DECLARATION made this 8th day of July, 1982, by WALTER N.
PHARR, JR., residing at 360 South Harbor Road, Southold, New York,
hereinafter called the Declarant.
WHEREAS, the Declarant is the owner of certain lands situate,
lying and being in southold, Town of Southold, Suffolk county,
New York, containing 40,727 square feet more particularly bounded
and described in Schedule A annexed hereto; and
WHEREAS, the easterly portion of the aforesaid property de-
scribed in Schedule A and denoted as "Parcel One" on the "Map of
Property Surveyed for Walter N. Pharr, Jr., by Roderick Van Tuyl,
P.C. amended June 15, 1982" attached hereto as Schedule B contains
30,104 square feet, is zoned "B" Light Business District under the
zoning Ordinance of the Town of Southold and previously received
from the Southold Town Planning Board by resolution dated October
19, 1981, approval as a "set-off" pursuant to section 106-13 of
the Subdivision Regulations of the Town of Southold; and
WHEREAS, the westerly portion of the aforesaid property de-
scribed in Schedule A and denoted as "Parcel Two" on Schedule B
contains 10,623 square feet and is zoned "A" Residential and
Agricultural under the Zoning Ordinance of the Town of southold;an
WHEREAS, in order to obtain approval from the Suffolk County
Department of Health Services for a private well, your Declarant
is requesting the Southold Town Planning Board to enlarge the
.previous approval of the "set-off" for "Parcel One" consisting of
30,104 square feet to include "Parcel Two" containing 10,623 squa.
feet so that the overall parcel will contain 40,727 square feet;
and
NOW, THEREFORE, the aforesaid described premises shall be

SCHEDULE A

ALL that certain plot, piece or parcel of land, situate, lying
and being at Southold, in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows;
BEGINNING at a point on the northwesterly side of Middle Road
(C.R. 48} said point being distant 832.77 feet southwesterly from
the southeasterly end of a line connecting the southwesterly side
of Kenney's Road with the northwesterly side of Middle Road, said
point also being where the southwes~erly line of land of Charnews
intersects the said northwesterly side of Middle Road, and from
said point of beginning running thence southwesterly along the
northwesterly side of Middle Road on an arc of curve bearing to
the right, whose radius is 2864.79 feet, a distance of 152.98
feet to land of Aliano; running thence North 540 09' 10" West along
the northeasterly line of land of Aliano and land of Mudd 286.65
feet to land of S.D. Mudd; running thence North 360 30' 30" East
along the southeasterly line of land of S.D. Mudd 150.01 to land
of Charnews; running thence South 540 09' 10" East along the
southwesterly line of land of Charnews 255.00 feet to the north-
westerly side of Middle Road, the point or place of BEGINNING.

shall run with the land:
1. Declarant does hereby warrant, covenant and represent
that "Parcel Two" as denoted on Schedule B herein shall remain
vacant, shall not be built upon, and shall be used only in an
ancillary capacity to "Parcel One" as shown on Schedule B.
2. Declarant does hereby further warrant, covenant and
represent that the foregoing restrictions and agreements shall
bind the undersigned, his heirs, Successors and assigns, and any
and all person or persons who shall succeed to the ownership of
said premises or any part thereof by transfer or otherwise.
