(631) 765-1809 Fax (631) 765-9064 SQa z?n C%T FINDINGS, DELIBERATIONS, AND DETERMINATION MEETING HELD AUGUST 18, 2009 ZBA FILE # 6302 -JOSEPH and JOANNA CHERNUSHKA, Applicants PROPERTY LOCATION: 640 Rabbit Lane, East Marion (adjacent to Gardiners Bay) CTM 31-18-20.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 14, 2009, stating that this application is considered a matter for local determination as there appears to be no significant county-wide orinter-community impact. PROPERTY FACTSIDESCRIPTION: The applicant's property consists of 4,691 square feet (to a tie line) with 38.35 feet along Rabbit Lane and 42.23 feet along Gardiners Bay, as shown on a survey updated March 19, 2009, by Nathan Taft Corwin III. The property is improved with a 1 story frame single-family dwelling and detached one- story building. BASIS OF APPLICATION: Requests for Variances under Sections 280-1166 and 280-124, based on an application for a building permit for additions and alterations to the existing dwelling, and the Building Inspector's March 13, 2009 Notice of Disapproval, for the reasons that the new construction will be: a) less than code-required minimum 75 feet from the bulkhead, b) less than a minimum 10 ft. single side yard; c) less than 25 feet for combined side yard setbacks; d) less than the code-required minimum rear yard setback of 35 feet; e) greater than the code limitation of 20% lot coverage on this parcel containing less than 4,700 square feet of buildable area. LWRP DETERMINATION: A Letter dated July 17, 2009 from Mark Terry, LWRP Coordinator, confirming inconsistency was submitted to the Board of Appeals under Chapter 95, Waterfront Consistency Review of the Town of Southold Code and Local Waterfront Revitalization Program (LWRP) standards. The location of an existing accessory garage/cottage and existing cesspools in the applicant's front yard prevents moving the house closer to the road and farther from the bulkhead as recommended by the LWRP coordinator pursuant to Chapter 268 4.1A. Although the dwelling is setback from the bulkhead at only 19 ft, the portion of the existing dwelling that is located seaward of the Coastal Erosion Hazard Line is only 61.8 SF. There is an existing at grade wood deck that covers Page 2 -August 18, 2009. ZBA # 6302 -Joseph and Joanna Chemushka, Applicants CTM 1000-31-18-20.1 the area between the residence and the bulkhead. Part of this deck is covered with a shed roof proposed to be replaced with a second story decklbalcony measuring approximately 12 ft x 9 ft. The denial of this proposed permanent structure will "reduce potential loss and damage by locating development and structures away from flooding and erosion hazards" required under Town Code Chapter 268. RELIEF REQUESTED: The applicant proposes to convert the existing dormered second floor bedroom on his dwelling into a true second floor code conforming space. This will require new code compliant interior stairs and lifting the dwelling to meet Flood Plain regulations at approximately six (6) feet above grade to elevation 11.3. The replacement of apre-existing 9 ft. x 12 ft. shed roof on posts over a portion of the existing at grade seaward wood deck, with a second floor decklbalcony with railings is also proposed, A new set of seaward steps from the first floor to the pre-existing wood deck at grade will be required. No changes in the pre-existing non-conforming lot coverage and setbacks are proposed which are as follows: 1. 19 ft. setback from the bulkhead 2. single side yard of 4.6 ft. 3. combined side,yard of 20.3 ft 4. rear yard setba~k of 26 ft. 5. lot coverage o£,30.9%. ADDITIONAL INFORMATION: At the public hearing the applicant's representative, Amy Martin, testified that the Owners intend to insulate the dwelling but do not intend to heat it since it is used and will continue to be used as a seasonal cottage. They will also remove the non-conforming use of the existing accessory garage as habitable space, which pre-existed their purchase, back to a storage space with half bath. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law 6267-b(3)(b)(3)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The cottages along Rabbit Lane were built mostly in the 1920's and 1930's, and' all of them have similar non-conformities to the applicant's dwelling. Some cottages along the street have been enlarged well beyond what the applicant is proposing. The requested construction will maintain the existing non-conforming footprint, setbacks, and lot coverage, as well as the original appearance as a seasonal, unheated cottage. 2. Town Law 6267-b(3,,(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance, because the unheated cottage has numerous pre-existing non- conforming setbacks aril lot coverage and the proposed work requires that the entire dwelling be made FEMA compliant. f 3. Town Law 6267-b(3).(b)(3). The variances granted herein are not substantial only in so far as all additions and alterations are to be within the existing footprint, and all of the pre-existing non-conforming setbacks and lot coverage are being maintained. Since the house must be elevated above the Flood Plain, a new set of seaward stairs will be required from the elevated first floor to the existing wood deck. The proposed second floor balcony/deck over a portion of the existing seaward deck is substantial since one corner post is virtually at the existing bulkhead. 4. Town Law 6267-b(3~(b)(5). The difficulty has not been self-created because the seasonal cottage was built prior to the enactment of a zoning code. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed second floor renovations require compliance with FEMA standards which involves raising the existing first floor on to concrete block piers at approximately 6 feet above grade to EI. 11.3'. Also, the subject property has sandy soil which provides excellent natural drainage, and drywells and gutters and leaders are proposed to capture roof runoff. The elimination of the proposed new 12 ft. x 9 ft. permanent second floor deck/balcony will "reduce potential loss and damage by locating development and structures away from flooding and erosion hazards" as required by Chapter 268 of the Town Code (LWRP). 6. Town Law &267-b. Grant of the requested relief, without the proposed second floor decklbalcony is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an enlarged second story on the cottage, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,:motion was offered by Member Weisman, seconded by Chairman Goehringer, and duly carried, to DENY the seaward-side, second floor decklbalcony as applied for, and GRANT the other setback and lot coverage variances as applied for concerning the seasonal cottage, .and shown on the `~ite plan by Robert Brown, Architect dated 06/30/2009 and the architectural plans by Fairweather-Brown, Design Associates, labeled drawing No: A1,A2, A4 and Zone Base Flood Elevations Determined dated June 2, 2009 ,subject to the following Conditions: 1. Removal of the'non-conforming, habitable space use of the existing accessory garage, and reverting and returning it to an accessory garage/storage space use, and 2. Prior to obtaining a Certificate of Occupancy for the requested construction in this variance determination, the owner shall obtain a new Certificate of Occupancy for the accessory building after reverting the building to non-habitable space; the owner shall file a copy of both Certificates of Occupancy with the ZBA; and 3. The owner shall file with the Town a Declaration of Covenants and Restrictions stating: a. "No heating or other new utilities will be added to the existing buildings that compromise the FEMA regulations, and that this seasonal-use fishing cottage shall remain unheated as presented to the ZBA for`.the grant of the limitations under the setback and lot coverage variances, b. This unheated building shall remain seasonal, except that when the cottage is converted or changed to a heated building or dwelling, the owners must bring the building into compliance with FEMA and all Towr regulations for use as asingle-family dwelling, c. The accessory building shall not contain habitable space and shall contain only acode-permitted accessory use. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the LWRP. A portion of the existing residential structure is located seaward of the Coastal Erosion Hazard Line. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Avoid development other than water-dependent uses in coastal haza~ areas. Locate new development which is not water-dependent as far~~aw y from coasta/hazard areas as practical. ~ - - - - b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas maybe warranted for: c. sites where relocation of an existing structure is not practical. The rear vard setback on the parcel is 35 feet from Rabbit Lane. From the rear vard setback to the existing structure is a total distance of 22 feet. It is recommended that the Board assess the feasibility of relocating the structure closer to Rabbit Lane within the building envelope and requiring a landscaped buffer landward of the existing bulkhead. A recommended definition for a landscaped buffer is: LANDSCAPED BUFFER a land area of a certain length and width which is planted with indigenous drought tolerant, vegetation similar to that found within the immediate proximity of the parcel Vegetation shall be installed in sufficient densities to achieve ninety-five (95) percent ground cover within two vears of installation. Survival of planted vegetation shall be (ninety) 90 percent for a period of three vears. Maintenance activities within the buffer are limited to removing vegetation which are hazardous to life and property, trimming tree limbs up to a height of fifteen feet (15') to maintain viewsheds replanting of vegetation and establishing a four foot (4') wide access oath constructed of pervious material for access to the water-body. 5.1 Prohibit direct or indirect discharges that would cause or contribute to contravention of water quality standards. Ensure effective treatment of sanitary sewage and industrial discharges by: 8. providing and managing on-site disposal systems: b. protect surface and groundwater against contamination from pathogens and excessive nutrient loading by keeping septic effluent separated from groundwater and by providing adequate treatment of septic effluent. It is recommended that the Board require that the applicant upgrade the on-site-septic system to protect from potential contamination to ground and surface waters. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. The site was evaluated for potential natural resource concerns regarding the alteration of raising the dwelling and adding a second story to the residence. At the time of this site visit, June 9, 2009, no natural resources concems were observed. The property is situated on the Gardiners Bay and is somewhat protected by a small bulkhead. The bulkhead and beach aze currently in good condition. Raising the house 6' seems appropriate for this residence due to the close proximity of the shoreline. It is recommended that re-vegetation of disturbed areas is completed as soon as possible after construction with native plants and grasses. Additionally, the installation of gutters, downspouts, and underground drywells will address stormwater runoff. No natural resource concerns were observed with regazd to the raising the dwelling and adding a second story to this residence.
