ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and beingindkK at Mattituck, Town of Southold, County of Suffolk and State of
New York, bounded and described as follows:
BEGINNING at a pipe set on the northeasterly line of Westphalia Road 131.20 feet
northwesterly along said line from the westerly corner of land conveyed by Jennie
W. Lester to George H. Taylor;
RUNNING THENCE from said point of beginning along said line of Westphalia Road two
(2) courses as follows: (1) North 540 52' 3011 West 59.56 feet; thence (2) North

AFM M RUNNING THENCE along said land of Oscar B. Gunther, two (2) courses as follows:
(1) North 150 59' 1011 East 17.59 feet; thence (2) North 640 49' 20" East 113.29 feet;
• RUNNING THENCE along ordinary high water line of Mattituck Creek northeasterly about
90 feet to land conveyed by Jennie W. Lester to Theresa M. Fitzpatrick by deed
dated August 23, 1958;

RUNNING THENCE along the northwesterly line of a 30 foot right of way South 350
District 071 30" West 100.0 feet to the point of beginning.
1000 TOGETHER with all the right, title and interest, if any, of the party of the first
part of, in and to Westphalia Road lying in front of and adjoining the above
Section described premises on the southwest to the center line thereof.

BEING AND INTENDED TO BE those same premises conveyed to the party
part by Philip Peluso, by a deed of conveyance dated May 14, 1963 and recorded
Lot in the Office of the Clerk of the County of Suffolk on May 15, 1963 in Liber
903 DOD 5347 of conveyances at page 259.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the sane for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indentpre so requires.
IN WITNESS WHEREOF,the party of the first part has duly executed this deed the day and year first above
