Hi Lauren,
I am getting back to you about the proposed handrails for DiBari. They would really like to have 2 handrails
because they are concerned for the safety of their three young children, all of whom are younger than age 8. If
this kind of safety concern does not rise to the Trustees' standard for the need for 2 handrails, then they will
accept approval for one handrail.
I want to mention that we are also seeking approval for the dock to equipped with water and electricity, which I've
indicated in the notes of the project plan I submitted with the application. However, I think the project description
in our application only mentions electricity, so please let me know if this email will suffice to have our request
amended to include water service or if we need to send you something else in writing.

The captioned permit authorizing construction of a fixed dock was issued on 23 September 2009 to Coyote
Properties, LLC, and liter transferred on 15 February 2011 to the current owners, John and Maria DiBari.
Construction of the permitted dock was recently completed, but the DiBaris would like to add handrails to the
dock since they have three small children, aged 8 years of age and younger. As electric service has already
been added to the dock, we are attaching an application to administratively amend the still valid and open
permit to include these two items, as depicted on the accompanying project plan prepared by En-Consultants,
list dated July 18, 2011.
Should you require any additional information to process our application, please let me know.

· pUrSuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code~ Of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on

"T' over the tidal marsh, and as depicted on the site plan prepared by En-Consultants,
Inc., last dated September 17, 2009, and received on September 23, 2009.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Coyote Properties, LLC, residing at 2000 Glenn Road, Southold, New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and ail such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Soutbold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to:remove or alter this work project herein stated without
expenses to the Town of South01d.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, September 23, 2009 regarding the above matter:
WHEREAS, En-Consultants, Inc., on behalf of COYOTE PROPERTIES, LLC applied to
the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated June 3, 2009, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 275-11 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: construction of catwalks is permitted
in Goose Creek including it's connecting branches over vegetated wetlands, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 23, 2009, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and ara familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfara of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice raquirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of COYOTE
PROPERTIES, LLC to clear and maintain a 4' wide path through the existing buffer and
construct a 4'x40' fixed timber catwalk with ramp and stairs, and a 4'x12' fixed "T" over
the tidal marsh, and as depicted on the site plan prepared by En-Consultants, Inc., last
dated September 17, 2009, and raceived on September 23, 2009.
Permit to construct and complete project will expira two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

As discussed during the public hearing held on the captioned application on August 19~h, please fred attached a
project plan last dated 17 September 2009, which depicts a modified dock design that lessens the structure's
intrusion into the waterway by approximately 5 feet. The overall orientation of the structure has also been
modified slightly so that the outer "T" section aligns parallel with the shoreline. The plan has also been revised
to reflect the location of low water and water depths recorded during low tide by John Ehlers, L.S., and me on 9
September 2009 and by staff from the New York Department of Environmental Conservation and me on
September 15t~. Please note that the two seaward comers of the outer "T" section were represented by the
stakes you viewed during your field inspection two weeks ago.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is INCONSISTENT
with the denoted following Policy Standards and therefore is INCONSISTENT with
the LWRP.
§ 275-11 Construction and operation standards of the Southold Town Code prohibit the
construction of new docks in West Creek over vegetated wetlands pursuant to:
[3] Prohibited locations and activities.
Ia] No new docks will be permitted over vegetated wetlands or such that it causes
habitat fragmentation of vegetated wetlands in the fo/lowing areas: Downs Creek,

In the meantime, please also be advised that we intend to modify our proposal f~om a fixed catwalk to a low-
profile, four-foot wide, fixed "T"-dock that will reach 30 inches of water and allow for dockage of a small
vessel without violating the "one-third rule" set forth by Chapter 275 of the Town Code.
It would likely be helpful to plan to meet at the site during your July field inspections so lhat you can view a
