SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State List of Actions, without further steps under SEQRA.
LWRP: This application is not subject to review under Town Code, Chapter 268.
PROPERTY FACTS/DESCRIPTION: The subject property, Lot 5, is a 19,208 square feet
lot (CTM 1000-126-3-5) which was merged with an adjoining 12,650 square foot lot (CTM
1000-126-8-7.3). The parcel to be unmerged has 100 feet frontage along the Wells Road
to the southwest, 184.16 feet along the northwestern boundary, 101.25 along the
northeastern boundary, and 200.00 feet along the boundary of Lot 7.3 to the southeast. Lot
5 is vacant, as shown on a survey by Joseph A. Ingegno, L.S. dated January 10, 2005. Lot
7.3 from which th9 unmerger is sought, is 14,810 square feet in area and has 95.00 feet
frontage along Wells Road.
BASIS OF APPLICATION: Request for a Waiver under Zoning Code Section 280-11, to
unmerge 19,208 square feet of land from the remaining described property. Based on the
Building Department's March 11, 2009 Notice of Disapproval, the properties merged under
Section 280-10(A):'
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on August 27,
2009, at which time written and oral evidence were presented.
1. The subject lot has not been transferred to an unrelated person since the time of
the merger. Ownership of Lot 5 passed from Katherine Tuthill to Agatha (a/ka Ida) Mondello

in 1963, and from her Estate to her son Michael Mongello in 2004. Ownership of Lot 7.3
passed from Katherine Tuthill to Thomas Mongelllo in 1963, and, upon his death in 1990, to
his wife Agatha (Ida) Mongello. Both lots passed from her Estate in 2004 to their son
Michael Mongello.
2. The lot to be recognized has an area of 19,209 square feet and is shown by
Property Map 125 to be larger than the majority of lots in the area.
3. The lot proposed to be recognized is vacant. It has historically been treated and
maintained as a separate and independent residential lot.
4. No evidence was presented to suggest that the waiver of merger would have an
adverse impact the physical or environmental conditions in the neighborhood.

APPLICANT'S REASONS:
(1) The waiver would recognize a lot that is comparable in size to a majority of the
improved lots in the neighborhood because:

LARGER THAN THE MAJORITY OF LOTS IN AREA.

For your information, I have been under contract for sate of Lot
No. 5 to Mr. Joseph J. Finora who resides at 185 Bay Avenue, Mattituck.
g~ile our contract is dated October 21, 2004 we, as you realize, were
unable to close on sale of property due to merger law as it existed
prior to the recent amendment.
I am presently 84 years of age, in failing health, having had
several heart related surgical procedures and the sale of this property
is necessary as I cannot continue to live alone. The proceeds of sale
are to be used for my nursing home care.
The property as identified belonged ~o my parents and was always
a separate and distinct lot and was deeded to me in settlement of my
Mother's estate. Both parcels have never been transferred to an
unrelated person or entity since o=iginatly and separately acquired.
Since we appear to satisfy other provisions of the new law we
respectfully request that you honor the enclosed application to unmerge
our family's property.
If it is necessary to be present at a hearing before your board,
we hereby authorize Joseph J. Finora, Contract Vendee to act on our
behalf.

LWRP CONSISTENCY ASSESSMENT FORM
All applicants for permits* including Town of Southold agencies, shall complete tiffs CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt

It is the applicant's responsibility to call the Department to arrange inspections of the sewage disposal system and water s~ppl5
facilities prior to backfilling. These include inspections of the soil excavation for tbe sewage disposal system, when rcqmrcd,
and inspections of the water supply welI, well lateral, public water supply line, disposal system, piping and final grading. Other
inspections may be required.
Following satisfactory construction and inspections:
1. The applicant must submit 4 prints of an as-built plan (up to and including 1 l"x 17"), by a licensed design profession:i!.
the subject property showing the following:
a. the lot location and metes/bounds description;
b. the lot number(s) and the name of the subdivision, if applicable;
c. permanent structures (i.e., buildings, driveways, walkways, swimming pools, decks, retaining
d. Ibc exact location of the private well and lateral, if applicable (give at least 2 dimensions measured
of the building to the well);
e. thc exact location of the public water linc, if applicable;
