AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter I 11 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
June 18, 2008 in consideration of application fee in the sum of $250.00.paid by Kevin Gallaeher and subject to
Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and
following:
Wetland Permit to install a Bio-Log System (with fill and native plantings)
within two (2) separate areas along the southern shoreline of subject property, and as
depicted on the plans prepared by Suffolk Environmental Consulting, Inc. dated May 7,
2008.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee, Kevin Gallagher, residing at 40 Beechwood Lane, Southold, NY, as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-co~npliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be uo interference with the right of the public to pass and repass along the
beach between high and Iow water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notic~,.to remove or alter this work project herein stated without
expenses to the Town of South01d.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that m~y be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Anderson:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., June 18, 2008 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of KEVlN GALLAGHER
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated November 16, 2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on June 18, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of KEVlN
GALLAGHER to install a Bio-Log System (with fill and native plantings) within two (2)
separate areas along the southern shoreline of subject property, and as depicted on the
plans prepared by Suffolk Environmental Consulting, Inc. dated May 7, 2008.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

The CAC Supports the application however questions the use of Bio-Logs and their 5-year
life span, as the best method for erosion control. The CAC recommends the area be
encircled with a Iow-sill bulkhead as an attempt to control erosion. This is a sensitive area
because of the unusual quantity of marsh mallow.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with LWRP policy standards 4.1 and 4.2 and
therefore is consistent with the LWRP.
The LWRP recommends the use of non-structural erosion control measures such as the
proposed action in restoring the natural protective features which have a reasonable
probability of managing erosion.
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
B. Use vegetative non-structural measures to manage flooding and erosion hazards'.
1. Use vegetative non-structural measures which have a reasonable
probability of managing flooding and erosion, based on shoreline
charucteristics including exposure, geometry, and sediment composition.
2. Use vegetative measures to increase protective capabilities of natural
protective features. Discourage clearing of existing, particularly indigenous vegetation
during siting, design, construction and regrading phases of any

Furthermore the pr~'~osed Bio-Log and vegetative revetment will further advance
LWRP sub-policy 4.2 by mAximizlno, the protective capabilities of the natural protective
features of the shoreline as outlined below.
4.2 Protect and restore natural protective features.
B. Maximize the protective capabilities of natural protective features by:
1. avoiding alteration or interference with shorelines in a natural condition
2. enhancing existing natural protective features
3. restoring the condition of impaired natural protective features wherever
practical
4. using practical vegetative approaches to stabilize natural shoreline
features
C. Minimize interference with natural coastal processes by:
1. providing for natural supply and movement of unconsolidated materials
and for water and wind transport

review with the New York State Department of Environmental Conservation (NYSDEC) for
same, the project has undergone a modification. Accordingly, we wish to revise our pending

for the

Situate: 40 Beechwood Lane; Town of Southold, New York
SCTM #: 1000 - 070 - 10 - 06g.1
Applicant proposes to install a Bio-Log System (w/fill and native plantings) within two
(e) separate areas along the southern shoreline of subject t property in order to prevent
any further erosion thereon.
The southwestern area will be comprised of a Bio-Log System extending ~6.0' ± along
the shoreline (two E~2 lower tiers and one [_1~ upper tier), with an overall width of ~}.o'
+, secured by wooden stakes (5.o' long). Beneath the Bio-Logs a layer of filter doth (i.e.
Geo-GridTM) will be installed. An area landward of the Bio-Log System containing 1{o
square feet _+ will be backfilled with lO.0 cubic yards of dean fill obtained from an
approved upland source to a maximum depth ofe.o' :1:. The resultant grade landward of
the Bio-Log System will be vegetated with native plantings: Approximately 7 - lO
specimens of Marsh Elder (Ivafrutescens) will be installed in a staggered row along the
landward edge of the Bio-Log System (~ $.0' o/c), and approximately $o - lOO plugs of
Cape American Beach Grass (Ammophila breviligulata) will be installed in the remaining
landward area (~ 1.o' o/c).
The southeastern area will be comprised of a Bio-Log System extending ~5.o' ± along

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review
of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as ~vell as the records
available to me, it is my recommendation that the proposed action is INCONSISTENT
with the denoted following Policy Standards and therefore is INCONSISTENT with
the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
Restore tidal wetlands and freshwater wetlands, wherever practical, to foster
their continued existence as natural systems by:
1. reconstructing lost physical conditions to maximize wetland
values,
3. manipulating biological characteristics to emulate natural
conditions through re-introduction of indigenous flora and fauna,
and
protecting lands adjacent to wetlands from alterations so as to
maximize natural buffers to wetlands.
4.1
Minimize losses of human life and structures from flooding and erosion
hazards.
B. Use vegetative non-structural measures to manage flooding and erosion
hazards.
1. Use vegetative non-structural measures which have a
reasonable probability of managing flooding and erosion,
based on shoreline characteristics including, exoosure,
geometry, and sediment composition.
2. Use vegetative measures to increase protective capabilities of
natural protective features.
Use hard structural erosion protection measures for control of erosion
only where:
1. Avoidance of the hazard is not appropriate because a structure is
functionally dependent on a location on or in coastal waters;
located in an area of extensive public investment; or reinforces
the role of Maritime Centers or Areas for Concentrated
Development.
2. Vegetative al~l~roaches to controlling erosion are not effective.
3. Enhancement of natural protective features would not prove
practical in providing erosion protection.
5. The proposed hard structural erosion protection measures are:
a. limited to the minimum scale necessary

6. Practical vegetative methods have been included in the project
design and implementation.
The revetment is proposed within an intertidal zone subject to tidal action and hence
erosion over long periods of time. As you are aware, the erosion process within these
areas contributes to the food web of species dependent upon zone.
Hardened shoreline structures are supported by the LWRP only where severe erosion
exists and the protection of property is imminent or if a maritime dependent use requires
a bulkhead for sustainability. The applicant has not demonstrated that severe erosion
exists and no threat to existing structures is apparent. Correspondingly, a wood retaining
wall occurs landward of the proposal further protecting the upland structures.
It is recommended that the applicant restore the areas through the re-vegetation of
the areas with the appropriate vegetative species and minimal changes of the
elevations of the grade.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

The instant proposal is consistent with the policy in that the sitin¢l and utilization of the improved erosion -
control facilities (i.e. stone revetment) will maintain the character of the surroundinq neiqhborhood, which
currently consists of other similarly improved lots with similar shorelines characterized by natural structures
and veqetatian, which the proposed revetment will mimic. In addition, subject parcel will be in harmony
with this "...beneficial use of a coastal location..." in that the subject waterfront lot will be enhanced and
improved by the installation of the proposed stone revetment in order to control erosion along1 the situate
shoreline. The instant proposal will also "...minimize the adverse effects of development" in that the
proposed constructian is situated only in the areas of substantial erosion and not the entirety of the situate
shoreline. AccordinClly, we feel that the instant proposal corer)lies with Policy 1.

to install a stone revetment alonq the situate shoreline of the subject parcel. The surroundina area is
currently comprised of properties containinq similar veqetated shorelines, which the proposed revetment
will mimic. Scenic resources, assumedly views of Goose Creek, are not at risk because the DroIDOSed
revetment will not block any views of said resource. In addition, stone and veqetafive revetments are an
inteqral part of the Southold Shoreline and do not neqatively impact scenic resources. Therefore, we feel
that the instant proposal complies with Policy 3.

Creek. The proposed revetment will also reduce current erosion which will in and of itself reduce siltation
into the Creek Therefore, we feel that the instant proposal complies with Policy 4.

thereby preventinq any upland soils from enterinq Goose Creek. The choice to construct in only the most
affected areas and not the entire shoreline, will further "protect and restore ecoloqical quality..." by limitinq
the amount of siltation caused by the instant proposal. Therefore, we feel that the proposal fully complies
