southold October 6, 2009 Page 45 Southold Town Board Meeting Minutes LORI SALMON: I just have a couple of questions, just to clarify a few things for myself. One is, I have seen it a couple of times, is a refund under Zoning Board of Appeals and you are authorizing refunds in the amount of $525. I hope I know the answer to that but is that just because nothing went forward, I mean, was anything started? SUPERVISOR RUSSELL: That is because the applicant had decided to withdraw the application. MS. SALMON: Before any work had been done? SUPERVISOR RUSSELL: There had been no action taken. MS. SALMON: Okay, very good. That is only fair. The other question is with the part-time police officers for the summer, I understand that we pay for them to go to the academy? SUPERVISOR RUSSELL: Not the seasonals. When we hire new police officers as part of the regular full-time employment, the officers that hadn't been to the academy will go to the academy and draw a salary from the town as a new hired officer. Seasonal officer's do not. They go at their own expense. MS. SALMON: No, I understand that, that they are not being paid as officers but what about the cost of the class? SUPERVISOR RUSSELL: The cost of the, I am not sure that we incur any but I can't say that we don't. That is one question I will certainly call the police chief tomorrow and find out. MS. SALMON: Okay. And these two are to replace two that they don't expect to come back next season or....? SUPERVISOR RUSSELL: That is what I understand. We actually are budgeted for 3 ½ TCO's fight now, with those two we will have 2 ½ TCO's. So we will still be one short. COUNCILMAN ORLANDO: That will be interesting. MS. SALMON: Yeah. And my other question, my last question is I know during the summer when layoffs were talked about, the CSEA gave up a couple of things and I think it was fair and I just want to know if you are still in negotiations with the PBA in regards to that and if you can comment on that. SUPERVISOR RUSSELL: Well, we are in negotiation and I can't discuss the details but we have an ongoing and rigorous negotiating team. MS. SALMON: Do you expect to come to some type of conclusion soon or....? SUPERVISOR RUSSELL: I can't say but I will tell you that probably not in the next few October 6, 2009 Page 46 Southold Town Board Meeting Minutes months. It is going to be protracted, look, we are going through a very similar situation that the CSEA and us dealt with. It happened to be at the close of their three year contract anyway, so we are negotiating not just because of the current fiscal climate but over three years and trying to frankly, change some trends here. MS. SALMON: Well, I know you had talked about layoffs and I don't, I want to make that clear, I don't think that we can afford to layoff the police officers but I know that was something that I think probably drove the CSEA to do what they did and I know a date was mentioned and what is going on with that? SUPERVISOR RUSSELL: I won't comment on that because that is part of the negotiation right now. I am sorry, I can't. MS. SALMON: Okay. Thank you. Melissa Wilcenski MELISSA WILCENSKI: Hi, my name is Melissa Wilcenski, I am a resident of Southold town. I had a question last year in 2008, I was trying to see if you were going to put a basketball court .... SUPERVISOR RUSSELL: With lights. With lights I believe. That is right. MS. WILCENSKI: And a scoreboard. SUPERVISOR RUSSELL: Yeah. MS. WILCENSKI: Summer, fall is already here. Nothing is there, so I am wondering if it is still on the table? COUNCILMAN ORLANDO: Well, there is about $40,000 still left in, Tasker park has its own little budget and it has about $40,000 in there. The town would have to actually approve to build that but there is money left in there. MS. WILCENSKI: I thought it was approved last year when I was .... COUNCILMAN ORLANDO: It was put in there, that is why there is money in there. It was put in there for that but the Town Board would actually have to talk about it and approve to do it. We just couldn't do it. So, there is money for it. MS. WILCENSKI: When will we do this then? This is already now a full year that we have been talking about it. The money was supposed to be there last year in 2008, now we are .... SUPERVISOR RUSSELL: Yeah, the money is in what is called the parks and playground fund which is what the gentleman before had commented on. That money is money that we collect from developers that apply for subdivisions, just so everybody knows where that source of those funds are. We get parks and playground fees for the subdivision of land, that money goes into a October 6, 2009 Page 47 Southold Town Board Meeting Minutes committed account and can only be used on the investments for the town's parks and playgrounds. That's what we are talking about. That is money that is not part of the annual budget process. I will gladly refer that to you and have your board discuss that and come back to the Town Board and we will have a discussion in two weeks. COUNCILMAN ORLANDO: It was on our original big list, we have a Christmas list in the beginning and things got taken off and that was one of the things that got taken off. SUPERVISOR RUSSELL: I just want to caution that our willingness to discuss it and have it back in two weeks shouldn't be construed as an endorsement of the plan. MS. WlLCENSKI: Right. SUPERVISOR RUSSELL: You know, there are some things, I have to be candid, I am going to have some concerns about lighting because we have already light quite a bit of Peconic Lane and I have homeowners there but we will talk about that. MS. WlLCENSKI: I was only kidding about the lighting. COUNCILMAN ORLANDO: Okay, scratch the lighting. SUPERVISOR RUSSELL: I thought you raised the issue of lighting last year, if I am not mistaken. MS. WlLCENSKI: No, no. It was just the court. SUPERVISOR RUSSELL: Okay. Well, that is something we will talk about. MS. WILCENSKI: I am not going to be down there at night. It is just when the games are going on, when kids are playing softball, baseball, it would be a nice addition down there. You have everything. How are you doing this evening? Only one person spoke at the public heating tonight on the local housing and community development block grants funds. I did stand up but you closed the hearing too quick, so quick I didn't get to say anything. So maybe it won't be part of the hearing but I have a suggestion that if you can maybe you will consider some improvements to the sidewalks down in Mattituck between the, what is it now, it used to be A&P, Waldbaums. And Love Lane. Between the Waldbaums down Factory Avenue down Sound Avenue over to the Love Lane area. It would be nice if people could walk back and forth, didn't have to get in their car all the time. There is a rally down on Factory Avenue and the Main Road this Saturday, some of the people there are very concerned with the proposal for 7-11 to build on that comer and further aggravate a sinful situation on Factory Avenue where you have the shopping center there interfering with the church that was there long before the shopping center and never should have been permitted the way it is. The fact that it is getting worse. I hope you will all join us this Saturday at noon. It is 10, 10 and 12:00. They should have had it at 10:00, it would have been easier to remember. 10, 10 10:00 but it is at noon. I was here this morning and I observed the discussion you had at that meeting in planning for the meeting to plan for the planning of Southold Town. You scheduled a public meeting and this morning you discussed the strategies to advertise that meeting. You are going to take out a little advertisement in the Suffolk Times, post on channel 22, put on the town website, posters throughout the town. I don't know who is going to put them up. And notice WLNG. Well, I thought it might be appropriate to discuss it a little bit at this meeting tonight, that one week and two days from today, there will be a public meeting on what you are calling a comprehensive development plan. I prefer to call it a comprehensive or a common preservation plan. SUPERVISOR RUSSELL: I don't think they referred it to a development plan. Develop a comprehensive master plan and update to the comprehensive master plan. MR. SCHWARTZ: Well, in the notice in the meeting and I think in tonight's meeting too, it was billed as public information meeting on the process, development and planning of a comprehensive development plan for the Town of Southold. So maybe that was an oversight. SUPERVISOR RUSSELL: It is. But we will correct it. You are right. MR. SCHWARTZ: You know, we would like to correct that. I asked two questions this morning and rather humorously, Scott, you told me to go to the meeting. SUPERVISOR RUSSELL: Not humorously, I meant it. Actually, we talked outside. You have good ideas, that is what that meeting is about. It is to engage the public at the beginning of the process. That is what that meeting is for. MR. SCHWARTZ: And I will be there. You know, one of the questions that was asked this morning that I didn't think got answered was asked by Tom Wickham. If this is going to be an update, we keep talking about it as an update, well, what is it updating? And I am not going to put you on the spot tonight but hopefully by next week we will have a clear answer to that question. COUNCILMAN KRUPSKI: I think that is just the way that it was written. It was written as an update to the comprehensive plan. It wasn't a comprehensive plan update of the comprehensive plan, it was written, what we received today from Heather Lanza was an update on the comprehensive plan. I think that was just the way it was worded. MR. SCHWARTZ: What is the current comprehensive plan? COUNCILMAN KRUPSKI: No, you don't understand me. The way it was written was it is not, the way I understood it, it was not an update of the comprehensive plan. We were getting an update on the status of the comprehensive plan. SUPERVISOR RUSSELL: I feel like I just stepped into a Joseph Heller novel. As a practical reality, it is an update to the existing plan. For lack of anything else, we have a zoning map that was passed in 1989. Many argue that is the master plan and there was years of discussion and protracted community participation in that and it was finally adopted in June of 1989. The, I think the issue what that might have been lacking was the narrative. All of the other components besides zoning that should be part of a master plan. Tom raised the issue of zoning today to say that yes, this comprehensive master plan is going to need some enforcement or some teeth, some enforcement mechanism. That is where zoning comes in. So, it is all part of the same package. But I, she might have meant simply updating the Town Board to the comprehensive plan meeting, not the comprehensive plan update. Personally, I disagree with Al but I think she meant the comprehensive plan update, updating the plan that we have as lacking as it is. COUNCILMAN KRUPSKI: Do you want to say that again? SUPERVISOR RUSSELL: It is really so impertinent, I don't know why we are talking about it. MR. SCHWARTZ: Well, this is a learning process that is not just, this town is not the only town going through this. There are many other towns in this region and around the world and when the original master plans were created, they used that term master plan. People didn't really like that, it wasn't very descriptive. It is a master plan that is going to control everything. It is impossible. So they changed to this term comprehensive plan. Well, the comprehensive plan suggests it is going to plan for everything and include everything and that is also impossible. So I like to use the term common plan. And why I like to say common plan is because this common plan is going to be for all different parts of our community. It is going to be for the farms, it is October 6, 2009 Page 50 Southold Town Board Meeting Minutes going to be for the waterfront, it is going to be for the businesses, it is going to be for the residents. I am not sure it is going to cover the government, politics. But it might. Anyway, it is a very important undertaking and I like to joke around as much as most pe.o~le do but I am hoping that we can get this one right and I will see you on Thursday October 15 at 6:00. Thank you. COUNCILMAN KRUPSKI: Thank you. Supervisor Russell SUPERVISOR RUSSELL: Thank you. Would anybody else like to address the Town Board on any issue? There has been a decision that was made last year at the adoption of the budget that eliminated the brush component to the fall cleanup. We are still picking up leaves this year, we are not picking up brush. The decision was made last year, it was advertised last spring. I think like most people, we forget what we read in March, myself included. We are making every effort we can to let the public know that we are starting to see brush pile up on the rights of ways and what we need is a fundamental understanding that the town highway department will not be there to pick up brush this year. If you have any questions, feel free to call me at the office any day of the week. COUNCILMAN KRUPSKI: The grace period. SUPERVISOR RUSSELL: The grace period, we have extended the grace period so that brush will be collected at the landfill. You can bring it there for free for the months of November and December. Okay?
