It states ~that the property lying landward of the 10 foot elevation contour is outside the jurisdiction of the Tidal Wetlands Act. Since the newly proposed swimming pool and patio are to be situated landward of that contour, these structures would also lie outside the jurisdiction of the Tidal Wetlands Act. If any alteration to the plan were to be made so that any part of the pool and patio were to be situated seaward of the 10 foot contour, a permit would be required. It is also the responsibility of the applicant to ensure that no disturbance or sedimentation of the land within the Tidal Wetlands jurisdiction occurs.
