ELIZABETH PURDY MARTIN, as to an undivided fifty (50%) percent
interest, as Trustee of The Elizabeth Purdy Martin Qualified Personal
Residence Trust Number Two dated October 9, 1998, residing at 411 Pebble
Creek Court, Venice, FL 34285,
party of the secopd part,
WITNESSETH, that the party of the first part in consideration of TEN ($10.00) DOLLARS and other
valuable consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part its interest forever
the following described property:
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon, erected,
situate, lying and being in the Town of Southold, County of Suffolk, and State of New York, more
particularly described as follows:
BEGINNING at a point on the Northerly side of Sound View Avenue a distance easterly of 300 feet
measured along the northerly side of said Sound View Avenue from the Southeasterly comer of the lands
of H.J. Osborne on a line running North 73 degrees 27 minutes 30 seconds East;
THENCE along lands now or formerly of Gladys W. Shinkle in a northerly direction North 10 degrees
56 minutes 40 seconds West a distance of 588.59 feet to the average high water line of Long Island
Sound;
THENCE running in a general easterly direction along the average high water line of Long Island Sound
North 89 degrees 54 minutes 30 seconds East a distance of 100 feet;
THENCE running in a general southerly direction along other lands now or formerly of Gladys W.
Shinkle, South 11 degrees 04 minutes 40 seconds East a distance of 560 feet to the northerly side of
Sound View Avenue;
THENCE running in a general westerly direction along the northerly side of the said Sound View
Avenue South 73 degrees 27 minutes 30 seconds West a distance of 100 feet to the point or place of
BEGINNING.
No building will be constructed by the party of the second part, or by his heirs or assigns that will cost
less than $3,500.00.
Together with all the right, title and interest of the party of the first part of, in and to the beach and land
under water of the Long Island Sound in front of and adjacent to the said premises.
Together with all of the right, title and interest of the party of the first part of, in and to Sound View
Avenue lying in front of and adjacent to the said premises.
SUBJECT TO:
1. Covenants and restrictions contained in instrument recorded in Liber 2397 of Conveyances, Page
579.
2. Any state of facts that an accurate snrvey m~y show.
3. any encroachments by the waters of Long Island Sound.
4. The right of the government of the United States to change the Harbor line adjacent to the
promises herein or to establish a bulkhead line different from said Harbor line; together with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part and to said premises; TO HAVE
AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors
and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the
party of the first part in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total
of the same for any other purpose.
TI'lIS CONFIRMATORY DEED is being recorded to confirm the previous conveyance in the Deed
dated October 9, 1998, recorded March 23, 1999, in Book 11952, page 917, which was executed and
delivered contemporaneously with, but which was inadvertently recorded out of order, and prior to the
Deed dated October 9, 1998, recorded March 23, 1999, in Book 11952, page 918.
The word "Party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

above written.
