Pursuant to our agreement during the 15 October 20public hearing held on the captioned application, please find attached (3) copies of a proj ct plan prepared by En-Consultants, Inc. and Frederick Keith, P.E., last dated 7 July 2009, which has been revised to depict a modified drainage design for the existing tidal overflow drainage pipe. Specifically, while the Board had no objection to maintaining the drain pipe to allow tidal flood waters overtopping the bulkhead to be efficiently released back into the canal, you wanted the drainage mechanism to be revised to contain ordinary surface water runoff from rainfall rather than allow it to be released directly into the canal as point source runoff. To that end, Frederick Keith, P.E., designed a system whereby a new 6-inch storm drain equipped with an overflow pipe (for release of tidal flooding)would be set into an area of coarse sand (replacing existing less pervious soils) so that runoff would be directed into the drain and downward into subsoils rather than outward into surface waters under ordinary conditions. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT pursuant to §268-3; provided that a silt boom is installed prior to the replacement of the bulkhead that will retain all suspended sediments within the immediate project area pursuant to §268-3 GG.
