DART, residing at (no #) peconic Lane, Peconic, New York 11958, WIT N E SSE T H : -------- WHEREAS, EDWAR? D. DART, is the owner in fee simple of certain premises situate at Southold, Suffolk County, New York, described on the Suffolk County Tax Map as District 1000, Sec- tion 005, Block 1, Parcel 10, and WHEREAS, said premises have been divided into a minor subdivision consisting of four (4) single and separate lots, as approved by the Southold Town Planning Board and filed on a map thereof prepared by Roderick VanTuyl, P.C., as surveyed October 28, 1981, last amended August 20, 1984, in the Office of the Clerk of the Town of Southold, and WHEREAS, a steel building exists on the premises, partly on Lot No.3 and partly on Lot No.4, as shown on said approved minor subdivision map, and WHEREAS, said owner, EDWARD D. DART, desires to estab- lish certain conditions with respect to Lots numbered 3 and 4 on said map, and the building which exists partly on each of said lots. . . '. '. . . NOW, THEREFORE, EDWARD D. DART declares that the afore- said land is held and shall be conveyed subject to the following covenants and restrictions, which shall run with the land: 1. That at, the option of the owner, EDWARD D. DART, his successors or assigns, the steel building, as it now exists, partly on Lot No. 3 and partly on Lot No.4, on the minor sub- division map above described, shall remain in its present loca- tion. 2. That the owner, EDWARD D. DART, his successors or assigns, shall have the right to do any of the following: (a) Totally remove said building from the premises; (b) Relocate said building entirely on Lot No.3; (c) Relocate said building entirely on Lot NO.4; 3. That in the event the owner, EDWARD D. DART, his successors or assigns,elects to have the steel building remain in its present location, to wit: Partly on Lot No. 3 and partly on Lot No.4, then in that event, the following conditions shall apply: (a) The grantee of Lot No. 3 shall take title thereto subject to the encroachment of the steel building thereon, as shown on the afore- described minor subdivision map and subject - 2 - . . further to an easement in favor of the owner(s) of Lot No. 4 of ingress and egress to that portion of the building which encroaches on said Lot No.3, and the immediate surrounding area within twenty (20') feet thereof, for all reasonable purposes, including but not limited to repairs, maintenance and replace- ment; (b) The grantee of Lot No. 4 shall take title thereto, together with all right, title and interest in and to the steel building, as shown on the aforesaid map, together with the right to maintain said building with its en- croachment on Lot No. 3 and together with an easement over said Lot No. 3 of ingress and egress to that portion of the building which encroaches on said Lot No. 3 and the immediate surrounding area, within twenty (20') feet thereof, for all reasonable purposes, including but not limited to, repairs, maintenance and replacement. DART, is the owner in fee simple of certain premises situate at Southold, Suffolk County, New York, described on the Suffolk county Tax Map as District WOO, Section 005, Block 1, Parcel 10, and WHEREAS, the Southold Town planning Board, by Resolution made on August 4, 1986, approved a minor subdivision of said parcel into four (4) lots, as shown on map of Roderick Van Tuyl, P.C., dated October 28, 1981 and last amended March 27, 1986, and WHEREAS, the Southold Town Planning Board approved said minor subdivision subject to certain Covenants and Restrictions, to be filed in the Office of the Clerk of the County of Suffolk, NOW, THEREFORE, in compliance with the Resolution of said Southold Town Planning Board, Delcarant herein declares that the aforesaid land is held and shall be conveyed subject to the following covenants and restrictions, which shall run with the land: 1. No lot shall be subdivided or its lot lines changed in any manner at any future date unless authorized by the Town of Southold Planning Board. 2. The access to the property (curb cuts) and the 25 foot access easement shall be created as proposed subject to the approval of Suffolk County Department of Public Works. ",:~~i;~~'--' -. 3. No driveway or entrance road on Railroad-Youngs Avenue shall be located within fifty (50) feet of the northerly end of the short radius curve connecting the northerly side of the right-of-way of Middle Road with the westerly side of the right-of-way of Railroad-Youngs Avenue. 4. All storrnwater runoff resulting from the development and improvement of this subdivision or any of its lots shall be retained on the site by adequate drainage structures so that it will not flow out on to the right-of-way of Middle Road.
