No. 4920—ANNE MACKAY Location of Property: 555 South View Drive, Orient Parcel 1000-13-3-8 Date of Public Hearing: March 15, 2001 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The subject property is a 25,419 sq. ft. parcel located on the south side of South View Drive in Orient. The lot has 160.12 ft. frontage along South View Drive and lot depth along the westerly side of 17.371 ft. The property is improved with an existing one and one-half story frame house, as depicted on the survey dated October 12, 2000, prepared by Joseph A. Ingegno, L.S. BASIS OF APPEAL Building Inspector's Notice of Disapproval dated December 14, 2000, denying an application for a permit to build an addition because the addition is less than 40 feet from the front property line. RELIEF REQUESTED: Applicant requests a variance for a proposed addition at the east side of the dwelling with a front yard setback at 33 feet at its closest point to the front property line. The existing front yard setback is shown at 36.1 feet at the closest corner of the house. A small shed in the easterly side yard will be removed or relocated to a conforming area. as shown on the October 12, 2000 map : (a) locating an accessory swimming pool partly in a side yard. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) An undesirable change will not be produced in the character of the neighborhood or a detriment to nearby properties. The proposed addition will maintain the front line of the existing house and will therefore be incorporated into the existing structure with no overall change in the appearance of the existing setback. (2) The benefit sought cannot be achieved by some method, feasible for the applicant to pursue other than a variance because the proposed location is the most practical for the addition, and location on the southerly part of the house is constrained by an existing porch and a slope. (3) The amount of relief requested is not substantial. The applicant's request is to decrease the existing 36.1 ft. front yard to a setback of 33 feet at its closest point. (4) The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. No evidence has been submitted to suggest that the proposed addition will have an adverse impact on physical or environmental conditions. (5) The action set forth below is the minimum necessary and at the same time preserves and protects the character of the neighborhood and the health, safety and welfare of the community. MISCELLANEOUS CUTS ...................................................................... ................. .................................. .......... 2 DIVISION 1: GENERAL.REQUIREMENTS The General Requirements contained in this Division are intended to supplement conditions and requirements of the Work set forth elsewhere in the Contract Documents. If these General Requirements conflict with other requirements of the Contract Documents,the conditions imposing the most stringent requirements shall control. I. SUMMARY OF WORK A. The work of all divisions, sections and trades is subject to the requirements of the Contract Documents and this Division. B. Scope: The work as required by Contract Documents shall include furnishing all labor, materials,appurtenances,equipment and services necessary to complete all work shown or reasonably inferred on the Drawings and/or specified herein: 1. Site Preparation, including but not limited to: - Relocation of the existing shed(two times removals might be required,at the beginning of the project and the end) - Removal of natural debris existing in the front yard. 2. Bedroom Addition 3. Repair and/or reinforcement of existing building,including: - Application of Clorox on the existing roof - Floor structural reinforcement around the existing bathroom C. "Provide"means furnish and install. All work indicated on Drawings as"N.I.C."or"Owner supplied"will be furnished by others and installed this Contract. D. The Owner reserves the right to perform construction or operations related to the Project with the owner's own forces.The Contractor shall participate with other separate contractors and the Owner in reviewing their construction schedules. II. GENERAL REQUIREMENTS A. All work shall conform to the latest edition and addenda of the New York State Building Code, State Energy Code,and all other applicable codes and laws,Hiles,regulations,and requirements of governmental Authorities and insurance companies having jurisdiction or coverage of the locus or Owner. B. Work shall be executed by licensed practitioners and personnel skilled in the trades. C. Guarantee: General Contractor shall guarantee all Work and Materials for a period of one(1) year from the date of final Certificate. Neither the final Certificate Payment,nor termination of the guarantee period shall relieve the Contractor of the responsibility for negligence or faulty, materials or workmanship within the extent and period provided for by the law. More extensive warranties shall not be affected by this guarantee. D. Cary all necessary insurance to fully indemnify Owner and Owner's representatives hannless against all losses,expenses and claims for death,personal injury,and property damage arising out of Work done by Contractor or subcontractors. E. The Contractor shall arrange and comply with all inspections required by local codes. F. Special Conditions: 1. During the construction,the Contractor to maintain Owner's accessibility to all the property except this addition part,ready-to-use condition for all the existing equipment and systems for the Owner's use. 2. When the construction requires temporary cut of electricity,gas,water, waste,telephone and/or like,or when any other part of the property need to be worked related to this construction,the Contractor shall previously notice to the Owner with the schedule of the work. 6 DIVISION 1:GENERAL REQUIREMENTS(continued) III. PREPARATION A. Contractor shall examine the conditions and preparations made for the performance of each section of work and notify the Architect of conditions detrimental to the proper and timely completion of this work.Do not proceed with this work until conditions are made satisfactory for the performance of such work. B. Verify all dimensions and job conditions prior to construction and report to the Architect any discrepancies or omissions which would interfere with satisfactory completion of the work prior to the start of work or construction of work in the area concerted. C. Contractor shall protect all existing fixtures, surfaces,appliances, windows etcfrom damage. Contractor is responsible for damage to existing conditions. Contractor shall patch and repair all existing conditions not within the contract limit which may be disturbed by the construction. IV. INSTRUCTIONS,CHANGES,SUBSTITUTES A. Supplemental Drawings and Specifications: As finishes and details become further developed and refined by the Architect,drawings&specifications will be issued during construction.In the event that the Contractor feels these drawings affect the cost of work that has already been bid.a Change Order will be negotiated prior to the execution of the work involved. B. Verbal Instructions: it is the Contractor's responsibility to advise the Architect regarding any additional costs resulting from the Architect's verbal instructions;such advice shall occur before any additional work is executed. C. Considerations of substitutions:burden of proof of the merit of proposed substitutions upon the proposer. D. Approval by architect is required before installation. If substitute material,equipment,or alternative configuration is installed before it is approved by the Architect,the Contractor shall be liable for its removal and replacement at no extra cost. 7 DIVISION 1:GENERAL REQUIREMENTS(continued) V. SUBMITTALS A. VL CONSTRUCTION SCHEDULES A. Submittal: the first schedule shall be submitted prior to the start of the Work,include commencement,order and completion dates for the various parts of the work; submit subsequent schedule changes as they arise. B. The contractor shall schedule connection to existing building and systems at a time that will be convenient for the Owner and cause minimum disruption to all parties involved. C. The Contractor shall schedule and coordinate with Utility Companies, such as Electrical, telephone,and/or cable TV companies,for such Utility Companies'work in connection with this Project. VIL CONSTRUCTION ADMINISTRATION A. Job site:the Contractor shall maintain on the premises an up-to-date and complete set of drawings,specifications,supplemental details,shop drawings,specification submittal,and Architect correspondence for the duration of the project,for the sole purpose of keeping an accurate record of changes made during the construction. B. Telephone:Quick and accessible communication shall be provided in a manner acceptable to both the contractor and the architect. C. Supervision:the Contractor or Contractor's superintendent shall supervise and coordinate all the Work defined by this document and Drawings whether by his own or his Subcontractor's forces. The Contractor's superintendent shall be personally present at the site for at least a portion of each day that the work is in progress whether by his own or his subcontractor's force. D. Contractor shall resolve all problems of related work. In case of conflicts due to improper coordinating by the Contractor,the Architect's resolution will be final.No compensation will be awarded for extrl work required resolving the conflicts. E. Trash removal: Contractor shall remove all trash from the site on a regular basis in accordance with all regulations. 8 DIVISION 1: GENERAL REQUIREMENTS(continued) F. Material receiving,moving,storage and protection: 1. It shall be the Contractor's full responsibility to make all arrangements and pay all charges for material moving, storage,removal etc. 2. Protect all equipment,materials and installations until final acceptance of work. 3. The Contractor shall be responsible for the security of his materials and equipment and those items bought by the Owner and installed this contract. He shall not receive any additional payments for replacement of such which are lost, stolen or in any way damaged or unfit for use. Contractor shall be responsible for securing the site whenever the Work is not in progress. VIIL PROJECT CLOSE-OUT A. Substantial Completion:the Architect shall issue a Certificate of Substantial Completion after the permanent utilities are in operation and the Work has progressed to the point that the Owner could occupy the project for its intended use with full access and all occupancy permits and approvals by governing authorities and franchised services are complete;the Certificate shall establish responsibilities of the Owner and Contractor for security,maintenance,utilities, damage to the work,and insurance,and shall fix a deadline,negotiated between the Contractor and the Owner,for the completion of all Punch List items;all warranties required by the Contract Documents shall commence on the date of the Certificate of Substantial Completion. B. Punch List: the Architect shall attach to the Certificate of Substantial Completion a Punch List setting forth the remaining work required to close-out the Contract;the Punch List and deadline may be amended repeatedly as further deficiencies in the Work arise;if the Punch List work is not completed by the deadline,the Owner may carry out the Work. C. Cleaning:the property shall be left spotlessly clean and in first class condition and repair. The entire interior of the property shall be vacuumed dust free including all cabinet interiors, window sills,etc.;all floors shall be thoroughly cleaned and dust-mopped,damp-mopped,or vacuumed as appropriate to the finish;all wall tile,glass,light fixtures,plumbing fixtures,and hardware shall be spotless;the entire exterior of the project and site shall be cleaned with the ways appropriate to the finishes and configurations;replace HVAC and water filters if units were operated during construction;cleaning operations shall be completed just prior to Owner occupancy;Comply with manufacturer's instructions;Remove labels that are not permanent; replace damaged materials;clean the landscape development of litter;repaint any marred or stained surfaces;each Punch list item performed after Owner occupancy shall be subject to the above cleaning requirements the Owner may carry out the Work. D. Owner's Manual: Provide Owner with all Owner's Manual and product service warranties for HVAC equipment,all appliances,etc.;also include a typewritten list of all subcontractors and their phone numbers and addresses;submit to Architect. E. Final Payment:after the Contractor has completed the Punch List, submitted the Owner's Manual,and submitted a complete release of liens to the Architect from every entity,including Contractor,who could lawfully and possibly file a lien arising out of the contract and related Work covered by the payment,the Architect shall issue the final Certificate for Payment.The final payment to the Contractor shall be made no later than 30 days after the date of issue and 7 days after the expiration of the final date for filing labor and material liens. F. Upon completion and final acceptance of the work,provide one complete check and adjustment, including any refitting that may be required of all operating doors. This work is to be performed at a time acceptable to the Owner between six and twelve months after Substantial Completion. 9 DIVISION 2-SITE WORK 02200 EARTHWORK PARTI: GENERAL 1.01 Scope of Work: labor and materials required to finish and to install site preparation,all excavation and filling works for the Project,includes: 1. The existing waste line might have a conflict with this excavation Make sure to protect the pipe form any damage and suppot the pipe as required. 3.03 Excavation Protection and Erosion Control: A. Keep excavations free from ground and surface water.Maintain ground water in bearing strata at safe levels by methods that preserve undisturbed state of bearing soils and prevent loss of fines.Dispose of collected water without causing silting drainage systems or erosion of site or adjoining property. 3.04 Fill and backfill: A. Before backfilling,remove trash and debris from excavations. B. Install material in separately-compacted 6"(rnax.)loose lifts. PART 2: PRODUCTS 2.01 Sheet Metal Duct Work: A. All high and low pressure ducts shall be galvanized steel, 28 gauge minimum, except where otherwise specified,with gauges,bracing and construction in accordance with the latest SMACNA duct manual standards,drive slips and snap lock connections are not permitted. Total air volume for low pressure duct systems shall be at least 95%of fan supply when measured by duct traverses taken with a pitot tube and water manometer. B. All low pressure supply, return and exhaust ductwork shall be fabricated in accordance with SMACNA standards for 2" WG construction. C. Air diffusers and grilles shall be located in conformance to architectural plans,where so indicated. D. All new and existing low pressure ductwork shall be taped and sealed with duct sealant to maintain a leakage rate of no greater than 5 percent of air volume. 2.02 Grilles,Registers and Diffusers A. Air supply registers shall be provided with adjustable face louvers parallel to the long dimension. Provide key operated opposed blade dampers fixedly attached to the grilles. B. Air return grilles and registers shall be provided with fixed face louvers parallel to the long dimension and set at 45 degree angle. For registers,provide key operated opposed blade dampers fixedly attached to the grilles. C. All air outlets shall be steel and shall be factory painted with acrylic white enamel paint finish or other color as directed by architect. D. All ceiling type air diffusers shall be provided with equalizing deflector and volume dampers. 2.03 Electrical Automatic Temperature Control: as manufactured by HONEYWELL, JOHNSON or ITT-PENN CONTROLS. 32 DIVISION 16-ELECTRICAL 16050 ELECTRICAL PARTI:GENERAL 1.01 Scope of work: Including all new connections,distributions,wiring and switch legs as required for outlet and lighting on Drawings;including general convenience receptacles as indicated on Drawings;including separate circuits and wiring for all items of mechanical equipment; including all lighting fixtures,fans,appliances,cable TV and telephone wiring;including fireismoke detector/alarm system. 1.02 Permits and Certificates A. B. The contractor shall be responsible for performing all controlled inspections required by applicable Administrative building Code. 1.03 Coordination with other trades: A. Where the work will be installed in close proximity to the work of other trades,or where there is evidence that the work will interfere with the work of other trades,arrange space conditions to make a satisfactory adjustment.If work is installed before coordinating with other trades,make necessary changes to the work to correct the condition without additional cost to the owner. The electrical contractor shall install all wiring for the mechanical systems requiring field wiring,according to the wiring diagrams provided by the mechanical contractor. 1.04 Install smoke,fire,heat,and/or CO detectors,complying with all applicable codes,including existing and renovated area. Submit layout and appropriate type for each detector. The bid shall be based on each Bidder's evaluation. PART 2: PRODUCTS A. Local wall switches: 1.
