We appreciate the cooperation you expressed at our April 3, 1998 meeting regarding the handling of
storm water runoff prior to oufletting to surface waters. Your participation in this effort, by acquiring
and maintaining lands at Hippodrome Creek, Perry's Pond and Moore's Drain, will allow us to
maximize our available resources in designing and constructing detention areas.
At Moore's Drain, which is presently owned by the Town, we will construct a detention pond to be
compatible with the development of an information center and recreation area. At Hippodrome CYeek
and Perry's Pond, we will detain runoff in an existing swale to minimize the impact on the natural

acceptance by the N.Y.S. Department of Envirenmental Conservation. Should you have any questions

the MOU expeditiously in order that we may progress design and conform to our procedural
requirements. Please let us know if you find the MOU acceptable by August 3, 1998. Our current
schedule calls for a November 2000 letting.

MEMORANDUM OF UNDERSTANDING
for Mitigation of impacts to surface waters NYSDOT PIN 0041.99
in the Town of Southold
This is a Memorandum of Understanding (MOU) by and between the:
New York State Department of Transportation (NYSDO'r),
acting through the Regional Director of Region 10,
State Office Bldg. Veterans Memorial Highway, Hauppauge, NY 11788,
and
Town of Southold (the ~Town"), acting through its
Main Road, Southold NY
with offices at Town Hall,

Whereas, NYSDOT is responsible to address issues relating to mitigation of State highway
stormwater runoff impacts on surface waters; and
Whereas, runoff from lands within the Town discharges on to State Route 25 in the hamlets
of Cutchogue, Peconic and Southold and outlets to lands which form the Peconic Estuary; and
Whereas, the NYSDOT and the Town desire to cooperate in the preservation of water quality,
Now therefore, the parties agree as follows:
1. NYSDOT will design and construct are'as on lands owned by the Town and made
available to NYSDOT for the detention of highway runoff within the project limits of PIN
0041.99; Rte. 25, Highland Rd. to 6th St. in the vicinity of Hippodrome Pond, Perry's Pond
and Moore's drain.
2. The Town will fumish the lands by dedication of presently owned lands or acquisition
of rights to privately owned lands and shall provide any easements necessary for NYSDOT's
entry, construction, installations or discharge of surface waters. The shape, dimensions and
location of the following lands will be determined by NYSDOT in coordination with the NYS
Department of Environmental Conservation and the Town.

3. NYSDOT will own, clean and repair all pipe and structures collecting highway runoff
upstream of the point of discharge into the detention area. The point of discharge is defined
as the pipe end section from which runoff conveyed by the closed systems inlets to the
detention area.
4. The Town will own or retain the rights to lands containing the detention areas and
provide all maintenance except as noted in Item 3. Maintenance shall include trash removal,
control and preservation of landscaping, cleaning and repair of the outlet pipe and structure
and the preservation of all slopes and embankments.
5. The duration of this agreement shall be permanent. The lands shall be available for
construction 6 months prior to the letting date.
