WITNESSETH, that the party of the first part, in consideration of Ten and 00/100--($10.)--Dollars, and
other good and valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Mattituck, in the Town of Southold, County of Suffolk and State of New York, bounded
and described as follows:
BEGINNING at a monument on the easterly line of Deep Hole Drive, 1,372.96 feet southerly along said
easterly line from New Suffolk Avenue, said point of beginning being the northwesterly corner of land of
Frank Martorana and the southwesterly corner of land now or formerly of Frank Zaleski, from said point of
beginning;
RUNNING along said land now or formerly of Frank Zaleski, South 79 degrees 00 minutes East 120 feet,
(deed) 113.55 feet (actual) more or less, to a creek or gutter and land now or formerly of H. Alvin Smith
and another the following two (2) courses and distances:
1. South 0 degrees 17 minutes 53 seconds West, 37.81 feet;
2. South 6 degrees 41 minutes 52 seconds West, 14.64 feet to the division line between Lots 9 & 10;
THENCE alqng land of Frank Martorana North 79 degrees 00 minutes West 105 feet (deed) 116.12
(actual) more or less, to said easterly line of Deep Hole Drive;
THENCE along the easterly line of Deep Hole Drive, North 4 degrees 52 minutes 50 seconds East 52.05
feet to the point or place of BEGINNING. -
"Regulated tidal wetlands associated with Deep Hole Creek are located at Suffolk-County Tax Map
Number: District 1000, Section 115, Block 17, Lot 9, otherwise known as properties of Mindy C. Martorana
and her heirs, assigns, or successors. This property is subject to the provisions of New York State
Environmental Conservation Law (ECL) Article 25 or its successors, and the conduct of regulated activities
may occur only pursuant to ECL Article 25 if prior approval is given by the New York State Department of
Environmental Conservation (NYSDEC) or its successor. Regulated activities include, but are not limited
to the erection of any structure(s); excavation; dredging; grading and filling; clearing of vegetation; and
application of chemicalswithin the area of NYSDEC jurisdiction.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed
recorded in Liber 12087 page 390.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
