Dear Applicants:
Based on the information you have submitted, the New York State Department of Environmental
Conservation has made the following determination.
The property landward of the 10-foot elevation contour interval, as shown on the survey prepared
by John C. Ehlers last revised on 11/3/02, is beyond the jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6 NYCRR Part
661) no permit is required under the Tidal Wetlands Act. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal
wetlands jurisdictional boundary, as indicated above, without a permit. It is your responsibility to
ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction which may
result from your project. Such precautions may include maintaining adequate work area between
the tidal wetland jurisdictional boundary and your project (i.e. a 15' to 20' wide construction area)
or erecting a temporary fence, barrier, or hay bale berm.
Please be further advised that this letter does not relieve you of the responsibility of obtaining any
necessary permits or approvals from.other agencies.

The following action was taken by the Southold Town Board of Trustees on Wednesday
March 23, 2005:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit # 5485 as follows:
Demolish the existing wood frame house, with the exception of the existing foundation,
and distribute the excavated soil from the digging of the new foundation onto the
existing lawn area between the house and the top of the bank, construct a retaining wall
in line with the retaining wall on Mr. Wipf's property next door, 15' seaward of the
house/deck, with no turf seaward of the retaining wall, and as depicted on the plan
surveyed by John Ehlers, revised 2-15-05, and the area of the retaining wall added 3-
24-05 by Bay Creek Builders.

Gentlemen:
The following action as taken by the Board of Town Trustees during a Regular Meeting, held on
January 23, 2002, regarding the above matter.
WHEREAS, Architecnologies on behalf of CHRISTOPHER & GLORIA GROOCOCK
applied to the Southold Town Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated November 29, 2001
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Heating was held by the Town Trustees with respect to said application on
January 23, 2002 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT.
RESOLVED, that the Board of Trustees approved the application of Christopher & Gloria
Groocock for a Wetland Permit to construct an addition to the existing first and second floor
with the stipulation that there will be drywells and gutters on the addition to catch the roof run-
off also include a dock 48 feet in length with ramp and a float as per plans and the pilings be no
greater than 6"x6" and the (one) handrail be no greater than 3 feet above the decking of the dock.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified when project is started and on
completion of said project.

a.4:~ application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
APPLICATION IS HEREBY MADE to the Building Department for the issuance of a Building Permit pursuant to the
Building Zone Ordinance of the Town of Southold, Suffolk County, New York, and other applicable Laws, Ordinances or
Regulations, for the construction of buildings, additions, or alterations or for removal or demolition as herein described. The

Supply ducts in unconditioned spaces must be insulated to R-8.
Return ducts in unconditioned spaces (except basements) must be insulated to R-2.
Insulation is not required on return ducts in basements.
Duct Construction:
All joints, seams, and connections must be securely fastened with welds, gaskets, mastics
(adhesives), mastic-plus-embedded-fabric, or tapes. Duct tape is not permitted.
Exception: Continuously welded and locking-type longitudinal joints and seams on ducts
operating at less than 2 in. w.g. (500 Pa).
Ducts shall be supported every 10 feet or in accordance with the manufacturer's instructions.
Cooling ducts with exterior insulation must be covered with a vapor retarder.
Air filters are required in the return air system.
The HVAC system must provide a means for balancing air and water systems.
Temperature Controls:
Each dwelling unit has at lesat one thermostat capable of automatically adjusting the space
temperature set point of the largest zone.
Electric Systems:
Separate electric meters are required for each dwelling unit.
Fireplaces:
Fireplaces must be installed with tight fitting non-combustible fireplace doors.
Fireplaces must be provided with a source of combustion air, as required by the Fireplace construction
provisions of the Building Code of New York State, the Residential Code of New York State or
the New York City Building Code, as applicable.
Service Water Heating:
Water heaters with vertical pipe risers must have a heat trap on both the inlet and outlet unless the
water heater has un integral beat trap or is part ora circulating system.
Insulate circulating hot water pipes to the levels in Table 1.

Swimming Pools:
All heated swimming pools must have an on/offheater switch and require a cover unless over 20%
of the heating energy is from non-depletable sources. Pool pumps require a time clock.
Heating and Cooling Piping Insulation:
HVAC piping conveying fluids above 105 °F or chilled fluids below 55 °F must be insulated to the
levels in Table 2.
