A. For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
' 4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing" land uses:

a. This application MUST be completely filled in by typewriter or in irak and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for ap_
addition six months. Thereafter, a new permit shall be required.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without further review under SEQRA.
LWRP EXEMPT/CHAPTER 268 DETERMINATION: The land area encompassing the
proposed construction is shown on a survey prepared and updated August 17, 2007 by John
Metzger of Peconic Surveyors, P.C. at 112 feet from the mean high water mark adjacent to
Goose Creek. Chapter 268 requires a minimum separation distance of 100 feet, and this
application is determined to be exempt, as a minor action under Section 268-3F.
PROPERTY FACTS/DESCRIPTION: The applicants' property contains 26,674 square feet of
total lot size with 100 feet along Waterview Drive and 108.42 feet along Goose Creek, and
located in the R-40 Low-Density Residential District. The premises is improved with an
existing single family dwelhng, as shown on survey prepared by John Metzger, Peoonic
Surveyors, dated 9/24/2004.
AREA VARIANCE RELIEF REQUESTED: Request for a Variance under Section 280-124,
based on the Building Inspector's August 1, 2007 Notice of Disapproval concerning proposed
additions and alterations to an existing single-family dwelling, for the reason that the new
construction will be less than the code-required 35 ft. side yard setbacks (total). Construction
requested by applicants includes the proposed replacement of an open deck with a single-story
addition to the dwelling of 20 ft. x 28 ft., a 11.6 ft. by 15.6 ft. sunroom, and an adjacent 10 ft. by
15 ft. open deck, as shown on map dated 9/24/04 prepared by John Metzger, Peconic Surveyors
and Elevation Plans prepared by Creative Concepts dated May 2007.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted
and personal inspections, the Board makes the following findings:
1. Town Law ~267-b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change
in the character of the neighborhood or a detriment to nearby properties. The applicants' parcel
is improved with a ranch-type home constructed about the early 1970's. The property has
frontage along Goose Creek, a tidal waterway. Applicants are requesting the replacement of an
open deck with a single-story addition to the dwelling of 20 f~. x 28 ft., a 11.6' by 15.6' sunroom,

and an adjacent open deck of 10 ft. x 15 ft. The real variance on the side yard that the neighbor
has totally screened along their northerly property line.
2. Town Law §267-b(3)(b)(2). The benefit sought by the applicants cannot be achieved by some
method, feasible for the applicants to pursue, other than an area variance. The applicants'
home was not built perpendicular to the public road and the corner of the foundation is within
the side yard area.
3. Town Law ~267-b(3)(b)(3). The relief requested is not substantial, resulting in 11% of a
variance for total side yards, approximately four feet.
4. Town Law §267-b(3)(b)(5). The difficulty has not been self-created. The difficulty is related
to the location of the existing building and location of the creek and other code provisions for
new construction.
5. Town Law §267-b(3)(b)(4). The granting of this application will not impact the physical or
environmental characteristics of the immediate neighborhood. The additions/alterations to the
rear of the home are well landward of the waterfront.
6. Grant of the relief requested is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of their property, while preserving and protecting the character of
the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member Goehringer,
seconded by Member Weisman, and duly carried, to
Grant the variance as applied for, as shown on survey prepared by John Metzger,
Peconic Surveyors, dated 9/24/2004 and Elevation Plans prepared by Creative Concepts
dated May 2007.
Any deviation from the variance given such as extensions, or demolitions which are not shown
on the applicant's diagrams or survey site maps, are not authorized under this application when
involving nonconformities under the zoning code. This action does not authorize or condone any
current or future use, setback or other feature of the subject property that may violate the
Zoning Code, other than such uses, setbacks and other features as are expressly addressed ih
this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an
alteration that does not increase the degree of nonconformity.

The Southold Town Board of Trustees reviewed the survey prepared by John T.
Metzger last revised August 17, 2007 and determined the proposed construction of an
addition to the existing dwelling, deck and sunroom to be out of the Wetland jurisdiction
under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wettands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised,
however, that no constructior~, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.
