HomeMy WebLinkAbout1000-59.-3-1710654 DECLARATION OF COVENANTS AND RESTRICTIONS DECLARATION made this 20th day of July, 1988, by ARGIRIOS ~ ',~ PAPADOPOULOS, residing at 154-11 28th Avenue, Flushing, N.Y. 11354, ~ ~ ~jand GEORGE MARAGOS, residing at 307 Melbourne Road, Great Neck, N.Y. ~ 11021, hereinafter referred to as "Declarants'. ~ ~, , .... ~ W I T N E S S E T H : WHEREAS, Declarants are the owners in fee simple of a certain parcel of land situate at Southold, Town of Southold, County of Suffolk and State of New York, containing 14.374 acres, and designated on the Suffolk County Tax Map as District 1000, Section 059, Block 03 and Lot 17; being the same premises conveyed to Declarants by deed dated February 9, 1985, recorded in the Suffolk County Clerk's Office on February 28, 1985, in Liber 9743 page 537, and referred to herein DIST as the "premises'. 1000 WHEREAS, the Declarant intends to subdivide said premises for SEC resident~a! purposes and desires to subject said premises to certain 059.00 reservations, restrictions, conditions, covenants and agreements. BLK NOW THEREFORE, the Declarant does hereby declare that the 03.00 aforesaid premises and every portion thereof is hereby held and shall LOT be conveyed subject to the conditions, covenants and restrictions 017.000 hereinafter set forth, and that every purchaser of said premises, or any portion thereof, by the acceptance of a deed thereto, covenants and agrees that the premises so purchased shall be held subject to the covenants, conditions, and restrictions hereinafter set forth. 1. Lot No. 3 as shown and designated on the subdivision map entitled NSubdivision Map made for Argirios Papadopoulos and George Maragos at Southold, N.Y.", heretofore approved or about to be approved by the Southold Town Planning Board, and filed or about to be filed in the Suffolk County Clerk's Office, shall not be further subdivided. This covenant will be effective only at such time as the Southold Town Planning Board endorses the subdivision map and said map is accepted by and filed with the Suffolk County Clerk. 10654 Pg464 2. That all of the covenants, conditions and restrictions contained herein shall be construed as real covenants running with the land and shall continue and remain in full force and effect at all times as against the owner of the premises or any portion thereof in perpetuity, except with the permission of the Southold Town Planning Board, or its then equivalent successor. Said covenants, conditions and restrictions shall be binding upon, inure to the benefit of and be enforceable by the Declarants, their heirs, successors and assigns; any owner of any portion of the aforesaid premises, their heirs, successors and assigns, and the Town of Southold, and its successors and assigns, and the failure of any of the foregoing to enforce any of such covenants, conditions and restrictions shall in no event be deemed a waiver of the right to do so thereafter.
