BARGAIN AND SALE DEED WITH COVENANT AGAINST GRANTOR'S ACTS
THIS INDED?TURL, made effective the day of March, j992 between RICHARD C. POWER,
residing at 11 Thruway Drive, Bridgewater, New Jersey 08807 and KEVIN D. POWER, residing at 21
Valdepenas Lane, Clifton Park, New York 12065, parties of the first part, and RICHARD C. POWER,
residing at 11 Thruway Drive, Bridgewater, New Jersey 08807, party of the second part.
Witnesseth that the parties of the first part, in consideration of ONE AND 00/100 ($1.00)
DOLLAR lawful money of the United States and other good and valuable consideration paid by the
party of the second part, do hereby grant and release unto the party of the second part, his
distributees and assigns forever:
ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being at Mattituck, Town of Southold, County of Suffolk and
State of New York, and bounded and described as follows:
BEGINNING at a concrete monument set on the northwesterly line of Riley Avenue at the
southeasterly corner of Lot 9 and the southwesterly corner of Lot 10 as shown on a map entitled
"Map of Property of G.H. , W.T. & D.T. Riley at Mattituck, N.Y." filed in the Suffolk County
Clerk's Office November 27, 1928 as Map No. 186; from said point of beginning running
northwesterly along the northeasterly boundary line of said Lot 9 at right angles to said
northwesterly line of Riley Avenue, 169.96 feet to a concrete monument; thence along said land
now or formerly of William Scholl, Sr. and Josephine Huttenlocker, 2 courses as follows:
(1) about easterly 76.18 feet to a concrete monument;
(2) southeasterly on a line which is parallel with said northeasterly boundary of said Lot 9 and
50.0 feet northeasterly therefrom, measured at right angles thereto, 112.48 feet to a concrete
monument set on said northwesterly line of Riley Avenue; thence southwesterly along said
northwesterly line of Riley Avenue, 50.0 feet to the point of beginning.
Subject to all enforceable covenants, considerations, restrictions and easements of
record and any state of facts an accurate survey may disclose.
Being the same premises conveyed to the parties of the first part by
deed dated October 8, 1988 and recorded in the Suffolk County Clerk's Office on November 4, 1988
in Book 10730 of Deeds at Page 85
Together with the appurtenances and all the estate and rights of the parties of the first
part in and to said premises.
To have and to hold the premises herein granted unto the party of the second part, his
distributees and assigns forever.
+ And said parties of the first party covenant that they have not done or suffered anything
whereby the premises have been encumbered in any way whatsoever.
This Deed is subject to the trust fund provisions of section thirteen of the lien law.
In Witness Whereof, the parties of the first part have hereunto set their hands and seals
effective the day and year first above written.
