PROPERTY LOCATION: 2635 Hobart Road (and Old Shipyard Lane), Southold CTM 1000-64-5-31
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and
determines that this review falls under the Type II category of the State's List of Actions, without fudher steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County
Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued a reply stating that this
application is considered a matter for local determination as there appears to be no significant county-wide or inter-community
impact.
PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 5663 sq ft lot with two front yards in the
residential R-40 District. It measures is 55 ft. wide (along Hobart Road) by 100 deep (along Old Ship Yard Road) and is
improved with a single family dwelling and frame shed, as shown on the site survey by Frank Notaro, RA dated 7/1/2009.
BASIS OF APPLICATION: Requests for Variances, based on an application for a building permit and the Building inspector's
December 2, 2008 Notice of Disapproval concerning new additions and alterations to the existing single-family dwelling.
Variances are requested: (1) under Section 280-122 and Code Interpretation under ZBA # 5039 (Walz Application), and for the
reason that construction is proposed with an increase in the degree of nonconformance with regard to existing nonconforming
single side yard, and each front yard, and (2) under Section 280-124 for additions at less than 10 feet on a minimum single
side yard setback, at lesslhan 35 feet from the front lot lines along Hobart Road, and at less than 35 feet from the front lot line
along Old Shipyard Lane.
RELIEF REQUESTED: The applicant proposes adding a single-story addition along the rear of his house (southwest elevation)
measuring 10 ft. deep x 26.6 ft. wide, removing and replacing per code the existing enclosed front porch facing Hobart Road
and adding two 7 ft. deep by 2.1 ft. wide additions (northeast elevation). These additions and alterations to the existing dwelling
on this properly with two front yards will maintain the pre-existing non-conforming front yard setback of 18.5 ft on Old Ship Yard
Road and front yard setback of 25.8 ft. from Hobart Road where the code requires a minimum front yard setback of 35 fi, and
maintaining the preexisting non-conforming side yard setback of 9.8 ft. where the requires a minimum side yard setback of 10
feet.
FINDINGS OF FACT
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the
Board makes the following findings:
1. Town Law §267-b(3)(b)(3)(1). Grant of the variances as applied for will not produce an undesirable change in the character
of the neighborhood or a detriment to nearby properties. The proposed additions and alterations will improves the conformity to
code and the appearance and functionality of the existing house. It will be no larger than many other relatively modest homes
on the neighborhood,

2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other lhan ama vadancos because the house, which sits on a comer lot, has two pre-exisltng non-
conforming front yard setbacks and a pre-existing non-conforming side yard setback. Therefore any additk)n will require a
variance.
3. Town Law §267-b(3)(b)(3). The vadances granted herein are not substantial insofar as they maintain all pre-existing non-
conforming setbacks.
4. Town Law §267-b(3)(b)(5). The difficulty has not been seE-oreatad but is the result of the pre-existing non-conformities of
the existing dwelling.
5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a vadance in this residential community will
have an adverse impact on the physical or environmental conditions in the neighborhood. The subject properly is in a flood
zone, like other propedJes in the neighborhood, and all additions and alti~rations will be built to codes including on site drainage.
6. Town Law §267-b. Grant of the requested relief is the minimum ac~on necessary and to enable tbe applicant to enjoy the
benefit of a larger mom code conforming dwelling while preserving and protecting the character of the neighborhood and the
health, safety and welfare of the community.
RESOLUTION OF THE BOARB: In considerng all of the above factom and applying the belandng test under New York Town
Law 267-B, mo'don was offered by Member Weisman, seconded by Chairman C-nehdnger, and duly carried, to
GRANT the variances as applied for, as shown on the architectural site survey dated 7/1/2009, and Drawings dated 3-
3-09 labeled sheets numbered: A-1.E, A-1 and A-4, all prepared by Frank Notam, subject to the following Conditions:
1. The dwelling shall be fitted with gutters and leaders as per code
2. An on-site drywell shall be installed to contained roof mr,off on site as per code
That the above conditions be written into the Building Inspactor's CerlJflcate of Occupancy, when issued.
Any deviation from the variance given such as extensions, or demolitions which am not shown on the applicant's diagrams or
survey site maps, are not at,'b']orizad under this application when involving nonconformiltes under the zoning code. This action
does not autho~ze or condone any cunent or future use, setback or other feature of the subject property that may violate the
Zoning Code, other than such uses, setbacks and other features as am expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase
the degree of nonconformity.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or

c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit

e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
ssues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
