WITNESSETH, that the party of the first part, in consideration of ten dollars and
other valuable consideration paid by the party of the third part, does hereby ~rant
and release unto the party of the third part, the heirs or successors and assigns of
the party of the third part forever, his undivided one percent (1%) interest forever;

County of Suffolk and State of New York, bounded and described~ as follows:
~ BEGINNING at a monument on the westerly side of, Luther's ~0ad 485.26, feet
northerly from the corner formed by the intersection of the westerly side b~ Luther's
Road and the northerly side of East Road; which monument is the southeasterly corner
of the premises about to be described; running thence from said point of beginning
alon~ land now or formerly of DeLuca North 79' 17' 50" WestA358.21 feet to a monument;
running thence along Lot 98 on the ~'Map of Captain Kidd Estates", Suffolk County Map
NO. 1672, North 6' 20' West 104.88 feet to land of Mattituck Park District; running
thence along land of Mattituck Park District North 83' 40' East 340.0 feet to the
westerly side of Luther's Road; running thence along the westerly side of Luther's
Road the following two courses and distances: (1) South 9' 36' 30" East 60.34 feet;
and thence (2) South 5' 58' 00" East 149.60 feet to the point or.place of BEGINNING.
The subject premises being the same premises conveyed to the party of the first
part and party of the second part by deed dated January 11, 2005 and recorded in the
Suffolk County Clerk's Office on January 19, 2005 in Liber 12366 Page 691.
TOGETHER with all right, title and interest, if any, of the party of the first part,
in and to any streets and roads abuttin~ the above-described premises to the center
lines thereof; TOGETMER with the appurtenances and all the estate and rights of the
party of the first part in and to said premises; TO HAVE AND TO MOLD the premises
herein granted unto the party of the third part, the heirs or successors and assigns
of the party of the third part forever.
AND the party of the first part covenants that the party of the first part has not
done or suffered anything whereby the said premises have been encumbered in any way
whatever, except as aforesaid·
AND the party of the first part and the party of the second part, in compliance with
Section 13 of the Lien Law, covenants that the party of the first part and the party
of the second part will receive the consideration for this conveyance and will hold
the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the ~mprovement and will apply'the same~fmrst;to the
payment of the cost of the ~mprovement before using any part of.-the total of the same
for a y ot er purpose.
The word ~party" shall be construed as if it read "parties" whenever the sense of, t, his
indenture so requires.
