Dear Mr. Marine:
In response to your letter dated August 12, 2009, the Board of Trustees
inspected the above-referenced property and determined the area of the property
referenced to in your letter as a "pond", is not defined as a wetland as per
Chapter 275-Wetlands and Shoreline of the Town Code, and therefore out of the
Wetland jurisdiction.
This portion of the property, however, appears to be a drainage area and should
be referred to the Southold Town Highway Dept. for their review before any
activity commences. Peter Harris, Superintendent of Highways, can be reached

I represent Nicholas and Joan Murray who pumhased the above real property on April
28, 2009. A copy of the deed is annexed. There is also annexed a copy of a survey dated
July 18, 2002 with an updated inspection dated December 23, 2008.
As you can see on the survey, there is a body of water on the property indicated on the
survey as a "pond". My clients wish to clean up or completely remove it from the property,
However, the Trustees must first determine whether or not Southold maintains jurisdiction
over the "pond".
Please inspect at your eadiest convenience and advise.
