Box 1179 Southold, New York 11971-0959 Telephone (631) 765-1892 Fax(631)765-6641 The Board of Town Trustees took the following action during its regular meeting held on Wednesday, January 22, 2014 regarding the above matter: WHEREAS, MARK BUSHELL applied to the Southold Town Trustees for an Amendment to Wetland Permit #3746 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and for a permit under the provisions of Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, application dated December 6, 2013, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of permit on structure; a 15' wide non -turf buffer to be established and subsequently maintained landward of bulkhead, and, 0 0 WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on January 22, 2014, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 and Chapter 111 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of MARK BUSHELL for an Amendment to Wetland Permit #3746 and for a Coastal Erosion Permit to excavate the landward side of existing 124' long bulkhead and two 10' long returns to install new vinyl sheathing, piles, and deadmen; new tie -rods will be connected to new 10"x20' long piling installed adjacent to existing facepiles; with the condition to establish and subsequently maintain a 15' wide non -turf buffer landward of bulkhead; and as depicted on the survey prepared by Joseph A. In 2004 the Board of Trustees issued a Wetlands Permit 5890 for a construction of a new residence and driveway that included the condition that a 10' non -turf buffer be installed landward of the bulkhead. It is recommended that the Board requires that the existing vegetation be retained to the greatest extent practical. Further, it is recommended that the 15' buffer proposed in this action be designed to achieve plant density to pre -construction conditions. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The project is certainly a beneficial use of the coastal location, and there will not be even an incremental in- crease in development in the area. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold. ❑ YES VO ❑ NOT APPLICABLE The existing bulkhead is of low profile and will continue to be inconspicuous in its present location, and the existing natural buffer area landward of the bulkhead con- tributes to its suitability in this location. The addition of terraced steps to access the undeveloped area immediately landward of the bulkhead will not be visually intru- sive. It is compatible with other existing shoreline structures in the area, and will 0 0 not adversely affect the dynamic landscape elements (tidal fluctuations, seasonal vegetation changes) which might contribute to ephemeral visual qualities. However, the entire shoreline in the area of the proposed project (650' northwest and 550' southeast) is hardened either by bulk - heading or by a single rock revetment (-300' northwest), and the entire northeast- ern shore of Orient Harbor is developed. The main thrust of the NYSDOS narrative appears to be the protection of water quality in the area, and the proposed project will not have any lasting adverse impact on water quality in Orient Harbor. All statutory and regulatory requirements, at all levels of government, will be strictly complied with. No dredging is proposed, and the minimal amount of con- struction required at grade level seaward of the bulkhead will be conducted in such a way, with the advice and consent of the Southold Trustees, as to minimise any impact upon the waters of Orient Harbor. 0 0 Policy 7 Protect and improve air quality in the Town of Southold. ❑ YES VNO ❑ NOT APPLICABLE The construction or future use of the project as proposed will not result in signifi- cant amounts of new air pollution.
