Binns: (1) South 50 degrees 29' 20" West 195.48 feet to a monument; thence (2) South 42 degrees 09' 00" West 65.10 feet to a monument, from said point of beginning, RUNNING THENCE land now or formerly owned by Dorothy R. Binns and along land of Ressler North 43 degrees 28' 50" West 241.27 feet to a monument; THENCE still along land of Ressler South 46 degrees 27' 00" West 103.00 feet to a monument and land now or formerly of Rysko; RUNNING THENCE along said land South 43 degrees 33' 00" East 59.00 feet to land of Donald P. Robinson; running thence along said land the following two courses and distances: (1) North 42 degrees 09' East 75.00,feet; thence (2) South 46 degrees 33' 50" East 189.51 feet to the Westerly side of Main Road; RUNNING THENCE along said Road'North 42 degrees 09' 00" East 18.00 feet to the point or place of BEGINNING. BEING AND INTENDED TO BE THE SAME PREMISES AS CONVEYED BY DEED LIBER 9124, PAGE 133. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. AND the party of the first part covenants as follows: that said party of the first part is seized of the said premises in fee simple, and has good right to convey the same; that the party of the second part shall quietly enjoy the said premises; that the said premises are free from incumbrances, except as aforesaid; that the party of the first part will execute or procure any further necessary assurance of the title to said premises; and that said party of the first part will forever warrant the title to said premises. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
