WITNESSETH, that the party of the first part, by virtue of the
power and authority given in and by said last will and testament,
and in consideration of Zero (-0-) dollars, paid by the party of
the second part, and made in accordance with the Drovisions of the
Last Will and Testament of the above decedent, does hereby grant
and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings
and improvements thereon erected, situate, lying and being at
Cutchogue, Town of Southold, County of Suffolk and State of New
York, bounded and described as follows:
BEGINNING at a point on the westerly side of a Private Road owned
by Case the following courses and distances from the intersection
of the south side of Main Road and the westerly side of Case's
Lane,
1) southwesterly from said intersection along the southerly
side of Main Road 764.98 feet to the westerly side of
Private Road:
2) thence along the division line of the westerly side of said
Private Road and the easterly side of Land now or formerly
of Roger's South 14 degrees 43 minutes 10 seconds West 325
feet;
3) thence along the land now or formerly of Case and the
southerly side of said Private Road south 50 degrees 25
minutes East 225.94 feet to the easterly side of said
Private Road;

SUBJECT to an Indenture Agreement recorded in the Suffolk County
Clerk's Officer on 10/11/72 in Liber 7259 Pages 347-354 and the
Grantee herein agrees to be affirmatively bound by the Covenants
of said Indenture.
TOGETHER with all right, title and interest, if any, of the party
of the first part in and to any streets and roads abutting the
above described premises to the center lines thereof;

12, 1980 and recorded December 22, 1980 at LIBER 8933 AND PAGE
291". Robert W Brown DIED January 31,.2005 Testate on March 3,

TOGETHER with the appurtenances, and ali. the estate and rights of
the party of the first part in and to said premises
TO HAVE AND TO HOLD the premises herein granted unto the party of
the second part, the heirs or successors and assigns of the party
of the second part forever.
AND the party of the first party covenants that the party of the
first part has not done or suffered anything whereby the said
premises have been incumbered in any way whatever, except as
aforesaid.

AND the party of the first part, in compliance with Section 13 of
the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any
other purpose.
The word "party" shall be construed as if it read "parties"
whenever the sense of this indenture so requires.
