BASIS OF APPLICATION: This is a request for Variances under Section 280-124, based on the Building~ Inspector's revised December 30. 2008 Notice of Disapproval concerning a proposed new single-family dwelling (after demolition of the existing building) in a location with front yard setbacks at less than 35 .feet: on this 10,067 square fooc parcel. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 19, 2009, at which time written and oral evidence were presented. Based upon ail testimony, documentation, personal inspection of the prope~rty and other evidence, the Zoning Board finds the following facts to be true and relevant: RELIEF REQUESTEp: Demolition of the existing building and construction of a new single family dwelling on 10,067 square foot in an R-40 Residential Zone. The property is on a corner lot with two front yards (two street frontages) which creates the required 35 ft. minimum setbacks. The existing home hes 1.2 feet from the front line adjacent to Locust Lane, and the new construction proposes an increase to 9.7 feet by removing the attached enclosed porch. The existing and proposed setback from the front line adjacent co Korn Road will remain at +/- 9 feet. Applicant will use the existing brick foundation to construct new dwelling. Town Law .q267-b(3)(b)(3)(1). Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The present home is more than 100 y~ars of age and in poor condition. Based upon testimony received at the hearing, the Applicant indicates that the only economical way is to demolish and substantially rebuild a home using the same foundation area, rather than to renovate and upgrade the exist/ng home. The home has been in its present noncon/orming location for more than 100 years. The back yard of the home lacks the necessary elevation to support a new home without significant filling, The remaimng yard area is surrounded on the n~rth west side wit]~ a large vegetated berm that could cause a drainage problem if leveled. No testimony was submitted to indicate that the replacement of this home as requested with more conformity to Codes would cause a detriment to the immediate neighborhood. 2. Town Law q267-b(3)(b)(3)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue other than an area variance. The homes in the immediate area vf this home share s£milar unique circumstances, to include small substandard lots, with varied nonconforming · setbacks. This applicant could change the location of this home, however, not without a much greater cost of construction, such as filling, need for proper drainage ~f the remaining lot, and cost to build a new foundation. 3. Town Law §267-b(3)(b)(3). The amount of relief is substantial~ inasmuch as it is based on present zoning code reqmrements. However, when considering the applicant will utilize the existing foundation which predates the current codes, the new home will be a substantial improvement and is in keeping with those on nearby lots with their varied setbacks. 4. Town Law §267-b(~](b)(5). The relief requested is not self-created. The applicant wishes to utilize the ex~sting foundation for-the new construction. 5. Town Law ~267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The Board finds the' rehef granted for a new dwelling on the existing foundation will not impact a neighborhood of similar types of homes at varied setbacks, nor will it compromise the physical or environmental characteristics of the immediate neighborhood. 6. Town Law §267-b. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of his property, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
