Lane, Peconic, New York 11958; party of the second part,
WITNESSRTH, that the party of the first part, in
consideration ~f Ten Dollars and other valuable
consideration pazd by the party of the second part, does
hereby grant and release unto the party of the second
part, the heirs or successors and assigns' of the party of
the second part forever,
ALL that certain plot, piece or parcel of land, with the
buildings and improvom~nts thereon erected, situate, lying
and being near Peconic, in the Town of Southold, County of
Suffolk and State of New York, hounded and described as
follows:
BEGINNING at a monument at the southeasterly corner of
land of the party of the second part, said point of
beginning being the northeasterly corner of Lot 4 as shown
on "Map of Hickory Acres" filed in the Suffolk County
Clerk's Office as Map No. 3325, from said point of
beginning running along said land of the party of the
second part North 33 degrees 31 minutes 50 seconds West, a
distance of 247.50 feet to a monument, thence along land
of the party of the first part, two courses, as follows=
(1) North 57 degrees 04 minutes 40 seconds East, a
distance of 425.0 feet to an iron pipe; thence
(2) South 30 degrees 22 minutes 20 seconds East, a
distance of 259.39 feet to an iron pipe and land of Luce
and others; thence along said land of Luce and others,
South 58 degrees 42 minutes 10 seconds West, a distance of
411.0 feet to the point of BEGINNING. Containing 2.431
acres according to survey of Van Tuyl & Son dated March
12, 1965.
BEING A~D INI~NDED ~O BE the same premises conveyed to the
Grantor by Deed dated April ~, 1965 and recorded in the
Suffolk County Clerk's Office on May 4. 1965 in Liher 5739
page 280, th? Grantor being the same person described as
the Grantee zn sazd Deed.
TOGETHER with all right, title and interest, if any, of
the party of the first part in and to any streets and
roads abutting the above described premises to the center
lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to
said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or
successors'and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party
of the first part has not done or suffered anything
whereby the said premises havebeen encumbered in any way
whatever, except as aforesaid.
AND the party O~ the first part, in compliance with
Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this
conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the
improvement before using any par~ of the total of the same
for any other purpose.
The word "party" shall be construed as if it read
'parties" whenever the sense of this indenture so
requires.
