The following action was taken by the Board of Town Trustees
during their regular meeting held on May 31, 1989 regarding your
request to amend the above permit.
RESOLVED that the Town Trustees Approve the request of J.M.O.
Consulting on behalf of Marjorie Todd to amend permit number 458
to reflect construction of 63' timber bulkhead and backfill with 30
cu. yds. clean sand to be trucked in from an upland source.
This letter is to notify you that we will amend permit on
payment of fees for work to be done and the amended permit shall take
effect as soon as payment is received. All other terms and
conditions in the original permit granted shall remain.

1. That the said Board of Tru~ees anit the Town of Southold are released from any and
all damages, or eld;ms for damages, of suits arising dir~dy or indirectly as a result of any oper-
ation performed pursuant to this permit; and the said Permit'tee will, at his or her own expeme,
defend any and ail such suits initialed by third par~es, and the said Perngttee assumes full liability
with respect thereto, .to the complete exclusion of the Board of Trustees of the Town of Southold
2. That this Permk is valid for a period of 24 mos. which is considered to be the

to maintain the structure or project involved, to provide evidence to anyone concerned that auth-

4. That the work involved will be subject to the inspection and approva/ of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with ~mvigation as a reset of the work
herein authotized.
6. That there shall he no interference with the fight of the public to pass and repass aiong
the beach between high and low water m~rks.
7. That if fumze operations of the Town of ,5outhold require the removai and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, tim

The following action was taken by the Board of Town
Trustees during their regular meeting held on September 29,
regarding the above matter:
1988
WHEREAS after an on site inspection was conducted by the
Trustees it was determined that it would be better for the
applicant to place a suitable fill material and replant and
revegetate in front of the bulkhead as opposed to putting hard
material on this site
WHEREAS there is a healthy marsh fringe around the entire
perimeter of the creek and in front of the stone wall, except in
the area of the jut where the bulkhead is located, NOW THEREFORE
-BE IT
RESOLVED THAT THE TRUSTEES DENY the request made by J.M.O.
Consulting on behalf of Marjorie Todd to amend permit No. 458
because of the potential impact that the stone would have on the
environment.

pleted, the owners, shall without expense to the State, and to such
extent and in such time and manner as the Department of Environmental
Conservation may require, remove all or any portion of the uncompteted
structure or fill and restore to its former condition the navigable
and flood capacity of the watercourse. No claim shall be made against
the State of New York on account of any such removal or alteration. 17.
11. That the State of New York shall in no case be liable for any damage
or injury to the structure or work herein authorized which may'be caused
by or result from future operations undertaken by the State for the
conservation or improvement of navigation, or for other purposes, and
no claim or right to compensation sharl accrue from any such damage.

the U.S. Army Corps of Engineers, U.S. Coast Guard, N@w York State

13 Ali necessary precautions shall be taken to preclude contamination
of any wetland or waterway by suspended solids, sediments, fuels.
solvents, lubricants, epoxy coatings, paints, concrete, leachate or any

other environmentally deleterious materials associated with the
project.
14 Any material dredged in the prosecution of the work herein permitted
shall be removed evenly, without leaving large refuse piles, ridges across
the bed of a waterway or tloodplain or deep holes that may have a
tendency to cause damage to navigable channels or to the banks of
a waterway.
There shall be no unreasonable interference with navigation by the work
herein authorized.
If upon the expiration or revocation of this permit, the proiect hereby
authorized has not been completed, the applicant shall, without expense
to the State. and to such extent and in such time and manner as the
Department of Environmental Conservation may req0ire, remove all or
any portion of the uncompleted structure or fill and restore the site
to its former condition. No claim shall be made against the State of
New York on account of any such removal or alteration.
If granted under Article 36. this permit does not signify in any way
that the project will be free from flooding.
If granted under 6 NYCRR Part 608, the NYS Department of Environ-
mental Conservation hereby certifies that the subject project will not
contravene effluent limitations or other limitations or standards under
Sections 301,302, 303, 306 and 307 of the Clean Water Act of 1977
(PL 95-217) provided that all of the conditions listed herein are met.
All activities authorized by this permit must be in strict conformance
with the,approved plans submitted by the applicant 6r his agent as part
of the permit application.

SPECIAL CONDITIONS
1. There is to be no disturbance to tidal wetlands vegetation as a result of this
project.
2. No construction material, fill or construction debris is to be allowed to
enter the wetlands or ~aterways.

The follow'ina conditions apply to all permits:

If any of the permit conditions are unclear, the permittee shall contact
the Division of Regulatory Affairs at the address and t~tephone noted below.
A copy of this permit or approval and supplementary conditions shall be
awailable at the project site whenever' authorized work is in progress.
The permit sign enclosed with the permit or a copy of letter of approval
shall be protected from the weather and posted in a conspicinus location
at the work site until completion of authorized work.
At least 48 hours prior to commencement of the project, the permittee shall
complete and return the top portion of the enclosed receipt form certifying
that he is fully aware of and understands all provisions and conditions of
this oermit. Within one week of completion of the permitted work, the
botto~ portion of that form shall also be completed and returned.
For projects involving activities to be accomplished over a period er more
than one year, the permittee shall notify the Regional Permit Administrator
in %~iting at least 48 hdurs to the commencement of resumption of work each
year.
If project design modifications take place after permit issuance, the
permittee shall submit the appropriate plan changes for approval by the
Regional Permit Administrator prior to undertaking any such modifications.
The permittee is advised that substantial modification may'require sub-
mission of a new application for permit.
All necessary precautions shall be taken to preclude contamination of any
wetlands or wate~ay by suspended solids, sediment, fuels, solvents,
lubricamts, epo×~Y coatings, paints, concrete, leachate or any other
environmentally deleterious materials associated with the project work.
Any failure to comply precisely with all of the terms and conditions of
this permit, unless authorized in writing, shall be treated as a violation
of the Environmental Conservation Law.
The permi~tee is advised to obtain any permits or approvals that may he
required from the U.S. Department of Army Corps of Engineers, NY District,
26 Federal Plaza, New York, NY 10278, (Attention: Regulatory ~unctions
Br~nch), prior to commencement of work authorized herein.
The granting of this permit does not relieve the permittee of the
responsibility of obtaining a grant~ easement, or other necessary approval
fron the Division of Land utilization, Office of General Services, Tower
Building, Empire State Plaza, Albany, 5~ 12242, which may be required for
any encroactument upon State-owned l&nds under water.

All dredging shall be conducted so as to leave a uniform
bottom elevation free of mounds or holes.
Ail spoil material shall be disposed of either in the
Atlantic Ocean or at an app~7ove~ U.S. Govermmel~t Dumpi~
Ground, as directed by the District Engineer, U.S. Depart-
ment of the Army, Corps of Engineers. Any spoil material
not intended for such water disposal shall be removed from
the site and disposed of at an approved upland site.
All fill and spoil material shall be suitably contained at
the work site so as to prevent its e~oding, leaching or oLher-
wise entering into adjacent w~tlands and waterways.
Ail peripheral tip-top berms, cofferdam0, rock revetments,
gabions, bulkheads, etc. shall be completed prior to plmcement
of any fill material behind such structures.
Ail repmirs to existing structures shall be confined to re-
placement of existing structural elements with no change in
design, dimension, or materials, unless specifically
authorized herein.

The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities· The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subiect this permit to immediate revocation by the Trustees upon receipt by the

The applicant does by the acceptance of this permit, assume all responsibilit'/ for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and proper~ resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of appIicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are oeing coneucted ~o
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially: A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-

The following action was taken by the Board of Trustees during their
regular meeting held on February 24, 1988 regarding the above matter:
WHEREAS, J.M.O. Consultants, on behalf of Marjorie Todd applied to the Southold
Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated September 1, 1987. and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and it is noted for the record they recommended approval of same, and
WItEREAS, a public hearing was held by the Town Trustees with
respect to said application on February 24, 1988 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE, BE IT '
RESOLVED that J.M.O. Consultants, on behalf of Marjorie Todd BE AND HEREBY IS
GRANTED PERMISSION UNDER THE

As amended to construct approximately 63' of timber bulkhead, 6~ seaward of the
existing concrete wall and landward of the existing stone wall located at approximately the
mhw line. Property is located on Bayvie~v Drive, East Marion.

This permit will e×pire on February 24, i990 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of thc work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
insurance policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as ~ name insured. Please take further notice that
thls declaration should not be considered a determination made for
any other department or agency which may also have an application
pending for the same or slmi]ar project.
This determination is not a determination for any other Department or Agency
which may have jurisdiction in this matter. Please return to the Building Dept.
for a determination on the need of any other permits that may be required.
A $10.00 Wetland Inspection Fee is due at this time.

The CAC made the following recommendations at their regular meeting held
Thursday, November 19, 1987:
No. 876 - Richard Mohring, Jr. - Recommend approval.
No. 577 - Anthony W. and Carolyn R. Leggio - Tabled application,
No. 878 - Anthony Robustelli - John Holzapfel will advise the Trustees at
their meeting, Tuesday, November 24, 1987.
No. 579 - Michael J. Schulam -Recommend approval.
No. 580 and 581 - Stephen Perricone- Recommend approval with the stipulation
that the cesspools are placed no closer to the wetlands
than indicated on the submitted plans. The CAC would
prefer that the applicant try to place the cesspools as far
from the wetlands as possible.
No. 582 - Marjorie Todd - Recommend approval with the stipulation that the
bulkhead in installed in kind, in place or behind the existing
structure. Under no circumstances should the bulkhead be placed
within 18" in front of existing bulkhead.
No. 583 - Joseph 13erardino - Recommend approval.
No. 884 - Wunneweta Pond Association - Recommend approval.
No. 585 - John Dwyer - Recommend approval. Suggest work be done as
soon as possible.
No. 586 - Manfred E. Kuerner - Recommend approval with the stipulation
that all runoff (rain,water, etc.) be collected and contained on
site,
