ADDENDUM TO PERMIT
Permit Description for docking facility for L.I. SOUND OYSTER, LLC CIO TOM
ANDERSON
Wetland Permit to expand an existing dock facility, to be utilized for a
commercial shell fishing and aquaculture facility. The existing 130' x 4' timber
catwalk, (which is only permitted at 100' long), is approved to be re-built at 100' x
10' wide, a 6' x 6' platform and 3' x 20' ramp, 6'x 20' float, 4'x 20' float, and 4' x
12' float, with 30' of existing dock to be removed, with the condition that all the
under water debris, rebar, and cages, be removed from the intertidal area at the
time of construction, dilapidated concrete wall to be removed, proposed shed in
previous shed location, with a 50' non disturbance buffer between MHW and the
existing concrete wall, to be replanted with native buffer vegetation,(i.e. Beach
grass, honeysuckle, Rosa rugosa, Switch grass, Seaside goldenrod, Bayberry,
Red cedar, Beach plum) and with the condition that the 10' width for the dock has
been approved for use of equipment for removal of oyster trays for an
aquaculture facility, and if the aquaculture operation is to cease then the dock
width will no longer be a permitted structure and must be removed or re-built to 4'
wide for use as a docking facility only, and all as depicted on the plan prepared
by Land Use Ecological Services, Inc. last revised May 5, 2005.

Dear Mr. Hall:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, February 16, 2005 regarding the above matter:
WHEREAS Land Use Ecological Services, Inc. applied to the Southold Town Trustees
for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated October 15, 2004, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on February 16, 2005 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application L.I. SOUND OYSTER,
LLC C/O TOM ANDERSON to expand an existing dock facility, to be utilized for a

November 9, 2004, the following recommendation was made:
Moved by Don Wilder, seconded by Jack McGreevy, it was
RESOLVED to TABLE the Wetland Permit application of LI SOUND OYSTER, LLC C/0
TOM ANDERSON to expand an existing dock facility to be utilized for a commercial
shell-fishing and aquaculture facility. The existing 4'X 130'+/-timber catwalk is proposed
to be widened to 10' to accommodate a fork-lift or truck. The existing platform and 3'X
20' ramp are proposed to remain. (7) 6'X 20' floats are proposed and to be supported by
(15) 8" dia. piles. The existing re-bar and garbage debris on the creek bottom is
proposed to be removed and disposed of at an.approved offsite location. On the north
side of the property west of the existing house the applicant proposes to remove the
remains of a dilapidated concrete wall, and proposes to remove existing wood
landscape debris to an approved offsite location. A shed is proposed in the same
location as the previous shed location, and proposed buffer area. South of the dock the
buffer area is proposed to extend from the MHW to the concrete wall. North of the dock
the buffer area is proposed to extend from the MHW to the back edge of the existing
fence north to the property line.

The CAC Tables the application because more information is needed in order to make a
recommendation. The CAC questions the purpose of the proposed operations, and

2. Commercial Docks (Marinas, Yacht Clubs and Restaurants):
Given the water dependant nature and economic benefit of properties
zoned as M1 and M2, dock design constraints and placement restrictions
will be given greater flexibility than would otherwise be allowed for
residential uses.
Ia] Construction of new marinas and additions to existing
marinas shall require establishment of a pump-out facility for
vessel sanitary waste.
Review and Approval of Dock Applications
1. Before issuing a permit for a dock structure, the Trustees shall
consider whether the dock will have any of the following harmful effects:

restrictions the Trustees put on the permit. They required the dock to be shorter as
originally permitted, in order to not deter navigation, and cover further creek bottom.

Applicant proposes to expand an existing dock facility proposed to be utilized for
commercial shell fishing and aquaculture facility. The existing 4'x130'+/- timber
catwalk is proposed to be widened to 10' to accommodate a fork lift or track. The
existing platform (6'x 6') is proposed to remain. A 3'x20' ramp is proposed offthe
platform leading to (3) proposed floats; a 6'x20' float, a 4'x20' float, and a 4'x12' float.
The existing Oyster Trays are proposed to be relocated as depicted on the project plans
for a total of (20) proposed 6'x16'+/- Oyster Trays. The existing re-bar & garbage debris
on the Creek bottom is proposed to be removed and disposed of at an approved offsite
location.
On the north side oftbe property west of the existing house the applicant proposes
to remove the remains of a dilapidated concrete wall, and proposes to remove existing
wood landscape debris to an approved offsite location. A shed is proposed in the same
location as the previous shed location. A buffer area is proposed as is indicated on the
project plans. South of the dock the buffer area is proposed to extend from the MHW to
the concrete wall. North of the dock the buffer area is proposed to extend from the MHW
to the back edge of the existing fence north to the pr01~¢rty line.

§ 100-120. Purpose.
The purpose of thc Marine II (IVflI) District is to provide a waterfront location for a wide range of
water-dependent and water-related uses, which are those uses which require or benefit from direct
access to or location in marine or tidal waters and which, in general, are located on major waterways,
open bayfronts or the Long Island Sound.
§ 100-121. Use regulatiom.
In the MI1 District, no building or premises shall be used and no building or part of a building shall be
erected or altered which is arranged, intended or designed to be used, in whole or in part, for any uses
except the following [one (1) use per eighty thousand (80,000) square fcct of land above mean high
water, unless otherwise specified]:
A. [Amended 5-9-1989 by L.L. No. 6-1989] Permitted uses. The following uses are permitted uses
and, except for those uses permitted under Subsection A(1) hereof, are subject to site plan approval by

(5) Boatyards for building, storing, repairing, renting, selling or servicing boats, which may
include the following as an accessory use: office for the sale of marine equipment or products,
dockside facilities for dispensing of fuel and, where pumpout stations are provided, rest room and
laundry facilities to serve overnight patrons.
