Implementation of the Suffolk County Planning
Commission Intermunicipal Agreement
Enclosed please find a copy of the Suffolk County Planning Commission's
final Intermunicipal Agreement (IMA) resolution implementing the IMA effective
August 21, 2009. The resolution includes the list of actions that no longer require
referral to the Suffolk County Planning Commission.

On September 3, 2008 the Suffolk County Planning Commission adopted a resolution
enabling the establishment of Intermunicipal Agreements OMA) with local Towns and Villages. This
IMA, authorized by New York State General Municipal Law, identifies non-regionally significant
actions that no longer must be referred to the Commission. The IMA allows the Commission to focus
its time on regionally significant applications while streamlining the referral process and reducing
papen~vork for local municipalities by potentially reducing the total number of referrals sent to the
Commission by 75%.
Upon adoption of the September 3, 2008 IMA resolution the Suffolk County Planning
Commission sent draft local IMA resolutions to the County's Towns and Villages. Having received
.your Municipality's adopted IMA resolution the Suffolk County.P anning Commission is now ready to

Resolution No. ZSR09-37 of the Suffolk County Planning Commission
WHEREAS, General Municipal Law (GML) §239 authorizes County Planning Commissions to establish agreements
with local Towns and Villages concerning the types of applications that are subject to Referral and;
WHEREAS,
the Suffolk County Planning Commission has analyzed the nature of the Referral process and has
determined that many current Referrals are not of county-wide or inter-community concern and represent
matters of strictly local concern and;
WHEREAS, the Snt'folk Coonty Planning Commission has previously authorized the Department of Planniug to
initiate the establishment of intermunicipal agreements with the individual Towns and Villages within
Suftblk Connl ay~4~d.;_
WHEREAS,
several Towns and Villages have responded and passed resolutions consistent with the recommendations
of the Commission to streamline the Referral process and reduce thc number of Referrals by determining
that the actions identified below are matters of local determination and shonld not be subject to referral
pursuant to GM[, or the laws of Suffolk County and;
· All area variances associated with single-family residences.
· Change of one permitted use to another with no changes in parking requirements (i.e. retail to
office).
· Minor additions less than 1,000 square feet with no change to use or occnpancy~
· Site plan applications proposing less than 5,000 square feet of new or renovated floor area or
less than 10,000 sqoare feet of land disturbance.
Exception - actions that have been given a Positive Declaration pursuant to SEQR or actions involving
property abutting state or county parkland, the Atlantic Ocean, Long Island Sound, any bro~ in SufJblk
County or estuary of any of the foregoing bodies of water shall be subject to the fully review process.

the Department of Planning continues to seek additional agreements with Towns and Villages in Suffolk
County, and be it fi~rther;
that the Department of Planning is hereby authorized to implement the revised Referral Process with the
below muuicipatities effective Angust 21,2009 and be it further;

Town of lslip
Town of Riverhead
Town of Southold
Village of East Hampton
Village of Head of the }larbor
Village of tlunfington Bay
Village of Lloyd Harbor
Village of Nissequogue
Village of North Haven
Village of Old Field

that the Department of Planning is authorized to continue to implement the revised Referral Process with
the remaining municipalities in Suffolk County upon receipt of locally adopted intermunicipal agreements
consistent with Commission policy.

WHEREAS, GML also allows for the County to enter into an agreement with a refern~ g body or duly

WHEREAS, the Town of Soutbold has proposed a litany of actions which hre consistent with the intent
of OML and represent matters of local not county-~de concern, and
WHEREAS, an inter-municipal agreement would streamline the referral review process without any
compromise to county-wide or inter-community planning considerations, now therefore be it
RESOLVED, that pursuant to the above the Suffolk County Planning Commission considers the
