Box 1179 Southold, New York 11971-0959 Telephone (631) 765-1892 Fax (631) 765-6641 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD April 20, 2005 Barry X Ball and Kimberly Van Zee 525 Cedar Birch Lane Orient, NY 11957 RE: 525 CEDAR BIRCH LANE, ORIENT SCTM# 15-8-26.7 & 26.8 Dear Mr. Ball and Ms.Van Zee: The Board of Town Trustees took the following action during its regular meeting held on Wednesday April 20, 2005 regarding the above matter: WHEREAS, BARRY X BALL AND KIMBERLY VAN ZEE applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated October 25, 2004 and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 20, 2005 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, RESOLVED, that the Board of Trustees approve the application of BARRY X BALL AND KIMBERLY VAN ZEE to remove debris, poison ivy, and invasive non-native species, and re-plant with native species and groundcover, as approved by the NYSDEC, in the 50' wide buffer and along the driveway; repair the bridge to the island; renovate existing dock and boathouse; remove debris, poison ivy, and invasive species from island at southern end of property; re-gravel driveway south of house as needed; renovate the existing dock on the pond on the east side of the house, trim Phragmites along the western edge of the pond to 2', and all as depicted on the plan surveyed by Stanley J. Isaksen, Jr. dated August 23, 2000, and revised by Barry X. Ball on April 20, 2005. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) We very much want to comply with all the laws, ordinances and regulations that apply to our property, and toward that end we believe that a meeting at our property will be valuable for both us and the Board. On September 3, an officer of the Southold Police Department - Bay Constable visited our Orient home and delivered a Notice of Violation stating that "clearing of underbrush has taken place within 100' of a wetland". The great sympathy and professionalism the officer displayed when he visited with us helped somewhat to alleviate our shock and consternation in receiving the summons. The officer complimented us on our efforts to enhance our property and encouraged us to apply for a permit for the work on our property we have already performed. If a permit is necessary, we will apply for one. We, however, believe that the horticultural maintenance work on our property that we have performed already and plan to perform in the future does not require a permit, for several reasons. We think that that a site visit to our property by the Board will make this apparent. The Certified Arbodst, Ned Harroun of Island Tree Service, who has been performing the work on our property, has also worked for many years with the various municipalities and town governments on the North Fork. Ned has offered to be at our property on the 13th to detail for the Board the work that he has done and will do at our property. We have enclosed a survey of our entire property as well as a couple ancillary maps. We have marked the survey to indicate where we have already done horticultural maintenance work / trash removal and where we plan to do more. We pumhased our property in September, 2000. Our entire property (including the house), was in serious disrepair when we took possession. The property had in recant years apparently been used as a dumping ground - by previous owners and soma of the general public. Mounds of debris, rusting farm equipment, lengths of fencing, stacks of cinder blocks, rotting log heaps, piles of decrepit plastic oyster boxes, etc. were strewn all over the property. Soma of this debris had damaged and killed trees and bushes. Part of our recent "clearing" work on the property has involved the removal of this extensive rubbish (enough to fill a very large dumpster). Our property is zoned "Agricultural", and it was quite recantly cultivated and farmad in its entirety. (VVe have access to photographs that documant this.) The man from which we pumhased our property (Richard Cantwell) used large parts of the land to commercially cultivate herbs for a line of gourmat vinegars he produced. A defunct irrigation system crisscrosses large sections of the property. All of the bodies of water on our property and abutting our property (labeled "ponds" on the survey) are man-made / artificial, and hence do not quali~ as "wetlands". Mr. King, who owned much of the Eastern tip of the North Fork at one time, dug these ditches as agricultural reservoirs and landscape features. The man-made circular "pond" near the southern tip of our property even includes a dock, boathouse, artificial "island" (replete with flagpole), and bridge - all created by Mr. King as a kind of fantasy kingdom for his family. Vera King Wilson, Mr. King's eldest surviving daughter and our neighbor on Cedar Birch Lane (the private road on the survey that we own), has regaled us with stodes of life in timas past amidst her father's creations on our property. Richard Cantwell utilized the rectangular pool near our house for the commercial cultivation of oysters. This reservoir has a dock, complete with heavy electrical power, that he used in that enterprise. We have already spent tens of thousands of dollars (and we are folks of relatively modest maans!) working with Ned Haroun trying to save the trees and native vegetation on our property. We have done no clear-cutting. On the contrary, we have rescued as many trees and speciman plantings as possible - including seedlings of only a few inches in height. In the process of reviving the vegetation on our property, we have cleared away non-native bramble, multiflora rose, Oriental bittersweet, etc., as well as poison ivy. We have not cut any Phragrnites australis. After years of neglect, many of the invasive species had choked, disfigured - and killed in some cases - some beautiful trees and bushes on our property. The profusion of the invasive undergrowth had also almost made sections of Cedar Birch Lane impassible to cars. Several of our neighbors on Cedar Birch Lane are elderly and disabled, and they depend on "Meals-on-Wheels" on a daily basis. Before we cleared the undergrowth, the Meals-on-Wheels vehicles, ambulances, fire trucks, and mail-delivery vehicles had difficulty driving down the road. Our neighbors are glad that we have restored the road access - we had received complaints from them about this before we cleared the undergrowth. Prior to the undergrowth clearing, our own curving driveway (to the south of our house) had, literally, become impassible to cars. It seems reasonable that we be able to maintain a safe, clear passage onto our property. We would also like to mention that our children (ages 8 and 12) have both had multiple cases of severe reactions as a result of contact with the poison ivy on our property. We have reluctantly had to resort to the use of dsky steroid medications for both kids on occasion, and both have missed many days of school with the condition. One incident almost led to hospitalization. Our elderly father and mother (she is on chemotherapy for cancer) have been affected by poison ivy on the property, too. It was dangerous for our children to dde their bikes down our driveway because of the protruding poison ivy. My son also contracted Lyme disease on our property. The increase in the deer population on our few acres is dramatic. The rampaging underbrush growth has facilitated this, as well as served as a haven for the deer tick population. And there was a marked increase in the mosquito population this summer - the damp underbrush was a perfect mosquito spawning ground. If for no other reason than to preserve the health of our family, we believe our selective underbrush clearing is prudent and advisable. We feel that our work to-date to maintain and improve our property has been performed in an extremely sensitive, responsible, and entirely legal manner. We are confident that the Board will agree with that assessment. We consider ourselves environmentalists, and we want to preserve the natural environment and beauty of our property, our refuge in Odent, for ourselves and our neighbors. A New York State Department of Environmental Conservation officer visited our property a few days before the Southold Police Department - Bay Constable officer came by. The DEC officer called back and reported to us that our work on our property was in compliance with DEC regulations. After apparently receiving the DEC's approval, the Notice of Violation that the Southold Police officer delivered was especially perplexing. We are somewhat upset and concerned that apparent multiple complaints have been lodged against us (erroneously, we feel) because of our work on our property. The officers that visited us told us that the complaints had been filed by a fellow citizen or citizens.
