Pleased be advised that the Planning Board has received an answer to its
memo to the Building Department for certification of use for your
proposed gas operation at the above location.
The Building Department has determined that the proposed use of this
property (storage and distribution of LP gas) is not a permitted use in
the Limited Business (LB) zone.
You may wish to apply for a variance from the Appeals Board. If you
decide on this course of action you must first receive a Notice of
Disapproval from the Building Department.
Due to the above, we are unable to process your site plan application.
Enclosed please find your site plan application, site plan and check.
If you have any questions, or require additional information, please

Dear Mr. Vitale,
The Planning Staff has received your letter of April 1, 1996, requesting
this Board's initial reaction to your proposal to establish a propane
business with supplemental appliance repair and sales at the above
referenced site.
The location of tile tank and technical data pertaining to the tank,
included in your letter, has been sent to the Building Department for
their review.
Based on your letter of April 1, 1996, it is the Board's understanding
that the propane warehousing and sales will constitute 90% of your
business and the repair and sales of gas appliances 10% of the business.
Warehousing is a permitted use ill this Limited Business (LB) District and
retail sales and repair of gas appliances are uses considered by the Town
Code 100-81 (2) (h) as supplemental to the service business establishment.
Please bear in mind that without a site plan application before this
Board, I can not give you the reaction of the Planning Board. I have
given other town departments information about your proposal, but I
cannot make any commitments on their behalf.
To accommodate the design requirements of this zone, the propane tank
must be screened from view by the building and evergreen plantings.
A twenty foot (20') vegetative buffer must be placed between the Limited
Business zone and the Residentia! portion of the property to the south.
A site plan application must be filed for this proposed use with the
Planning Department. A site plan application is included for your use.
A pre-submission conference with the Board's staff wili insure that the
proposa! meets site plan requirements.

Dear Mr. Vitale,
Thank you for your letter of February 5, 1996, requesting information on
your proposal to locate your propane business at the former site of the D
& D Cycles building on County Route 48. As you know, this area is zoned
Limited Business (LB).
The Town Code is silent on the retail sale of fuel, except for gas
stations.
Gas stations are permitted by special exception in the General Business
zone only.
Perhaps you may wish to petition the Town Board for a change in the
Code to permit this use in certain zones of the Town.
Another approach may be to find a suitable location in the General
Business (GB) zone and try to make the case that the sale of propane is
similar in operation to that of a gas station.
The repair of appliances is a permitted use in the L.B. zone, as is the
sale of appliances incidental to their repair.

(b) The dwelling shall have at least two (2) exits
and there shall be a window large enough for
emergency egress in each guest room.
(c) The identification sign shall be no larger than
two (2) square feet in areas zoned Residential-
Office or higher, but there shall be no exterior
signage identifying the use as a bed-and-
breakfast in residential areas.
(d) No accessory apartment, as authorized by
§ 100-31B(13) hereof, shall be permitted in or
on premises for which a bed-and-breakfast
facility is authorized or exists.
C. Accessory uses, limited to the following uses and subject
to the conditions listed in § 100-33 herein:
,~ (1)Any customary structures or uses which are
customarily incidental to the principal use, except
those prohibited by this chapter.
(2) [Amended 4-9-1991 by L.L. No. 10-1991;
7-28-1992 by L.L. No. 14-1992] Home occupation,
including home professional office and home
business office. In permitting these uses, the Town
Board recognizes that the residents historically have
operated small businesses which provide services to
the community fi.om their homes. The Board finds
that these businesses have not impacted negatively
on the appearance of these residential zones. In the
Board's judgment, it finds that in order to maintain
the economic viability of the town, to maintain the
rural quality of life and in the interests of the
welfare of the residents, these businesses (or home
occupations) should be permitted to continue. In
setting forth the following subsections, the Board
intends to permit as of right certain business uses in
residential zones with the understanding that these
uses are to be conducted in a manner that will not
alter the character of the residential neighborhoods.

Comment: The terms waiver and exceptions are often
used interehangeably. In fact, waiver refers to the sub-
mission of required documents while exceptions are for
relief of design standards in the ordinance.
An applicant may request a waiver of the require-
ment to submit an environmental impact statement for a
small, isolated lot and request an exception to the side-
walk requirement if there are no sidewalks on either side
of the lot. The waiver would be granted by the approving
agency and would be based on whether the documents
for which the waiver is requested have any relevance to
the application or are needed in order to make a decision
on the application.
Cox (1991) notes that a request for a waiver requires
the agency to make findings and conclusions in order to
"permit proper judicial review."

(1) Bulky waste--items the large size of which precludes
or complicates their handling by normal collection, pro-
eessing, or disposal methods; (2) construction and dem-
olition waste--building materials and rubble resulting
from construction, remodeling, repair, and demolition
operations; (3) hazardous waste~wastes that require
special handling to avoid illness or injury to persons or
damage to property; (4) special waste---those wastes that
require extraordinary management; (5) wood pulp
waste---wood or paper fiber residue resulting from a
manufaetufing process; and (6) yard waste--plant clip-
pings, prunings, and other discarded matefial from yards
and gardens.
Land that is barren and uncultivated.
Water carrying wastes from homes, businesses, and in-
dustries that is a mixture of water and dissolved or
suspended solids; excess irrigation water that is runoff to
adjacent land.
A description of existing and future wastewater-related
jurisdictions, wastewater service areas, and selected en-
vironmental features and domestic treatment works sub-
ject to approval by the appropriate state agency.
Any natural or artificial collection of water, whether
permanent or temporary.
The ability of a pipe, channel, or floodway to transport
flow as determined by its shape, cross-sectional area, bed
slope, and coefficient of hydraulic friction.
Any natural or artificial stream, fiver, creek, ditch, chan-
nel, canal, conduit, culvert, drain, waterway, gully, ra-
vine, or wash in which water flows in a definite direction
or course, either continuously or intermittently, and has
a definite channel, bed, and banks and includes any area
adjacent thereto subject to inundation by reason of over-
flow or floodwater.
