· This apphcat~on MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months fi.om such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

I was able to find copies of the survey ,and the Legal Notice. letters have been mailed out today, I was at the
post office when you called.
As far as the sign, I personally put it up on Sunday morning. It was up all day Sunday and Monday, and 1
removed it today, Tuesday when I left for work, becanse the lawn guys arc supposed to come today' and cut the
grass, and I was afraid they would lose it, or ruin it. I am planning on putting it back up when I get home this
evening.

1) Between September Ist and September 8th: Please send the enclosed Legal Notice,
CERTIFIED MAIL, RETURN RECEIPT REQUESTED, with both a letter including your telephone
number and contact person, and a copy of your map filed with this application which shows
the new construction area, to all owners of land (vacant or improved) surrounding yours, including
land across any street, railroad tracks or right-of-way that borders your property (please see
revised Town Code Ch. 58 enclosed). Use the current addresses shown on the assessment rolls
maintained by the Town Assessors' Office (765-1937) or the County Real Property Office at the
County Center, Riverhead. If you know of another address for a neighbor, you may want to send the
notice to that address as well.
2) Before September 15th: Please make arrangements to place the enclosed poster on a sign
board such as plywood or similar material, posting it at your property for seven days; the si.qn
should remain up until the day of the hearing. Securely place the sign on your property
facing the street, no more than 10 feet from the front property line bordering the street. (If
you border more than one street or roadway, an extra sign is available for the additional front yard.)
If you need a replacement poster, please contact us.
3) Before September 15th, please either mail or deliver to our office your Affidavit of Mailinq

By this appeal, appellant seeks to build a one-
story garage on premises located on a private right-of-way (also
owned by appellant herein) off the south side of P~conic Bay
Boulevard, Laurel, with an insufficient frontyard setback in
lice wlt~ the northeast corner 'of the s~bJect dwelling and with
an insufficient easterly sideyard setback of six feet at the
southerly end O~ the proposed addition and 12 feet at the
northerly end of the proposed addition. The subject dwelling
has existed prior to adoption of the zoning ordinance ~nd is
situated on-the lot at an unusual angle. Running along the
westerly sxde of this premises is a 10' wide foot path. The
Board agrees with reason'ing of the applicant.
The Board finds that the relief requested is not substantial
in relation.to the Code requirements; that the relief requested
is within the spirit of the zoning ordinance; that the variance
will not change the characterof the neighborhood; that no adverse
effects will be produced on available governmental facilities of
any 'increased population: that the practic~.l difficulty is unique;
and that the interests of justice will be served by granting the
relief herein as noted below.
On motion by Mr. Goehringer, seconded by Fir. Douglass, it
was
P~SOLVED0 that Victor E. Catalano be granted a variance to
the zoning ordinance, Article III, Section 100-31 in Appeal No.
2794, as follows:
(1) That the proposed addition be constructed with a minimum
setbadk of 8 feet at the eas~ sid~/~outh end, and
(2) That the proposedaddition be constr~cted with a minim%~n
sethack of 10 feet at the east side/north end, and
(3) That this matter be-refer~edto the Suffolk County
Planning Co~ission pursuant to The Suffolk County Charter.

WHEREAS, a public hearing was held and concluded on
December 8, 1988 in the Matter of the Application of VICTOR AND
LINDA CATALANO under Appeal NO. 3799; and
W~EAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
W~U~EAS, the Beard has carefully considered all testimon~
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is a corner lot located along
the southerly side of Peeonic Bay Boulevard and the westerly
side of a private right-of-way, in the Hamlet of Laurel, Town of
Southold, and is identified on the Suffolk County Tax Maps as
District 1000, Section 128, Block 6, Lot 13.1.
2. The subject premises is identified on the subdivision
Map file~ under Appeals No. 2692 revered May 28, 1980, a~d
under Appeal No. 1914 rendered June 13, 1974, grandfathered by
the Planning Board September 23, 1980 {Section 106-53}, as Lot
NO. 3, containing a total area of 13,727 sq. ft.

3. The subject promises is vacant land.
4. By this application, appellants request a variance from
Article III, Section 100-30 and Section 100-31 for permission to
locate a new principal buildi~ to be used as a poolhouse
(ca3oana) accessory to the adjoining swimmingpool and residence
to the south (on Lot No. 2) as more particularly depicted on the
site plan map prepared by Craig Coronato, Landscape Architect,
dated August 30, 1988. The building is proposed of a size 16'
by 24', located &ppro~m~tely 20 feet from the westerly property
line, 35 feet from the~eastsrly (front) property line, and
approximately 10 feet from the southerly property line (see
landscape plan).
5. Article III, Section 100-30 of the Zoning Cede pexmits
one-family dwellings on a lot, and Section 100~32 ~ertains to
accessory uses or buildings incidental to principal use existing
on the lot. The premises is vacant, and the use of the
poolhouse (cabana) will not include the minimum requirement of
850 sq. ft. of liveable floor area for a single-f~-mily dwelling.
6. For the record, it is noted that the promises was the
subject of prior applications rendered: (a) under Appoal No.
1914 on June 13, 1974, and (bi under Appeal No. 2692 on May 28,
1980.
7. In considering this application, the Board also finds
and determines=
(a) there is no other alternative available for
appellants to pursue other than a variance;
[b) the variance regueated ia uniquel~ related to the
property and will not alter the essential character of the
neighborhood;
(c) the variance requested is the minimal necessary
to afford relief;
(d) the variance will not in turn be adverse to the
safety, health, welfare, comfort, convergence or order of the
town, or be adverse to neighboring properties;
(e) in view of all of the above factors, the

Dear Ms. Tortora,
I have recently received your "Legal Notice" dated August 25, 2003, including a map,
advising me of a Public Hearing being held on September 25, 2003 at 2:20 p.m. from my
neighbor, Mr Victor E. Catalano covering his request for a "Variance" to build a two car
garage on his property that is adjacent to my property. Although he did not sign his
letter, he noted that his daughter, Lisa Cifarelli would be his POA. I assume that this
means "Power of Attorney".
My wife Margaret and I have known Mr. Catalano for many years. We have major
reservations about the "Variance" for a two car garage on his property. They are as
follows:

Mr. Catalano has not been around this area lately in order to use a garage.
Mr. Catalano's daughter Lisa and her husband David Cifarelli, live in the
house on Peconic Bay. This house has a one-car garage, which was added in
the last few years. The second house, north of the Cifarelli house, whose
occupant and owner are unknown, does not have a garage. The proposed site
of the garage is too far and inconveniem for any normal person's use.
What assurances do the bordering neighbors have that:
A. He adheres to the zoning requiremems of property lines and distances
of the Southold Town
B. The garage is a low level one, not more that one story high, and will
not accommodate living quarters for anybody.
C. The automobiles that will be in this garage will be his and will not be
used to store trucks or vans, or be used for any commercial purposes.
My wife and I are planning to attend the hearings on Thursday, September 25, 2003.

Dear Ms. Tortora:
I have received notice of a request for a Variance from my neighbor, Victor C~talano
(05321, hearing on Septembe~ 25 at 2:20pm) and have two concerns.
I abut the Catalano's property on its western side. The proposed garage appears to be
placed within three feet of my property line. I feel that any building conslxucted that close
to my prope~ line would have a negative impact on the value of my property. As I
understand the zoning regulations, the building envelope requires a tea foot setback fi.om
the property line. If the proposed garage is to be approved, I request that the normal
building setbacks apply.
I am concerned about the proposed use of the garage. While convenient to the road, it is
not at all convenient to the two houses already on the property, making it appear to be
impractical as a residential garage. I am aware that Mr. Cifarelli (Mr. Catalano's son-in-
law) runs a window ¢le.~nlng business with several v~n~. I would not want to see the
residemial property adjacent to mine become, in effect, a commercial garage for vans.
Since I will be unable to attend the hearing, I would appreciate it if this could be read

hearing is on behalf of Victor Catalano Is
there anyone here who would like to speak on
behalf of that application?
MR. CATALANO: I'm Victor
Catalano. I've asked for a variance to put a
garage on a lot adjoining my property on
Peconic Bay Boulevard in Laurel. It's a
variance for, I guess, a reduction of the
sideline to the westerly property. There's no
other structure on this lot. It had an
approved building envelope on a prior meeting
that I had with the Building Department
showing where our house and a garage could
eventually go. I've not decided to pursue any
other building ventures, but this garage would
s~rve my house, which is a middle lot on the
property, and as it turns out my daughter owns
a lot on the water that's part of this parcel,
that has a one car garage. My home has no
garage. We have had this situation since 1980
with the front house having one car garage the
middle house having no garage. There's really
no other area to build a garage on either
parcel. I've had both looked at. I think the
survey shows constraints on both sides of the
house, both houses.
CHAIRWOMAN TORTORA: Let me just
stop you. One of the things that a couple of
Board members had asked me about this and
myself, when you're speaking about the three
lots, what we have in our file is one lot.
MR. CATALANO: Okay, I'm sorry.
CHAIRWOMAN TORTORA: So when
.you're referring to where your principal house
is, and your daughter's, that's one of the
problems is that we're trying to review this
application. We don't have a view of the
three lots. All we have here is a survey of
where the proposed garage is, which is, you
know, it's called Lot Number 2, I believe it
is.

MR. CATALANO: Yes, ma'am.
CHAIRWOMAN TORTORA: And we can't
make any assessment as to where your house is,
the distance or any of those other factors
because we simply don't have that. What we
really need to see is, we need to see, you
refer to in your application, you refer to
three lots, and the need for this garage. We
have some concerns from neighbors but we have
nothing, no picture in front of us of where
the three lots are. Ail we have is one
isolated lot, and it's very, very, difficult
for us.
MR, CATALANO: I'm sorry. I
had -- I wasn't advised to provide the other
pictures. I can do that; it's not a problem.
CHAIRWOMAN TORTORA: On the other
two lots do you have a surveys on them so that
when you say, here's my lots and here's --
MR. CATALANO: Yes, ma'am.
CHAIRWOMAN TORTORA: It would make
things so easy for us, because we simply have
no way of calculating the neighbors' concerns
or anything else without looking at all three
together.
And one other thing, I know that
this has been the subject of a number of prior
appeals, and maybe you can clarify this for
us, in 1985 the three lots were created.
Zoning Board of Appeals approval Lot 13-1, Lot
13-2 and Lot 13-3. What happened to 13 1 and
how did we get 13.47
MR. CATALANO: I think it was 2,
3 and 4.
BOARD MEMBER OLIVA: No.
CHAIRWOMAN TORTORA: No. I went
through, and it was like a mystery.
BOARD MEMBER OLIVA: I did too.
CHAIRWOMAN TORTORA: On the old
ZBA approvals it refers to Lot 13-1, 13-2 and
~13-3, and every single variance application
there is no mention of a Lot 13-4. Now when
we look at the tax map we see a lot 13-4, and
13-1 has disappeared. In other words, I'm
trying to cross reference what the Zoning
Board approved before and what we have now and
somewhere along the line Lot 13-1 disappeared
and 13-4 showed up.

MR. CATALANO: Could 13-1 have
been the original total parcel?
BOARD MEMBER OLIVA: We don't
know.
MR. CATALANO: And the resulting
three be 2, 3, and 4. Because I don't ever
remember a 13-1. Honestly, I'll go back in
records. It had been a single parcel when I
bought it in 1980, I believe, and at that
point it then was made into three.
MS. KOWALSKI: That's probably 1.
Usually when a property is redeeded, and it
would have been redeeded sometime after 1979
probably?
MR. CATALANO: Yes.
MS. KOWALSKI: It gets new
numbers.
MR. CATALANO: Because, Linda, I
don't ever remember a 1. I remember my tax
bill 2, 3 and 4.
MS. KOWALSKI: I don't have the
answer for you. You can find out from one of
the real estate offices, either the assessor's
office or the Suffolk County Center Real
Estate office.
BOARD MEMBER GOEHRINGER: Real
property, second floor.
MS. KOWALSKI: Or the assessor's
office can tell you.
BOARD MEMBER HORNING: Sir.
MR. CATALANO: Yes.
BOARD MEMBER HORNING: The most
obvious question here why are you proposing to
locate this garage outside of the building
envelope that you could put it in?
MR. CATALANO: Strictly
aesthetics.
BOARD MEMBER HORNING: Nothing
else on the parcel.
MR. CATALANO: Exactly, to put it
to one side. I only have a neighbor,
residential neighbor to my east. There's no
structure to my west at this point on the lot.
Basically, to make it not as conspicuous in
the middle of the property. As I said, I
don't plan to do anything more. It's really
strictly for garaging vehicles in the winter.
BOARD MEMBER HORNING: And then

you sell a parcel and someone tries to build a
house, and then you have this nonconforming
garage. I don't understand the logic of why
you cannot put it in the building envelope and
conform that way. Your biggest problem is the
use is not allowed. A single family dwelling
would be allowed.
MR. CATALANO: Yes. I was
apprised of that.
BOARD MEMBER HORNING: Not a
garage, but now you're compounding a situation
by wanting to push it up to some setback
that's going to be nonconforming.
MR. CATALANO: This is why I'm
here. I'm asking for that consideration.
Because either way it's either going to be
where I've asked it to be, or it's going to be
in the middle of the property. So either way
it's going to be, because we've decided for
the two family residences we need a garage. I
personally -- we felt it would be
aesthetically more pleasing hidden. I believe
you went to see the property; it's more treed
there. It would be a little more hidden than
stuck in the middle of the property. But if
it's got to go in the middle of the property,
it will go in the middle of the property. I
think it would be much more pleasing to the
eye to my neighbors.
BOARD MEMBER HORNING: You're
asking for a lot in a way. You're asking for
a use that's not conforming and placed in a
nonconforming position on the parcel, when in
fact, you have ostensibly all kinds of areas
where you could place it would be at least
conforming.
MR. CATALANO: Yes, sir, that's
completely correct. There's a building
envelope that we could put the building smack
in the middle and build it as large as we
want, but that was not our desire. We were
trying to keep --
MS. KOWALSKI: I think you were
talking about planning a house for the
future.
MR. CATALANO: Right, exactly.
That was why the building envelope had been
done by the office here, show me what the

building envelope would be, but at this
juncture, I do not have a plan for a house.
CHAIRWOM/kN TORTORA: I think the
most important thing before we -- because
Mr. Horning's raised some good points -- I'm
sure Mr. Goehringer will, but I really think
we need to see what all three properties are.
I see on the survey, I see part of the brick
patio that's over the property line, is that
your property also?
MR. CATALANO: Yes, ma'am.
CHAIRWOMAN TORTORA: See, we're
not looking at everything. We are just
looking at one lot, so we have no idea how it
relates to the three houses.
MR. CATALANO: I had asked that
question, and I was advised that the other two
lots had no impact. In other words, it
really -- the fact that one of the reasons I'm
here, and as far as being a variance, that
it's owned by family members --
CHAIRWOMAN TORTOHA: They would
not have impact as far as the Building
Department, but they definitely have impact as
to whether we're going to grant a variance on
this and our Board, yes, they do.
MR. CATALANO: Right, obviously.
And obviously because there's really no space
on the other two lots that a structure like
this can go.
CHAIRWOMAN TORTORA: We have to
see all that.
BOARD MEMBER HORNING: My
suggestion to you, sir, would be come up with
a plan on that parcel that included a house
and the garage, if that's what you need, and
then you come back to us with that plan so we
would have an idea and with where you would
place a house on there, so that we don't end
up with a nonconforming thing, that - oh,
well the garage is here now and I can't do --
MR. CATALANO: If you look at the
picture, I believe the survey shows one of the
things they suggested was to make sure the
garage stayed within the setback from where a
house would have to be. You have to be 35
feet from the front; you have to --
BOARD MEMBER HORNING: Right. But

you're not proposing that.
CHAIRWOMAN TORTORA: Yeah --
that's why. You're right, I'm not proposing
that.
BOARD MEMBER HORNING: You'd be
better off with a plan for a house, just my
suggestion.
BOARD MEMBER GOEHRINGER: Or merge
both properties.
MR. CATALANO: Excuse me?
BOARD MEMBER HORNING: Or merge
both properties to your existing house. Merge
this lot to your existing house.
CHAIRWOMAN TORTORA: He's saying
combine the lots with your existing house
lot.
MR. CATALANO: And --
MS. KOWALSKI: Waive your right to
a new house.
BOARD MEMBER GOEHRINGER: That is
the only true way that we really can grant an
accessory structure on that piece of property.
In reality we don't do it. It's been done
once; it was done down on Moose Cove, and the
gentleman merged the two waterfront parcels,
and I can tell you that was in 1986. We just
don't do it. We don't create accessory --
cause it's not accessory to anything. There's
no dwelling to make it compatible with.
CHAIRWOMAN TORTORA: In other
words, the other factor if you really look at
this from a legal point of view, the use is
not permitted on a vacant lot.
MR. CATALANO: Vacant lots.
CHAIRWOMAN TORTORA: So,
Mr. Catalano, the criteria for that in the
Town law you wouldn't even want to come in
here with that.
MR. CATALANO: Point of
clarification, one last question, I know it's
running late, a request for the house with the
garage, still requesting a variance to be
over, closer to that lot line.
BOARD MEMBER GOEHRINGER: Over the
building envelope?
MR. CATALANO: Yeah. If I ask for
the house with the garage and the garage being
closer to that lot line --

didn't create that lot line, the Planning
Department created that lot line, that
building envelope and that's something --
MS. KOWALSKI: The Planning Board
did not create a building envelope. It's the
Zoning Board setbacks, and if you can't fit in
the zoning setbacks, then you get an amended
disapproval from the Building Department, and
you could submit a separate variance for that.
MR. CATALANO: But it would have
to be for a house and garage?
CHAIRWOMAN TORTORA: Yes.
MR. CATALANO: And technically, I
can build in stages, right, if I had that
approval for that house and garage, I could
start with my garage and as I went in stages
then --
CHAIRWOMAN TORTORA: Then they
would have to determine that. Do you want to
do this, you kind of -- do you want to
consider some of these alternatives? Because
we could keep adjourning this, but I think Mr.
Goehringer and Mr. Horning are have really
kind of pointed out the Board really doesn't
grant accessory uses on unimproved parcels
because it's not accessory. And in order to
get approval you'd have to have a use
variance; in order to get a use variance, it's
the toughest area in New York State Town Law
to get.
MR. CATALANO: Okay, so then,
basically to come even with a request for the
garage within the building envelope strictly
as a garage probably wouldn't work either. So
it would be the house and the garage.

whole new application for the house and the
garage.
CHAIRWOMAN TORTORA: I think what
you need to do is go over it with the Building
Department first and say, if I do this what
will happen.
MR. CATALANO: Right.
CHAIRWOMAN TORTORA: Because we
can't say how the Building Department's going
to respond. We have an idea, but it's really
up to them to kind of guide you on their end.
MS. KOWALSKI: I think there are
time limits too. You have to build the house
together with the garage. You can't just
build the garage without the house.
CHAIRWOMAN TORTORA: They can go
through those things and different options you
might have with them to get you off in the
right direction.
MR. CATALANO: Okay, so the
Building Department.
CHAIRWOMAN TORTORA: Okay. To
see if anyone in the audience has any
questions or comments or anything.

we'll do is we're going to -- do you want to
close the hearing?

you should recess it without a date. Then you
come back to us when you figure out.

That will leave things open for you after
you've kind of mulled on them, if it does
require a new application, you can go that
route; if it doesn't, you don't have to go
that route.
I'm going to make a motion to
recess it without a date and look over some
options, and I think we've given you some
things to think about.
