I, John/vardy and Linda/Vardy, 39-27 220th Street, Baysid~ New York 11361, hereinafter called his wife, both residing at the Owner; WHEREAS, the OWner has title to certain lands situate, lying and being at Southold in the Town of Southold, county of Suffolk and State of New York, said lands hereinafter being more par- ticularly described; and WHEREAS, it is the OWners' intention that the aforesaid lands be subdivided into a minor subdivision consisti~ of not more than three residential lots. NOW THEREFORE, the following described lands shall be restricted as hereinafter set forth; ALL that certain plot, piece or parcel of land situate, lying and being at Southold in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a point on the northwesterly side of Sound- view Avenue which point of beginning is 120.66 feet northerly along the northwesterly side of Sound view Avenue from the intersection of the northwesterly side of said Sound view Avenue with the northerly side of Dogwood Lane. Running thence from said point of beginning north 420 03' 10 seconds west along said northeasterly side of lands of Bowes353.93 fe~t to land now or formerly of Gilbride, running thence along land of Gilbride and lands of Siebert, Green, Tuttle and Briamonte north 320 55' and 20 seconds east 430.28 feet to the southerly side of lands now or formerly of Carnegie running thence along said lands of Carftegie the following two courses and distances: 1. South 630 04' 30 seconds east 144.28 f~; 2. South 590 29' 20 seconds east 144.07 feet to th~AwesterlY side of Soundview Avenue. RUnning thence along the northwesterly side of Soundview Avenue south 270 12' 10 seconds west 545.87 feet to the place or point of BEGINNING. DECLARANT DOES hereby warrant, covenant and represent that on approval of the aforesaid land as a minor subdivision by the Planning Board of the Town of Southold, no further application will be made to that Board or to any other Board in the Town of Southold to further subdivide any of the lots set forth in said minor subdivision. DECLARANT does hereby further warrant, covenant and represent that the aforesaid described lands within the minor subdivision cannot be subdivided into more than three lots and that each such lot shall comprise an area of not less than 40,000 square feet. DECLARANT does hereby further warrant, covenant and represent that the aforesaid described lands as shown on a certain subdi- vision map dated November 28, 1975 made by Roderick VanTuyl, P.C., -2- RUDOL.PH H.
