SEQRA DETERMINATION: The Zoning Board of Appeals has visited the properly under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County
Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply stating
that this application is considered a matter for local determination as there appears to be no significant county-wide
or inter-community impact.
PROPERTY FACTS/DESCRIPTION: The subject property is a 31,915 sq. ft. non-conforming, irregularly shaped lot
in the Residential R-40 District. It fronts on Crabbers Road (an unopened paper right-of-way) and on Broadwaters
Cove Road, and is adjacent to wetlands and Haywaters Cove. It is improved with a single- family dwelling and raised
wood deck and hot tub.
BASIS OF APPLICATION: Request for a Variance under Section 280-124A, based on an application for a building
permit and the Building Inspector's March 5, 2009 Notice of Disapproval concerning raised patio and swimming pool
construction which will be less than the minimum code-required 40 fl. front yard setback on this 31,916 square foot
parcel
LWRP DETERMINATION: This application has been reviewed under Chapter 268, Waterfront Consistency review of
the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. A letter
dated June 19, 2009 was received from the LWRP Coordinator Mark Terry, stating that based upon the information
provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available
to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore
is CONSISTENT with the LWRP
RELIEF REQUESTED: The applicant proposes to construct a raise terrace at a 7 ft. front yard setback from
Crabbers Road, an in ground swimming pool at a 12 ft. front yard setback from Crabbers Road right-of-way where
the code requires a minimum 40 foot front yard setback. In addition, the applicant proposes to construct extensive
perimeter retaining walls with re-grading around the proposed terrace and pool area, seaward of the existing
dwelling, and in the existing front yards parallel to Crabbers Road and Broadwaters Road.

ADDITIONAL INFORMATION: The applicant submitted an altemate site plan for the proposed raised terrace and
pool to the NYS DEC which located the construction on the seaward side of the existing dwelling at 50 feet from the
wetlands along Haywaters Cove. (See site plan by Garrett A. Strong, Architect, dated 3-21-08 labeled drawing No.
SP-1). This alternate site plan would not have required a front yard setback variance from the Board of Appeals.
This plan received approval from the Southold Town Board of Trustees (See letter dated Mamh 19, 2008). However
it was denied by the NYS DEC because it failed to meet Article 25 Section 661.9(b)(1)(i) and (iv) of the
Environmental Conservation Law. The DEC recommended the placement of a proposed raised terrace and in ground
pool in place of the applicant's as built non-conforming raised wood deck on the northeasterly side of the house, for
which a vadance for a 14 ft. setback from Crabbers Road was granted by the Board of Appeals on November 6,
2003 (No. 5400). (See letter from the DEC dated May 14, 2008). The applicant's revised site plan is the subject of
the relief in this vadance application.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and pemonal
inspections, the Board makes the following findings:
1. Town Law §267-b{3)lb)(3)11). Grant of altemative relief will not produce an undesirable change in the character
of the neighborhood or a detriment to nearby properlies. There is an existing raised wood deck and hot tub on the
subject property with a non-conforming 14 ft. front yard setback from Crabbem Road, which is a narrow paper read
that is unopened. The applicant has a driveway over Crabbem Road right-of-way for access to his property from
Bmadwaters Cove Road and the adjacent land on the opposite side of the paper read which the applicant also owns.
There are significant slopes on the subject property which require re-grading for the proposed raised terrace, pool,
and lawn areas that ara not typical of other structures in the front yards of neighboring properties. The Board, in
granting alternative relief, seeks to minimize the visual impact that the proposed construction will have on
Broadwatem Cove Road as well as Crabbers Road right-of-way from both front yards on the subject property.
2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for
the applicant to pursue, other than an area variance because the existing dwelling is setback 39 feet +/- from
Crabbers Road ~ght-of-way, and the NYS DEC required the applicant to construct the proposed raised terrace and
pool in the front yard facing Crabbers Road in place of a non-conforming as-built deck and hot tub structure.
3. Town Law §267-b(3)(b)(3). The vadance as applied for is substantial. The code requires a minimum front yard
setback of 40 ft. The pre-existing non-conforming setback of the as built raised wood deck and hot tub is 14 feet
which is a 65% vadance from the code. Since the proposed consl]*uction involves the demolition of the existing wood
deck, and Crabbers Road is an unopened paper right-of-way, the Board of Appeals seeks to reduce the proposed
new non-conformity by granting Altemative SeE)ack Relief from Crabbers Road right-of-way for a minimum of 15
feet, which is a 62.5% vadance from the code.
4. Town Law §267-b(3)lb)(5). The difficulty has been self-created, however, the proposed location is the result of
the NYS DEC denial of a request to place a raised terrace and pool in a location that would not have required a front
yard setback variance.
5. Town Law ~267-b~3){b)~4}. No evidence has been submitted to suggest that a vadance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. A letter
dated June 23, 2009 from Nicole Spinelli of the County of Suffolk Soi! and Water Conservation District indicated that
no natural resources concems were observed on the subject property with regard to the proposed construction of a
raised terrace, in ground swimming pool and retaining walls. The property is heavily vegetated and the shoreline

along Broadwaters Cove is in stable condition. The site plan submitted includes a proposed drywell for both pool
water backwash and roof run off.
6. Town Law §267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a raised terrace, swimming pool and retaining walls, while preserving and protecting
the character of the neighborhood and lhe health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New
York Town Law 267-B, motion was offered by Member Weisman, seconded by Chairman Goehringer, and duly
carried, to
DENY as applied for, and further to
GRANT ALTERNATIVE RELIEF as noted below and subject to the following CONDITIONS:
1. The selback from Crabbers Road for the proposed accessory structure shall be 15 feet.
2. A new site plan showing pool location at 15 ft. from Crabbers Road, all retaining walls, drywells for pool
water backwash and roof runoff ,evergreen screening, and the location of mechanical equipment for the pool
in the Broadwaters Cove Road front yard, shall he submitted to the Board of Appeals before a building
permit is issued.
3. Pool equipment shall be housed in a sound proof container.
4. The pool and raised terrace shall remain open to the sky.
5. A line of evergreen trees, minimum 5 feet tall, planted 4 feet on center, shall be k)cated between and
parallel to the proposed raised terrace/pool and Broadwatera Cove Road for a length of 40 feet (+/-) to
create pdvacy screening.
That the above conditions be wdtten into the Building Inspector's Certificate of Occupancy, when issued.
Any deviation from the vadance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey
site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not
authorize or condone any current or future use, setback or other feature of the subject property thai may violate the Zoning Code,
other than such uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the ~jht to substitute a similar design that is de minimis in nature for an alteration that does not increase the
degree of nonconformity.

I have reviewed with the Building Inspector the site plan and letter of inquiry that the ZBA
Office received from you on 1/14/10 regarding meeting the required conditions for
altemative relief granted in ZBA appeal #6290 (Spiro Geroulanos). All of the conditions
as described in the Determination are satisfied with the exception of condition//5 which
requires that: "a line of evergreen trees, minimum 5' tall planted 4' on center, shall be
located between and parallel to the proposed raised terrace/pool and Broadwaters Cove
Road for a length of 40 fl (+/-) to create privacy screening." Your survey shows a
proposed line of evergreen trees along Crabbers Road (the unopened R.O.W.).
Please relocate the required 40 fi. line of evergreens so that it is parallel to the 18 ft. width
of the proposed pool and the 35 ft. width of the proposed stone terrace. The final site
plan/map should be submitted to the Building Inspector with a cover letter. Please furnish a
copy of the cover letter and one print of the final site plan/map to the ZBA office for
permanent recordkeeping.

The property is situated on Broadwalers Cove in Nassau Point. The site is hca~ily vegetaied with trees,
shrubs and lawn grass. The land slopes towards the Cove where there exists wetland vegetation, a small
sandy beach and a wooden dock. The house is not fit~l with gutters, downspouts or drywells. At the ~c
of the visit there was no erosion and the shoreline was in stabile condition. It is recommended ilmt
provisions for draining thc proposed pool be made; pool water should never be drained into the Cove.

Dear Mr. Strang;
The Department objects to the proposed project at the Geroulanos property as this proposal fails to meet
Article 25 section 661.9(b)(1)(i)and (iv) of the Environmental Conservation Law. The limit of
jurisdiction remains at the 20' contour line and the construction as proposed does not meet development
restrictions. Reasonable alternatives should be considered.
The Department recommends project to be modified to show pool on east side of house or in place of the
existing wood deck with a small deck on the west side 75' from the tidal wetland boundary. Please send
4 copies of revised plans to my attention.

Enclosed is an original and seven (7) copies of all required elements in connection with the above
referenced matter, together with the required fee and one copy of an affidavit of service on the Building
Department.
The applicant seeks relief from the required 40' front yard with the proposed setback to be 7' to a new
terrace and 12 feet to a new swimming pool. Please note that this is a second front yard on an unopened
road and all other zoning requirements have been met. We respectfully request the Board's consideration
for approval of this reduced setback, inasmuch as there presently exists a 14' front yard established by the
existing deck and hot tub which was granted relief by the ZBA under appeal # 5400. The proposed pool
and terrace will replace aforementioned deck and hot tub.
For further consideration, the applicant originally wanted to locate the pool and terrace in the westerly rear
yard between the house and creek which would not have required a variance. A permit was secured from
the Southold Town Trustees for this location however; the New York State DEC denied our application
for such a permit. They indicated that they would allow the pool and terrace to be located as now shown
in the northerly yard as a replacement for the existing deck and hot tub and have in fact issued a permit for
same.

FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF NOVEMBER 6, 2003 NOV I 9 2003
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without an adverse effect on the environment if
the project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 31,422 sq. ft. parcel has 230+- ft.
frontage along the northerly property line, an unopened access easement referred, to as
"Crabbers Road" and 74.28 feet along Broadwaters Road. The property consists of Lots
264 and part of 265 on the Amended Map A of Nassau Point filed in the Suffolk County
Clerk's Office on August 16, 1922 as Map No. 156. The lot is improved with a single-
family one-story frame house with as-built deck and hot tub, as shown on the May 13,
1986 survey, revised June 20, 2003, by Pecontc Surveyors, P.C.
BASIS OF .APPL CATION: Building Department's May 30, 2003 Notice of Disapproval,
citing Section 100-244B, in its denial of a building permit application for an "as-built"
deck and hot tub addition at less than 40 feet from the front lot line.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on October 23,
2003, at which time written and oral evidence were presented. Based upon all
testimony, documentation, personal inspection of the property, and other evidence, the
Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTS:D; The applicant is requesting a variance for the
as-built deck-hot tub addition, presently 14.1 feet from the northerly front line facing
Crabbers Road (an unopened right-of-way), shown on the May 13, 1986 survey, revised
June 20, 2003 by Peconic Surveyors, P.C.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Grant ofthe relief requested will not.produce an undesirable change in the character
of the neighborhood or a detriment Io nearby properties. The 'as built' upper deck
measures approximately 20 feet x 15 feet, and the attached lower deck-hot tub area
measures approximately 12 feet x 12 feet, located on the northeast side of the house.

The deck construction faces a paper road, which is undeveloped and referred to as
'Crabbers Road'. The applicant has a driveway over Crabbers Road for access to his
adjacent land on the opposite side of the paper road.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for
ap~Pl[6ant to pursue, other than an ama variance. The appliCant has two front yards as
noted on:the.June 20, 2003 survey prepared by Pecenic Surveyors Inc. This right--of-
way easement referred to as Crabbers Road is not developed, and may never be
developed:. iTlie d~ck COnStruction is located 14..1 feet at the closest polnt to the front
!Jne.alorig crabbers Road, and the paper width is approximately 22 feet wide. The width
.0f.lthe.paper easement allows .a visual seE)ack of a greater distance .(37+-') from the
adjaCent property, also owned by the applicant.
3. Al~0ugh the rellaf requested is substantial in relation to the 40 ff. front yard code
raquirernent, the relief granted is the minimum necessary, and Is based on the fact that
the flghtTOf-Way referred to as Crabbers Rood has not bean developed or used as a
roadway, giving a Visual buffer greater than the actual 14.1 ff. setback.
4. Although the .house was built in its present location more than 30 years ago, the
difficulty was :se[f-created when the applicant built the new construction without seeking
reqUired: permits.
5. 'l'hera is no evidence that the grant Of the relief requested will have a~ adveme effect
or impact On physical or environmental COnditions in the neighborhood or district. The
applicant is also'required to obtain review determinations from the State and local
envirohrhental agencies with respect to the adjacent wettend areas.
6. Grant of the relief requested is the minimum action necessary and adequate to enable
the applicant to ehjoy the benefit of the hot-tub/deck addition, while preserving .and
protecting the 'character of the neighborhood and the health, safety and welfare of'the
COmmunity.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member
Orlando (Vice Chairman), seconded by Member Geehringer, and duly carried, to
GRANT the variance as applied for, as shown on the May 13, 1986 survey,
revised June 20, 2003 by Peconic Surveyors, P.C., SUBJECT to the Condition
that the hot-[ub/deck addition shall remain open to the sky.

Dear Mr. Strang,
I hove reviewed with the Building Inspector the site plan and letter of inquiry that the ZBA
Office received from you on 1/14/10 regarding meeting the required conditions for
alternative relief granted in ZBA appeal #6290 (Spiro Geroulanos). All of the conditions
as described in the Determination are satisfied with the exception of condition #5 which
requires that: "a line of evergreen trees, minimum 5' tall planted 4' on center, shall be
located between and parallel to the proposed raised terrace/pool and Broadwaters Cove
Road for a length of 40 ft (+/-) to create privacy screening." Your survey shows a
proposed line of evergreen trees along Crabbers Road (the unopened R.O.W.).
Please relocate the required 40 ft. line of evergreens so that it is parallel to the 18 ft. width
of the proposed pool and the 35 ft. width of the proposed stone terrace. The final site
plan/map should be submitted to the Building Inspector with a cover letter. Please furnish a
copy of the cover letter and one print of the final site plan/map to the ZBA office for
permanent recordkeeping.

Dear Mr. Strang:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, March 19, 2008 regarding the above matter:
WHEREAS, Garrett A. Strang, Architect on behalf of SPIRO GEROULANOS applied to
the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated January 22, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on March 19, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of SPIRO
GEROULANOS to install an in-ground swimming pool, terrace, retaining wall, and new
lawn area, with the condition of a line of stakes hay bales along the 9' contour line, a 50'
non-disturbance buffer area seaward of the retaining wall with a 4' wide trimmed path to
the beach, re-vegetate any areas in the non-disturbance buffer area disturbed by
construction, a pool drywell installed to contain run-off, and as depicted on the site plan
prepared by Garrett A. Strang, Architect, last dated March 21,2008, and received on
March 25, 2008.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Dear Ms. Weisman and Members of the Board:
In response to the Boards determination of July 21, 2009, enclosed are eight (8) copies of an amended Site
Plan incorporating the following required conditions of the alternative relief granted.
Setback of accessory pool from Crabbers road is now shown to be 15'.
All existing and proposed retaining and landscape walls are shown.
Al 1 roof drainage and swimming pool backwash dry wells are shown.
Pool equipment location with sound absorbing container is shown.
A line of evergreen screen planting 5' high ~ 4' o/c is shown along both
the Broadwaters and Crabbers Road property lines. In addition, the Owner
is considering ,as part of his landscaping plan, a screen planting along
both the Broadwaters and Crabbers Road side of the pool terrace.
I believe this addresses all the conditions, however, if you have any questions or require any additional
