THIS INDENTURE, made the 18th day of November, two thousand and eight,

James Mardikos and Helen Mardikos, 36 Belmont Place, Staten Island, New York 10301,
party of the first part,
and
Nicholas J. Mardikos, 55 Fort Hill Circle, Staten Island, New York 10301, and Theodosi J.
Mardikos, 63 Fort Hill Circle, Staten Island, New York 10301, as Trustees of The James
Mardikos Irrevocable Trust, dated 11 / 18/08,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of ten dollars and no/100
($10.00), lawful money of the United States, to them paid by the party of the second part, does
hereby grant and release unto the party of the second part, the heirs, successors or assigns of the
party of the second part forever,
ALL that certain lot, piece or parcel of land together with the buildings and improvements located
and to be erected thereon, situate, lying and being at East Marion, Town of Southold, County of
Suffolk, and State of New York, more particularly bounded and described as follows:
See Schedule A annexed.
BEING the same premises conveyed by Walter W. Washburn and Sena E. Washburn, Grantor,
to James Mardikos and Helen Mardikos, Grantee, by Deed dated October 20, 1961 and recorded
in the Suffolk County Clerk's Office on October 24, 1961 in Liber 5069 of Deeds at page 404.
THE PARTY OF THE FIRST PART named herein is the sole beneficiary of the Party of the
Second Part, The James Mardikos Irrevocable Trust, dated 11/18/08, during the lifetime(s) of the
Party of the First Part and is entitled to veterans and senior exemptions as provided under RPTL
subsections 458(7), 458-a(5) and 467(9), and the school tax relief (STAR) exemption as provided
under RPTL section 425.

SUBJECT tc~ covenants, conditions, restrictions and rights of way of record, if any.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets
and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and
to said p?emises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year

BEGINNING at a point on the westerly line of a 50 foot private road known as "Circle
Drive" distant South 2 degrees 00' 00" East 152.6 feet, more or less, along said westerly
line from the Southerly line of Aquaview Avenue, said point of beginning being the
south-easterly comer of lands of Holecek; from said point of beginning
RUNNING thence along said land of Holecek and along the lands of Brown and of
Shannon South 77 degrees 19' 50" West 208.2 feet to an iron pipe and lands of
Farmikidis; and along land of Kantarsis
THENCE along said land of Farmikidis, South 13 degrees 45' 10" East 250.0 feet to an
iron pipe and land of Ben'ill;
THENCE along said land of Berrill and along other land of said Brown North 77 degrees
19' 50" East 156.11 feet to said westerly line of said 50 foot private road known as
