Dear Mr. Karbiner:
This is in reference to your letter to the Building Department
of July 12, 1993, requesting guidance on your proposed
subdivision.
Your letter has been referred to the Planning Department for
response.
The proposed subdivision would result in two non-conforming
lots. In order to make an application to the Board of Appeals
for a variance, an application for a building permit would have
to be made to the Building Department. The Building Department
would then give you a notice of disapproval as the lots would be
undersized.
After the notice of disapproval is issued you may apply to the
Zoning Board of Appeals for a variance.
If you require more information, or have any questions, please
contact this office.

I am an owner of the land and single family home located at 155
Sunset Path, Southold, N.Y.(Suffolk Tax Parcei:1000-054-4-33). The
map of the existing property is attached. Last year I also acquired
the adjacent parcel of land (Suffolk Tax Parcel:lO00-054-4-32). I
am proposing to combine both parcels and subdivide the combined
property into two parcels (see proposed subdivision drawing
attached). As noted on the drawing parcel B, which has the existing
house located thereon, would have approximately 38,000 sq.ft, or
.888 acres and parcel A for which I am requesting a building permit
would have approximately 32,000 sq. ft. or .743 acres.
I have been advised that the area requires a minimum zoning of
one full acre which would leave parcel A short by approximately
.257 acres. Since I am not familiar with all the regulations please
advise me if a permit will be granted or denied.
