Present Were: Absent Were: James Eckert, Chairman Jack McGreevy, Member Peter Young, Member Doug Hardy, Member Greta Schiller, Member Lauren Standish, Secretary Anne TrJmble, Member Scott Worth, Student Member Dave Bergen, Trustee CALL TO ORDER Chairman James Eckert called the meeting to order at 4:30 PM. REPORTS Chairman James Eckert asked for comments from the members regarding the memo from Supervisor Russell requesting the CAC to conduct compliance inspections for the Board of Trustees. The majodty of the members agreed to assist with the inspections, rotating each month with the inspections for new applications before the Board. Chairman Eckert said he would discuss the matter further with Trustee Dave Bergen. Member Peter Young reported that the stake and pulley system inventory is complete and has been submitted to the Board of Trustees. The mooring inventory is on hold until a vessel becomes available or a Bay Constable can assist. The inventory may have to wait until next year. Peter stated that the Trustee should consider raising the permit fees for moorings and stakes. The other members agreed and offered to make recommendations. Peter volunteered to research the Town Codes for East Hampton, Southampton and Shelter Island, as a comparison. APPROVAL OF MINUTES Moved by Peter Young seconded by Jack McGreevy, to Approve the Minutes of July 15, 2009. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by James Eckert, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of JAMES MANNING for the existing 4' wide stairs to beach, total run 33' with three 4'X 4' landings and 11'X 15' deck, and a 5.3'X 15.1' boat shed. Located: 1370 Jackson St., New Suffolk. SCTM#117-10-10 Inspected by: James Eckert The CAC Supports the application with the Condition the slope is maintained as a non- disturbance buffer, the pool backwash is contained into a drywell, and any future work on the deck (attached to the stairs) and shed should be done in compliance with the current code. Vote of Council: Ayes: All Motion Carded Moved by Greta Schiller, seconded by Doug Hardy it was RESOLVED to SUPPORT the Wetland Permit application of HENRY KAMINER to replace the existing deck, extend screened-in porch over deck, reconstruct screened porch and new stairs off deck, and replace the existing windows with sliding doors onto deck and access to top of porch/balcony. Located: 130 Midway Rd., Southold. Located: 405 Cedar Point Dr. West, Southold. SCTM#90-2-27 Inspected by: Doug Hardy, Greta Schiller Vote of Council: Ayes: All Motion Carried Moved by James Eckert, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of SUSAN CEBULSKI, ARTHUR FARNBACH AND PAUL FARNBACH to construct onto existing one-story, one- family dwelling a second-story addition over the existing first story (to remain), a covered porch and steps, one-story fascia addition beneath proposed second-story, 2'X 16' one- story addition, 5'X 10' second-story deck; construct a 13'X 28' wood deck and 5.5'X 8' steps in place of existing concrete patio and wood deck and steps to be removed; remove existing sanitary system and install relocated, upgraded sanitary system; and install a drainage system of drywells and public water service. Vote of Council: Ayes: All Motion Carried Moved by James Eckert, seconded by Peter Young, it was RESOLVED to SUPPORT the Wetland Permit application of RYAN STORK to demolish an existing single-family dwelling; construct a new two-story single-family dwelling approx. 32'X 70' overall, with a full basement, and in a new location 75' from the bulkhead. 4 Demolish an existing garage/guest house; construct new garage approx. 22'X 37' overall in new location landward of new dwelling. Abandon existing on-site sewage disposal system; construct new sewage disposal system in a new location more than 100' from the wetlands. Located: 3270 Peconic Bay Blvd., Laurel. SCTM#128-6-8 inspected by: James Eckert The CAC Supports the application with the Condition of a 10' non-turf buffer, hay bales and silt fencing are installed pdor to all construction activities, and gutters and drywells are installed to contain roof run-off. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Greta Schiller, it was RESOLVED to SUPPORT the Wetland Permit application of JOHN FlSCHETTI & DEBORAH DEAVER to re-trim and shingle the existing dwelling; provide new front porch with roof; provide 6' addition to existing deck; new roof deck; and construct an addition to the existing mud room. Located: 1675 Pine Neck Rd., Southold. Located: 1265 Shore Dr., Greenport. Located: 6300 Indian Neck Lane, Peconic. SCTM#86-7-2.1 Inspected by: James Eckert The CAC Supports the application with the Condition of a 10' non-turf buffer from the patio to the bluff, and gutters and drywells are installed to contain roof run-off. SCTM#10-7-15 Inspected by: Greta Schiller, Doug Hardy Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to NOT SUPPORT the Wetland Permit application of CARDINAL EAST COAST DEVELOPMENT, LLC to remove and replace (in-place) approx. 87 If. of existing timber bulkhead with vinyl bulkhead; remove and replace (in-place and raised 12") approx. 130 If. of existing timber bulkhead with vinyl bulkhead; remove and replace (in-place and raised 12") variable width (23' max.) X 130' deck (including 4'X 5' step-down); remove and replace (in-place) 2.5'X 10' ramp and 6'X 30' float; backfill with approx. 35 cy. of clean sand fill to be trucked in from an approved upland source; and temporarily remove, side, re-shingle, and refurbish existing +14.5'X 14.5' boat house. SCTM#111-14-33.1 Inspected by: James Eckert, Doug Hardy The CAC does Not Support the application because the deck is on Town property and is in violation of the Public Trust Doctrine, and the bulkhead should be replaced in the same dimension (height) as per the Town Code. Vote of Council: Ayes: All Motion Carried Moved by James Eckert, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of EDNA MCNULTY to construct a fixed timber dock consisting of a 4'X 90' fixed timber catwalk (elevated 4' 6 above grade of marsh), a 3'X 20' hinged ramp, and a 6'X 20' floating dock supported by (2) 8" dia. pilings. Located: 875 Westview Dr., Mattituck. SCTM#139-1-18 Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATIONS OF APPLICATIONS TO AMEND PERMITS JOSEPH ZEVlTS to Amend Permit #6928 to construct a single-family dwelling 50' from the wetland boundary, a northerly deck 48' from the wetland boundary, and a second deck and stairs facing the water. Located: 1945 Little Peconic Bay Lane, Southold. SCTMf190-1-13 The CAC did not make an inspection, therefore no recommendation was made. Moved by Peter Young, seconded by James Eckert, it was RESOLVED to SUPPORT the application of JAMES BAKER to Amend Permit #6619 to construct 8 If. of new 4' wide wood post and framed stairs with a rail mounted to an existing dock waterward of the 10' elevation contour. Construct a 10'X 8' landing with a dock box, construct 38 If. of timber/stone steps with roils set in the existing bank leading to a new 4'X 4' wood post and framed landing at the top of the bank, and install Iow intensity lighting and water service. Located: Peninsula Rd., Fishers Island. SCTM#10-5-9 Inspected by: Peter Young, Greta Schiller, Doug Hardy The CAC Supports the application with the Condition appropriate materials aro used (no CCA), and the landing is reduced and constructed in compliance with the Town Code. Vote of Council: Ayes: All Motion Carded Moved by James Eckert, seconded by Peter Young, it was RESOLVED to SUPPORT the application of MICHAEL & ROBIN DREWS to Amend Permit #6430 to alter the previously approved deck areas with a new hot tub, pond and barbeque aroa. Located: 7425 Nassau Point Rd., Cutchogue. SCTM#118-4-2 Inspected by: James Eckert Vote of Council: Ayes: All Motion Carded 7 Members Doug Hardy and Greta Schiller will attend the next regular meeting of the Board of Trustees scheduled for Wed., August 19, 2009. The next meeting of the Conservation Advisory Council has been set for Wed., September 16, 2009 at 4:30 PM at Down's Farm Preserve.
