SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and
determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA.
PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 21,000+/- square foot lot measuring 100 feet
along Rocky Point Road and 210 feet deep. It is improved with a single-story, one family dwelling as shown on the survey
prepared by Otto W. Van Tuyl and Son dated November 26, 1963.
BASIS OF APPLICATION: Request for a Vadance under Section 280-124, based on the Building Inspector's November 6,
2008 Notice of Disapproval concerning a proposed addition and alterations to the existing single-family dwelling on a
nonconforming 21,000+/- square foot lot, stating that the new construction will be less than the code-required minimum side
yard of 15 feet.
LWRP: This application is not subject to review under Chapter 268 because the vadance relief requested does not involve
features that relate to a regulated natural feature or a bulkhead or other shoreline.
RELIEF REQUESTED: The applicant proposes an addition on the rear of their single-family dwelling measuring 5 ft. by 24 ft. to
expand the size of the living mom. The addition will maintain the pre-existing non-conforming side yard setback at 10 feet,
where the code requires 15 feet.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and pemonal inspections, the
Board makes the following findings:
1. Town Law §267-b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The proposed addition is only 5 ft. deep and 18 ft. high and will be in the
very large rear yard of this property, so it will not be visible from the road. The rear yard and side yards are screened from
neighbors by mature trees and vegetation.
2. Town Law §267-b(3)(b)(2). The benefit sought cannot be achieved by some method, feasible for the applicant to pursue,
other than an area variance because the house was originally built many years ago with a 10 ft. side yard (nonconforming).
Stepping back the proposed addition by another 5 feet would create a much less functional and attractive amhitecturel solution
to the applicant's needs for an expanded living room space.

3. Town Law {267-1~3)(b1(31. The variance granted heroin/s not substantial in so far as the proposed addition will maintain an
existing 10 ft. side yard and the fact that the house is located very close to the southerly propen'y line, leaving a 16 +/- foot on
the side yard on the norlh on a very narrow lot.
4. Town Law ,~267-b(3)(b)(5). The difficulty has nat been self-created but is the result of a pre-existing non-conforming side
yard.
5. Town Law ~267-b~3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will
have an adveme impact on the physical or envimnmantal conditions in the neighborhood. The subject pmpe~ is fiat, and the
proposed addition is to be built on slab ~hout land disturbance.
6. Town Law ,~267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of an expanded living room space, while preserving and protecting the character of the neighborhood and the
health, safety and welfare of the commune.
RESOLUTION OF THE BOARD: In considering all of the above facto~ and applying the balancing test under New Yod( Town
Law 287-B, motion was offered by Member Weisman, seconded by Member Schneider, and duly carried, to
GRANT the variance as applied for and shown on the architectural plans dated October 2008 (Project No. 08051)
numbered shoats 1-5 prepared by Edward J. Cebul, Design Den, subject to the following Condition:

Any deviation from the vadance given such as extensions, or demolitions which are not shown on the applicant's diagrams or

Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.

temperature in January is 25'F (-¢'C) or less or when Fable RflBOL2(1)
criteria so designates, an ice barrier that consists of a least
two layers of underiaymen[ cemented together or of a self-adhering
polymer modified bitumen sheet, shall be used in geu of normal
undeda?ment and extend from the eave's edge to a point at least 24
inches (610 mm) inside the exterior wall line of [he building.

vertical in 12 units horizontal (17-percent slope), up to four units
vertical in 12 units horizontal (33-percent slope), underlayment shall be
two layers applied in the following manner, Apply a 19-inch (485 mm)
strip of underlayment felt parallel with and starting at the ea~es,
fastened sufficiently to hold in place. Starting at the eave, apply 36-
inch-wide (914 mm) sheets of underlayment, overlapping successive sheets
19 inches (483 mm), and fastened sufficlenfly to hold in place. For roof
slopes of four units vertical in 12 units horizontal (33-percent slope)
ar greater, underlayment shall be one layer applied in the following
manner. Underlayment shell be applied shingle fashion, parallel to end
starting from the eave and topped 2 inches (51 mm), fastened sufficiently
to hold in place. End laps shall be offset by 6 feet (1829 mm).

§RRg05.2.8 Flashing. Rashing for asphalt shingles shall comply with
this section.
§RR905.2.8.1 Base and cap Dashing. Ease and cap flashing shall be
installed in accordance with monufacthrer's installation instructions.
Rase flashing shall be of either corrosion-resistant metal of minimum
nom[nal O.019-inch (0.483 mm) thickness or mineral surface roll roofing
weighing a minimum of 77 pounds per 100 square feet (3.76 kg/m2). Cap
flashing shall be corrosion-resistant me[hi of minimum nominal
O.019-inch (0.483 mm) thickness.
§RR905.2.8.2 Valleys. Valley linings shall be Jnsthlled in accordance
with manufacturer's installation instructions before applying shingles.
Valley linings of the following types shall be permitted:
1. For open volley (valley lining exposed) lined with metal, the
valley lining shall be at least 24 inches (610 mm) wide and of any
of the corrosion-resistant metals in Table RR905.2.8.2.
2. For open valleys, valley lining of two plies of mineral surface
roll roofing, complying with AS]M D 249, shall be permitted.

§RR905.2.8.3 Crickets and saddles. A cricket ar saddle shall be
installed on the ridge side of any chimney greater than 39 inches (762
mm) wide. Cricket or saddle coverings shall be sheet metal or of the

§RR905.2.8.4 Sidewall flashing. Flashing against a vertical sidewall
shall be by the step-flashing method.
§RR905.2.8.5 Other fleshing. Rashing against a vertical front well,

All nails are smooth-common, box or deformed shanks except where
otherwise stated. Nails used for framing and sheathing connections
shall have minimum average bending yield strengths os follows: 8D ksi
(551 Mpa) for shank diameter of 0.192" (2Dd common nail), 90 ksi (620
Mpa) for shank diameters larger than 0.142" but not larger than
0.177", and 100 ksi (689 Mpa) for shank diameters of 0.142~ or less.
Staples are 16 gage wire and have a minimum 7/16-inch on diameter
crown width.
Rails shall be spaced at not more than 6 inches on center at all
supports where spans are 48 ~nches or greater.
Four-foot-by-9-foot or 4-foot-bB~-g-foot panels shall be applied
vertically.
Spacing of fasteners not included in this table shall be based on
Table RR602.3(1).
For regions having basic wind speed of 110 mph or greater, 8d deformed
nails shall be used for attaching plywood and wood structural panel
roof sheathing to framing within minimum 48-inch distance from gable
end walls, if mean roof height is more than 25 feet, up to 35 feet
maximum.
g. For regions having basic wind speed of 100 mph or less, nails far
attaching wood structural panel roof sheathing to gable end wall
framing shall be spaced 6 inches on center When basic wind speed is
greater than 80 mph, nails for attaching panel roof sheathing to
intermediate supports shall be spaced 6 inches on center for minimum

INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of tiffs application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Building Zone Ordinance of the Town of Southold, Suffolk County, New York, and other applicable Laws, Ordinances or
Regulations, for the construction of buildings, additions, or alterations or for removal or demolition as herein described. The

authorized inspectors on premises and in building for necessary inspections.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and Town Code Chapter
280 (Zoning), Town of Southold, the following public hearing will be held by the SOUTHOLD TOWN
ZONING BOARD OF APPEALS at the Town Hall, 53095 Main Road, P.O. Box 1179, Southold, New York
11971-0959, on THURSDAY~ JUNE 25, 2009:
1:00 P.M. MICHAEL CONWAY # 6287. Request for a Variance under Section 280-124, based on
the Building Inspector's November 6, 2008 Notice of Disapproval concerning a proposed
addition with alteration to the existing single-family dwelling on a nonconforming 21,000+/-
square foot lot, for the reason that the new construction will be less than the code-required
minimum side yard of 15 feet, at 2950 Rocky Point Road, East Marion; CTM 31-2-1.
The Board of Appeals will hear all persons, or their representatives, desiring to be heard at each
hearing, and/or desiring to submit written statements before the conclusion of each hearing. Each
hearing will not start earlier than designated above. Files are available for review during regular

Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of the Times Review newspaper.

number and a copy of your Survey or Site Plan (filed with this application) which shows the
new construction area or other request, by CERTIFIED MAIL, RETURN RECEIPT
REQUESTED, to all owners of property (tax map with property numbers enclosed), vacant or
improved, which abuts and any property which is across from any public or ~)rivate street.
Use the current owner name and addresses shown on the assessment rolls maintained by the
Town Assessors' Office located at Southold Town Hall, or Real Property Office at the County
Center, Riverhead. If you know of another address for a neighbor, you may want to send the
notice to that address as well. If any letter is returned to you undeliverable, you are requested
to make other attempts to obtain a mailinq address or to deliver the letter to the current owner,
to the best of your ability, and to confirm how arranqements were made in either a wdtten
statement, or durin.q the hearing, providin.q the returned letter to us as soon as possible;
AND not later th~n June 15~'f~: Pleas~ either mail Or deliver to our office your Affidavit of
Mailing (form enclosed) with parcel numbers, names and addresses noted and furnish to
