WITNESSETH, that the Grantor, the Referee appointed in an
action between THE BANK OF NEW YORK SUCCESSOR IN INTEREST TO THE
BANK OF NEW YORK, plaintiff

DONALD J. CLAUSE, ALDO D. GIRASOLA, JOHN D. CLAUSE, DR. CARL
DOSSIANO AND WILLIAM B. MOORE, defendants
foreclosing a mortgage recorded on the 14th day of August, 1989,
in the Office of the Clerk of the County of Suffolk in Liber
15339, page 93, and mortgage recorded on the 8th day of November,
1989, in the Office of the Clerk of the County of Suffolk in
Liber 15549, page 333, as consolidated by Agreement recorded on
the 8th day of November, 1989 in Liber 15549, page 337, as
further extended by Consolidation, Extension and Spreader
Agreement recorded on the 29th day of May, 1990 in Liber 16026,
page 01 in pursuance of a Judgment entered at a special term, of
the Supreme Court of the State of New York, County of Suffolk on
the 21st day of July, 1993, and in consideration of FIFTY
THOUSAND AND N0/100 ($50,000.00) DOLLARS paid by the Grantee,
being the highest sum bid at the sale under said judgment does
hereby grant and convey unto the Grantee, all the right, , title
and interest of the defendants in and to8ALL that certain plot,
piece or parcel of land, situate, lying and being at Mattituck,
Town of Southold, County of Suffolk and State of New York being
more particularly bounded and described as follows:
BEGINNING at the corner formed by the intersection of the
northerly side of Main Road with the Easterly side of Love Lane;
THENCE North 31 degrees, 19 minutes, 20 seconds West along the
Easterly side of Love Lane 72. 11 feet to a point;
THENCE through other land of M. A. Kelsey Properties Inc. the
following three courses and distances:
1 ) North 58 degrees, 40 minutes, 40 seconds East 55.30 feet;

2) North 17 degrees, 51 minutes, 30 seconds West 5. 70 feet;
3) North 63 degrees, 02 minutes, 20 seconds East 73.05 feet to
land of V. Stype;
THENCE along land of V. Stype, South 21 degrees, 28 minutes, 20

THENCE along said northerly side of Main Road, South 75 degrees,
PCO2 42 minutes, 40 seconds West 116.33 feet to the point or place of

SUBJECT to any state of facts an accurate survey and/or a
personal inspection may show; to all covenants, restrictions,
easements, agreements and reservations, if any, of record,
insofar as the foregoing may be in force and effect and to
possible lettings and tenancies, if any, not cut off in this
action; and to possible equities of redemption, if any, and to
the Zoning and Buuilding Ordinances and Restrictions of the
Municipalities in which said premises are situated and to any
violations of state or municipal departments, to unpaid town and
village real estate taxes, assessments and water charges, if any.
TO HAVE AND TO HOLD the premises herein granted unto the Grantee
its successors and assigns forever,

used herein shall include the plural and all genders.
