WITNESSETH,that the party of the first part,to whom permanent and unrestricted letters
testamentary were issued by the Surrogate's Court, New York County, New York
on December 13, 1989 and by virtue of the power and authority given in and by said last will
and testament, and/or by Article 11 of the Estates, Powers and Trusts Law, and in consideration of

paid by the party of the second part, does hereby grant and
release unto the party of the second part, the distributees or successors and assigns of the party of the second
part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and beings as set forth on the annexed Exhibit
SUBJECT TO A MORTGAGE dated April 4, 1984 to Colonial Mortgage Corp.
or its successors and assigns in the principal sum of $72,650.00 as
presently reduced, which mortgage the party of the second part by
the execution of this deed agrees to assume and pay in accordance
with its terms.
BEING and intended to be the premises conveyed to Jay Herbert now
deceased by Bargain and Sale Deed of Maurice Ekus, dated March 11,
1985 and recorded at Liber 9758, page 17 in the Suffolk County
New York Clerk's office on March 25, 1985.
