We are perplexed by both the initial and follow-up request (Wilson letter dated July 23, 2009) for us to change our plans to accommodate their ability to turn around a larger vessel which they MAY purchase in the future. There is ample room for any mariner to turn a vessel around in the canal, we have done it for years (including our teenage grandchildren) and so have our neighbors with even larger vessels. Some have selected different turn around points to accommodate new vessels and some chose to back down the canal, which we have done on occasion. There are several questions which are obvious: Why didn't the Wilsons request placement of their dock further west to accommodate a larger vessel when their dock with constructed approximately five years ago? • Why haven't the Wilsons requested from the Board permission to turn their platform around to allow their dock to be placed further west of our dock? • Why haven't the Wilsons considered turning the potential vessel around on the south side of the canal which would allow another approximate 30 feet in our adjacent property? • Why, after learning at the last Board of Trustees meeting that the plans for our proposed dock will provide an additional 3 feet in width of the canal and that the placement of the platform will move the dock twelve feet west of the existing dock, haven't the Wilson accepted this as being adequate additional room for navigating their vessel? • What would the Wilsons have done if we were not in the process of replacing our bulkhead and dock? We are confident that when you visit the site a second time, you will see that there is more then adequate room for the Wilsons to turn a much larger vessel around on either side of the canal, but most specifically on the south side of the canal and that forcing us to move our dock further west would place our vessel with five foot draft in much shallower water for no need. Please find enclosed another overhead picture of the area of the canal where we and the Mainos have our docks. I have marked it up to show you how we both navigate in our area of the canal. Both of us return to our docks heading westward down the canal. We both head the bow of our boat into area A. Next we do a series of forward and reverse motions in area B to turn our boats. It is relatively easy for the Mainos to reverse to their dock while avoiding our boat. It is far more difficult for me to reverse into my dock because of the presence of the Maino's boat at their dock. Our current boat's length is about 22' (20' boat plus outboard). The boat I picture in the attachment is larger,the same size as the Maino's,with our boat as a cutout because we plan to upgrade to a sailboat approximately that size now that my wife has retired. My request that you move the Maino's new dock three pilings west is specifically to add the minimum amount of space for me to turn a boat the same size as the Maino's when returning to my dock. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the following recommendations to further the below listed policies are implemented. 5.3 Protect and enhance quality of coastal waters. A. Protect water quality based on an evaluation of physical factors (pH, dissolved oxygen, dissolved solids, nutrients, odor, color and turbidity), health factors (pathogens, chemical contaminants, and toxicity), and aesthetic factors (oils, floatables, refuse, and suspended solids). To further the above policy, it is recommended that the Board minimize the use of CCA treated materials in the bulkhead and dock design. r A Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. E. Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided: 1. Maintain buffers to achieve a high filtration efficiency of surface runoff. 2. Avoid permanent or unnecessary disturbance within buffer areas. 3. Maintain existing indigenous vegetation within buffer areas. To, further the above policy, it is recommended that a perpetual landscaped buffer be required landward from the bulkhead. LANDSCAPED BUFFER -- a land area of a certain length and width which is planted with indigenous, drought tolerant, vegetation similar to that found within the immediate proximity of the parcel. Vegetation shall be installed in sufficient densities to achieve ninety-five (95) percent ground cover within two years of installation. Survival of planted vegetation shall be (ninety) 90 percent for a period of three years. Maintenance activities within the buffer are limited to removing vegetation which are hazardous to life and property, trimming tree limbs up to a height of fifteen feet 05') to maintain viewsheds replanting of vegetation and establishing a four foot (4') wide access path constructed of pervious material for access to the water-body. Construct 110'of new bulkhead and new 4' wide wood walkway in-place. Remove existing floating dock, ramp and access platform and install new 4'x4'cantilevered platform, 32"x14'seasonal aluminum ramp and 4'x50'seasonal floating dock in-place. Remove existing retaining wall and construct 110'of new retaining wall in-place. Provide 10'wide non-turf buffer zone landward of walkway. DEVELOPED COAST POLICIES Policy 1 Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. Our proposal is consistent with this policy in that all structures are existing and the homeowner is trying to maintain his property by reconstructing this waterfront structures. There are no new structures being proposed. Policy 2 Preserve historic resources of the Town of Southold. This project location has no significant historic resources. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold. Our proposal will not have a negative impact on the visual quality or scenic resources. This proposal is consistent with the area. NATURAL COAST POLICIES Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion. This project has will have no flooding or erosion concerns. The new bulkhead will protect the property in the same manner as the existing. Policy 5 Protect and improve water quality and supply in the Town of Southold. Our proposal will not have any impact of the water quality or supply in the Town of Southold. Policy 6 Protect and restore the quality and function of the Town of Southold's ecosystem. Our proposed dock facility will have minimal effects on the ecosystem. During the initial construction there will be minor disturbance to the underwater lands. Once construction is completed the area will immediately settle and re-establish itself. Policy 7 Protect and improve air quality in the Town of Southold. Our proposal will not have any impact on the air quality in the Town of Southold. Policy 8 Minimize environmental degradation in the Town of Southold from solid waste and hazardous substances and wastes. PUBLIC COAST POLICIES Policy 9 Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. Our proposal will give the property owner the ability the access their boats and engage in the recreational use of town waters. The dock will not inhibit others ability to access these same waters. This is a waterfront piece of property where the property owner accesses the water to engage in water dependent activities such as boating and fishing. Reconstructing the existing structures will ensure that the homeowner will be able to continue accessing the water without worrying about any of these aging structures failing. Policy 11 Promote sustainable use of living marine resources in the Town of Southold. The project area does not offer any opportunities for commercial fishing or shellfishing. There are also limited opportunities for recreational fishing at this location.
