RELIEF REOUESTED: The applicant's original plan was submitted for a 30 ft. x 23.4 ft accessory garage with a front yard setback from Mill Road of 37 feet, were the code requires a minimum setback of 50 feet. AMENDED APPLICATION: On March 20, 2009,'the applicant's agent, Nancy Dwyer, submitted to the Board of Appeals an mended plot plan requesting an additional two feet in size on the proposed garage, now measuring 32 fL x 23.4 feet and located two feet closer to the house at 32 feet 10.5 inches rather than the 34 feet 10.5 inches applied for. The front and side yard setbacks remain the same as applied for and the size, height and location of the proposed accessory garage remain conforming as proposed with this amendment. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted 'and personal mspeetions, the Board makes the following findings: 1. Town Law §267-b(3)fo)(3)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. SCTM#113-4-2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the LWRP. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The proposed setback from the "garage" to the top of bank is 53.4 feet; a minimum separation distance of 100' is required Chapter § 275-3. Findings; purpose; jurisdiction; setbacks. Please require that the applicant amend the application to meet the above policy to the greatest extent practicable. Additionally, if the action is approved and to further Policy 5: Protect and Improve Water Quality in the Town of Southold and Policy 6; it is recommended that a minimum 25 foot natural vegetated buffer (see below) be required. NATURAL VEGETATED BUFFER -- a land area of a certain length and width where existing vegetation occurs prior to the commencement of any grading or clearing activity. Vegetation shall be maintained to achieve a minimum percent ground cover of ninety-five (95) percent. To achieve the percent ground cover indigenous, drought tolerant vegetation shall be planted. Survival of planted vegetation shall be (ninety) 90 percent for a period of three (3) years. Maintenance activities within the buffer are limited to removing vegetation which are hazardous to life and property, trimming tree limbs up to a height of fifteen feet (15') to maintain viewsheds, replanting of vegetation and establishing a four foot (4') wide access path constructed of pervious material for access to the water-body Figure ii Ka~ residence.
