June 30, 2009 Southold Town Board Meeting Minutes Page 4 Special Presentation Supervisor Scott A. Russell Before we get to the items on the agenda, I am going to, with a great deal of pride w~uld like to present a proclamation to someone who has decided to retire after many, many, many years of service to Southold Town. Jack Sherwood. Anyone who has been around here for any length of time knows Jack. He is, any values, any qualities I had as an assessor I learned from Jack. He has absolutely been a mentor to me, the rest of the Board of Assessors. He was an institutional wealth of knowledge. He is going to be sorely missed. You cannot find anybody with the type and to the extent of knowledge Jack has for this community and his deep commitment to his community, his family, his church. I can't say enough about you Jack. I got married about 10 years ago, irony of irony, Jack and his wife Edie probably danced more than anybody there that night, if you all remember. I have very fond memories of it myself. Hold on, I am going to come down and read the proclamation. Whereas a most devoted public servant of the Town of Southold is leaving the Assessors Office and will now spend his retirement years in tree peace and tranquility; and Whereas Jack Sherwood's co-workers will fondly remember his stories of military service and his first-hand account of the Iwo Jima battle. The Assessors Office just won't be the same without his pleas for milk with chocolate cake, the traditional bagel Wednesday's and his favorite lunch order: "bowl and a roll"; and Whereas Jack has given generously of his time and talent and has provided faithful service to the residents and employees of the Town of Southold since 1976. Besides his duties as a mapping consultant, the historical knowledge he so enthusiastically shared with everyone has been invaluable, and Southold's own "Natural Resource" will be sorely missed; now, therefore be it Resolved that the Town Board of the Town of Southold hereby expresses its sincere appreciation to Jack Sherwood, a true gentleman, a man of faith and a genuine good guy, for his dedicated efforts on behalf of Southold Town and extends their best wishes for health and happiness in the years ahead; and be it further Resolved that a copy of this resolution be presented to Jack Sherwood and entered into the permanent records of this Town Board meeting. I honestly am going, I told you when my son was born if my son grows up to be half the man you are, I will be a very proud dad indeed and I mean every word of that. I mean, I am a lost cause but we have hope for my son. There is also with that, the sadness in Jack's retiring, we also have, I would like to ask everyone to please stand for a moment of silence in the passing of Ruth Oliva, former Town Councilwoman and a member of the Zoning Board of Appeals and all around active part of this government. Thank you very much. What I would like to do at this point is ask anybody that has any issue they would like to address as it appears on this agenda, please feel free to come forward and speak now. Opening Statements Karen Rivara, SC Aquaculture Corem KAREN RIVARA: Hi, my name is Karen Rivara, I am a shellfish farmer in Southold Town. Also a member of the Suffolk County Aquaculture Leasing program advisory committee and I just want to thank you all for spending time with Tom Isles and DeWitt Davies today to take June 30, 2009 Southold Town Board Meeting Minutes Page 5 another look at the program. It is important for the Town, for all of us who work on the water and try to keep the traditional fisheries alive. So, thank you for hopefully for your support. SUPERVISOR RUSSELL: Thank you. Would anybody else like-to come up and address the" Town Board? Tom Skabry, Pres CSEA TOM SKABRY: How are you doing? Betty, is this working? TOWN CLERK NEVILLE: It should be. MR. SKABRY: I noticed that other microphone wasn't. TOWN CLERK NEVILLE: Well, that is because somebody pulled it in front, rather than to the side. It is working though. MR. SKABRY: Sure. Just a couple of comments, just looking quickly through the resolutions tonight, first of all, Tom Skabry, CSEA. I notice we have a couple of resolutions, 486, 487 and 551. It appears that these all deal with Fishers Island Ferry District employees, it looks like they are going to be giving these individuals some increases. I realize that some Board over there must be approving them, but I just seem to remember reading in the local paper that that district is approximately $600,000 or some odd short and I just hope that this Town Board takes that into consideration when they deal that, when it comes up for resolution. That's, just wanted to make comment on that. And resolution 534, this deals with an installation of the concrete pad for the bagging program. On this issue, I just hope that Martin, I see that it has to be done by your approval, will you please be sure that the proper wage scales will be abided by? SUPERVISOR RUSSELL: We, I envision that being defeated this evening. That particular resolution. MR. SKABRY: Alright. Thank you. SUPERVISOR RUSSELL: I don't think there is support for it. On the issue of Fishers Island, let me explain for everyone that Fishers Island Ferry District is a municipal corporation. They operate their own ferry district and all fees, salaries, cost of operation are borne by the riders on that ferry and the Fishers Island special district tax. Any of the raises you see in this agenda are raises that are meted out by the Fishers Island Ferry commissioners to their workers. Their fiscal year starts July 1st, unlike ours. So this is the raises in anticipation of their current fiscal year. They have it appropriated and budgeted in their accounting for it. It is not any money from the Town. The reason we vote on this, in other words, we vote on resolutions they already passed is because as a municipal corporation, they operate under the full faith and credit of the Town, so that they can go out and get bonding and things like that. The Supervisor didn't indicate that a group of us from the Town Board and the Supervisor's office and the Comptroller and the Town Attorney visited with the Commissioners of the Fishers Island Ferry District last June 30, 2009 Page 8 Southold Town Board Meeting Minutes week and while it is true that the Ferry Commissioners have the sole discretion of how they operate the district, how they set the salaries, we had quite a discussion with them about our feelings on the rates of increase and how they are determined and they listened to us and whether in the end that-turns out to be something well taken or not, some 0fthe other resolutions that are going to come up that deal with individual people, we did leam, at least I learned, something very interesting. Some of the people only work two days a month, some might only work two days per summer and that is why there are so many people, because they need coverage for all the shifts and all the boats that they run and taking that into consideration, the increase, the cost of living increase that they had proposed was put in a different perspective. So I will make .... JUSTICE EVANS: You are putting the resolution forth as rejecting the bid? COUNCILMAN KRUPSKI: Rejecting the bid. That is fight. Comments regarding resolution # 573 COUNCILMAN KRUPSKI: I am going to ask the Board to hold this resolution if we could because this is not a creek that the County has dredged in the recent past and my concern and I have been thinking about this since the work session, my concern is if we authorize the County to dredge this and then there is a shortfall in County dredging, that I don't think that this is one of the priority creeks that we would want kept open and if this were one of the ones that the County did and not another one that would be more important, I think would be an unfortunate set of circumstances. So I would like to hold it and talk to either the Dredging Advisory Commission or the Trustees or both. And or the County, Department of Public Works and see exactly what their intentions are. SUPERVISOR RUSSELL: I just hope that it wouldn't interfere with the windows. I don't know what the time frame is. COUNCILMAN KRUPSKI: The normal window wouldn't start until September. Dolly Snyder7 Dolly Schneider DOROTHY SNYDER: My name is Dorothy Snyder and I am the owner of a 56 acre parcel. If you don't mind, now that I have given my name, I would like to read this and then if there is any questions or whatever, feel free to ask them. As I stated, my name is Dorothy Snyder and I am the owner of a 56 acre parcel of property, located on North Road, Albertson Road, Colony Road and Bayview, one facing the sound and one facing Arshamomaque creek. When I first purchased the property, I went in for a change of zone for a subdivision. The Board refused my application, saying it was because they had no water. When I asked when it would become available, they said they had no idea. I was told to withdraw my application, which I did. This cost me much money to prepare. I also got letters from DEC and consultants etc. pertaining to wetlands, of which they stated in their opinion, the property had no wetlands. I then became instrumental with Suffolk County Water Authority buying out Greenport Water Authority. As a result of this, projects including Peconic Landing were able to be built. Then came the moratorium and a new Supervisor, Scott Russell. I have put in over several years of hard work to pursue my project. I feel strongly about this because the project would bring jobs, people would spend money, including downtown, where there are so many empty stores and most important, almost a million dollars a year would be gained in taxes from the project. As I went along with this with my architect, who unfortunately is not able to be here this evening, changes were made to cluster the buildings, put in a beautiful clubhouse and reorganize the layout as suggested. There would also be someone on the premises at all hours to drive the people into town to spend money, visit doctors, etc. which would help the economy and keep very satisfied renters. By bringing in the extra revenue from this property every year, we wouldn't have to lay off people including police officers who cover from Orient Point to Mattituck. This is not only creating heartache for people who have been laid off in these hard times but also causing people June 30, 2009 Southold Town Board Meeting Minutes Page 32 to leave our beautiful island. I would like the Board to take my application, and have time to explain my intentions to the people, so that a fair judgment of my property could be made. I thank the Board and all who have listened. I once again ask for your consideration to rezone my property. Thank you. Wh~t I mean by this is, I did pht in an application and I did all the necessary things including getting aerial maps paid for by Nelson, Pope and Voorhees, I already had the girls type in the necessary radius people, which was only waiting for a date from the Board. I was told pick up your check and take back your application. Now, unfortunately this is not fair because not only the Board's should decide what the people of Southold should have. This is a very, very good project; would bring much money. You wouldn't have to worry about laying people off. At this time especially, it is almost criminal. All the while I have been in the position where thank god financially I have been able to do this without having to go to banks for money. I worked very hard all my life and this is a dream that could become a reality which more important, gives you money. Thank you. COUNCILMAN WICKHAM: Excuse me, could you give the Town Clerk a copy, please? SUPERVISOR RUSSELL: Would anybody else like to come up and address the Town Board on any other issue of mutual interest? Melanie Norden, Greenport MELANIE NORDEN: Melanie Norden, Greenport. A point of clarification, resolution 580. What is the substance of the memorandum of understanding that you arrived at? SUPERVISOR RUSSELL: Is that public .... TOWN ATTORNEY FINNEGAN: It is... SUPERVISOR RUSSELL: I know what it is. I mean, is that... MS. NORDEN: I mean, isn't all of the information regarding how our tax dollars are spent public information? TOWN ATTORNEY FINNEGAN: It is not regarding tax dollars. MS. NORDEN: Excuse me, I can't hear you. TOWN ATTORNEY FINNEGAN: It has to do with just correcting what was an anomaly in .... MS. NORDEN: But I am asking what is the substance of the anomaly? SUPERVISOR RUSSELL: You know what? As a matter of record, there is a gentleman that retired who under current contract would require 10 years of active service and participation in a medical plan to retire and qualify for medical coverage. He had actually opted out of our plan, he had good medical coverage for a couple of years and decided he didn't need to burden the Town with the cost of the medical coverage. The problem is, now that counts against him because although he has worked for the Town for more than 10 years, he didn't have the full 10 June 30, 2009 Page 33 Southold Town Board Meeting Minutes years needed investing in the medical plan. The Town agreed by memorandum of understanding with the union that we don't want to punish someone for trying to save the Town money and that we would credit him with the two years of participation in the medical plan. That was the agreement wiih the union. " MS. NORDEN: Okay. It would be helpful in some of these resolutions if we had a little more clarification going forward. It is very vague. You can read this as a decision that might have been made across the board for every retiree. So it is just very difficult when you are looking at the resolutions to understand what the substance is. With respect to resolution 576, what are the special event regulations that were waived in the cases of both of these events? SUPERVISOR RUSSELL: The special events regulations which would require costs, permits and the like. There was a problem with the wording with the legislation itself in that our intent for public property was town owned property or private property not municipal corporation property. In these two specific cases, these are governed by a fire district and a park district. They have their own sets of rules and regulations, their own insurance requirements, their own everything. It was not our intent to try to expand our sphere of influence over the park districts and the fire departments. They have their own commissioners who speak for the uses of their property. Unfortunately with the wording it would look like on a quick read that these people needed to come to us for a special permit as well. They don't, they just need to go to their park district or their fire commissioners. MS. NORDEN: Okay. So basically you are really tracking in the special event legislation about activities that take place on Town of Southold properties only? SUPERVISOR RUSSELL: Town of Southold property or private property, private businesses, things of that like. But we don't really have the right to regulate the use, you know, park district property isn't really public property it is held for the benefit of a small group of people so, that was simply a glitch in our wording. MS. NORDEN: Right. COUNCILMAN ORLANDO: And it was really targeted for for-profit organizations, charitable ones we didn't really target the whole legislation. MS. NORDEN: Yeah, well that was part of my objection because I really think that charitable organizations can afford to pay some money to the Town to host events because events generate lots of dollars. But anyway, I raised those issues the last time around. I am just concerned though that if we, does that mean then that the fire departments and the special park districts don't require any town services to actually host these events? They don't require police or anything else? Because if they do, in point of fact there should be some money kicked in to underwrite those services that taxpayers are paying for. SUPERVISOR RUSSELL: They, there is a modest amount of use the policing. That is at the discretion of the police department. There are no road closures or anything of that nature. Also, June 30, 2009 Southold Town Board Meeting Minutes Page 34 you know those fire districts and those park districts, the residents of those districts are taxpayers in this town as well. They are entitled to a certain amount of policing services and the like. MS. NORDEN: Righff Okay. So these are actually large events that do require quite a bit of regulation with respect to parking and lots of other things. I am just saying that we should consider if we don't want to regulate what events take place on fire department property or on parks department property, that we should nevertheless recognize the fact that they are going to be using up resources that we as a, town-wide pay for. And that we should have some reimbursement established so that we will not be out of pocket for either of these entities or entities going forward. So we could think a little bit about that and in this tight economy. Thank you. SUPERVISOR RUSSELL: Thank you. Would anybody else like to address....? Don Sayre, Southold DON SAYRE: My name is Don Sayre, from Southold. I was here at a meeting a couple of weeks ago when you mentioned that you were going to terminate or layoff people. And at that time, somebody had asked the question how much is health insurance costing the town and you had mentioned it was $20,000 per family to the town and you know, I don't know what broker you have or anything like that, I don't know who looks at your plan or how often but you can buy insurance for a lot less than that. A decent plan from a reputable company could cost anywhere from $15,000 to $17,000. That is a cost savings right there. And I don't know, is the town looking into any .... SUPERVISOR RUSSELL: We are actually self-insured and we have a plan administrator, that administers our account each year. You have to remember that the medical plan is also tied to a benefits package that you need to negotiate with the prospective unions, so a lot of the medical plans that are out there that could save us money would mean a drastic cut in quality of the coverage. That is the balancing act. MR. SAYRE: I don't agree with that. SUPERVISOR RUSSELL: Okay. MR. SAYRE: Not all town employees are with the union and I really think there could be a cost savings if you look into this. Are all elected officials entitled to health insurance? Medical insurance? The Trustees... SUPERVISOR RUSSELL: Yes. MR. SAYRE: Everybody. SUPERVISOR RUSSELL: Yes. MR. SAYRE: So their salary could be lower than the cost of the insurance that they are getting. The benefit. June 30, 2009 Southold Town Board Meeting Minutes Page 35 SUPERVISOR RUSSELL: Yes. MR. STkYRE: Everybody thinks that that is fair? SUPERVISOR RUSSELL: Yes. COUNCILMAN WICKHAM: I do. MR. SAYRE: I think that they could forgo their salary and take the insurance. SUPERVISOR RUSSELL: You know, I think that that's, I have worked along with these town boards, democrats and republicans, I don't think that people have an appreciation for how many hours of service these board members put in. Everybody knows by job is full time. I think they need to know that the Town Board members put in inordinate amounts of hours, night, weekends, days. They really do. Also, if you are going to start looking at reducing the type of reimbursement they are going to get, you have to start wondering what quality candidates you are going to have down the road. It is a fundamental issue. What we are doing as a Town Board is in the very near future, we are sitting down with management and we are requiring ourselves and management to all pay 5% of our medical coverage. Five percent out of pocket from each of us. All the elected officials and all of the management, anybody that is full time that is not covered by a union contract. Five percent. You know, I think to just be strident and say do away with it, I don't think that is fair either. I mean, these people work more than full time. Even the ones I don't agree with work more than full time. MR. SAYRE: Yeah but I don't know. I don't really agree with that. I don't, quite frankly, I don't agree that the council people get it. I don't think that they should be entitled to it. They get a salary, I don't know what the salary is now because what is posted on the website is 2008 numbers. It has gone up, I am assuming for 2009. SUPERVISOR RUSSELL: No, we didn't. The Town Board hasn't taken a raise in two years. MR. SAYRE: Okay. Well, that is good. SUPERVISOR RUSSELL: And as a point of fact, I haven't taken one in four. MR. SAYRE: But keeping the insurance, I don't think it should be. And I don't think that, if you are saying that these people put in this much time and their salary is in excess of $30,000 a year, I think? SUPERVISOR RUSSELL: Yes. Probably. MR. SAYRE: Trustee's are probably half that, so they are probably putting in half the time that these people are and that is, that is just not fair. It is not right. I don't think that the taxpayers should be, should have to put up with the burden of giving these people health insurance. In June 30, 2009 Southold Town Board Meeting Minutes Page 36 regard to cost sharing, I do applaud you there; that is a good thing. And that is for management and the council people and .... SUPERVISOR RUSSELL: Elected officials. MR. SAYRE: Okay. There is no more buyout? If somebody doesn't take insurance, you can't .... SUPERVISOR RUSSELL: Yes. MR. SAYRE: There is no more buyout on that? SUPERVISOR RUSSELL: No, we offer a buyout if you are buying out of the town's insurance coverage. We had a glitch in the past where if you had a husband and a wife working both for the town, there was also a policy that allowed one of them to buyout while they were still covered under the spouse's plan. That was never the intent of the buyout. We did away with that. But you can still buyout if you are going to move out to insurance, if you are a Trustee who happens to be a teacher and you have better coverage, we offer buyouts. That saves the taxpayers substantial amounts of money. MR. SAYRE: Well, they could forgo the buyout, too. I don't agree with the buyout either. I don't... SUPERVISOR RUSSELL: How about for employees though? MR. SAYRE: Excuse me? SUPERVISOR RUSSELL: How about for employees? MR. SAYRE: No, I don't think it should be. You know, you are offering a benefit to an employee. They either take it or they leave it. SUPERVISOR RUSSELL: Yeah. That is a fair point. A very fair point. MR. SAYRE: And as far as this ten year, this ten year giveaway program that we have here, this retirement, because you work for the town 10 years or more you are entitled to take the insurance with you .... SUPERVISOR RUSSELL: Yeah. MR. SAYRE: That is a horrendous cost. Horrendous. SUPERVISOR RUSSELL: I think this Board agrees with you 100 % on that. That is contract language that has been there long before, that predates all of this Board. This entire Town Board. In terms of how that got into the contract. But I agree. Also, you get 10 years here and June 30, 2009 Southold Town Board Meeting Minutes Page 37 have to be of a retirement age to qualify. In other words, if you put 10 years in and you are my age, 45, and you go, like if I went; it is likely, I don't get to go with medical coverage because I am not old enough. You would still have to be the retirement age. MR. SAYRE: I don't know. I really think you have to rethink that. SUPERVISOR RUSSELL: I agree. MR. SAYRE: When you renegotiate with your unions, you really have to bring that point across. We can't afford this. And even in the good times it shouldn't happen. Right now we are going through some economic times that are really pressing but a lot of this stuff really should be addressed and you really have to cut the costs. And this is only one line on your budget, health insurance. What about all the other lines? You know, you really have to scrutinize every line of your budget. With that said, that is enough. SUPERVISOR RUSSELL: Thank you very much. Lori Salmon, Southold LORI SALMON: Loft Salmon, Southold. I don't want to beat a dead horse, but it did bring something to mind. When we polled the Board two weeks ago about insurance benefits, who took it and who didn't, Mr. Ruland said that he didn't. Do you take the buyout or are you also .... COUNCILMAN RULAND: I did in 2008. MS. SALMON: You are not taking it this year? COUNCILMAN RULAND: No. MS. SALMON: I applaud you. Melanie Norden MS. NORDEN: Just for the record, I thoroughly disagree with the last speaker. I do believe that if people are public servants, they really should have the benefits that have accrued to that. Particularly at a 10 year basis. I mean, it makes virtually no sense to work your life away in Town Hall, find yourself retired with no medical benefits with no money to pay for those benefits. That is really not what we want to do. that is not what we are encouraging in terms of town government. I believe that everybody that is an elected official should have these benefits, I think that everybody does work, I agree with you even though I do disagree with some people, I do think everybody works extremely hard. I don't think that is where we need to save the money and I do know that the Board has really scrutinized the medical plan. We could look at that again. I know that we took a big hit last year with the self-insurance, I don't really know if going forward that is going to still take place. But I believe that there are probably many other ways to save money but I wouldn't save it on the back of the people who work for the town or on the back of the elected officials. I mean, you really, the people that work for the town board earn every dime that they are willing to put in to this. Which can sometimes be rather frustrating. So I think you are definitely entitled to whatever benefits that the town can afford but certainly I June 30, 2009 Southold Town Board Meeting Minutes Page 38 wouldn't try cutting your benefits to ease up on some budget problems. COUNCILMAN KRUPSKI: Thank you. We appreciate that support. We, a lot happens here that no one sees and when everything works well nobody comes. This ~,hole meeting hall is empty every two weeks and nobody sees what really goes on to make everything happen in this town and the Town Board works hard, the Trustees work hard. All the elected officials. The Highway Superintendent, the Assessors, certainly the Town Clerk and the Supervisor, so, and when it works smoothly, you know, you don't hear from anyone. So thank you. Benja Schwartz, Cutchogue BENJA SCHWARTZ: I wouldn't say the whole meeting hall, there are a couple of seats like Melanie. I have been here before, even when things are going smoothly. Benja Schwartz from Cutchogue. Three things, two from the work session this morning. The first one, garbage. There was some discussion about cutting back the pickup of garbage, the road side drop off. Southold Town does not pick up household garbage from houses but we have a road side drop off pickup program. Superintendent of Highways, Pete Harris said something, I don't know if I am getting this exactly right but I think he said that 90% of the garbage in those cans comes from houses and not from beaches or... SUPERVISOR RUSSELL: He is talking about the blue barrels or the town barrels that get put out, there are areas of the town that we maintain. Now it is split between Pete Harris and Jim McMahon under DPW, the blue barrels that you see at the road ends are generally emptied by Pete, the barrels that you see at the beaches are generally emptied by Jim. Those are put out for people that are using the beach or people that are using that park or people that are using Love Lane, where you might find them and what we are finding is that people are just using them as a receptacle to through out that what they estimated at 80% of the garbage that comes in is just simply household garbage. MR. SCHWARTZ: And as you know, I live on one of those road ends... SUPERVISOR RUSSELL: That is right. MR. SCHWARTZ: And I have had second thoughts recently about the benefits of having a barrel, a beach shouldn't be a place for people to bring garbage to. People who bring, who have garbage on the beach, I think they can probably take it with them. Maybe we don't need the program, maybe we do but getting back to what you were discussing this morning, I had asked this morning how much that program costs the town. Pete Harris mentioned that the barrels cost $55 a piece. Then Jim McMahon told me that we hadn't bought any barrels in the past couple of years. So, you know, the overall cost you Scott Russell or Supervisor Russell mentioned maybe we should look into privatization of the pickup of those barrels but before we do something like that, I would like to know how much that program is costing the town. I am sure we could get an estimate for the cost of the entire program, the trucks, the gasoline, the labor, the cans whatever and if that could be broken down by location, then I think you would have something to look at that maybe you could decide whether or not you really need to consider privatization. SUPERVISOR RUSSELL: I don't think privatization is going to be an answer. I happen to June 30, 2009 Southold Town Board Meeting Minutes Page 39 agree, I had actually mentioned a few years ago that we should probably start getting rid of the barrels, certainly in the more remote locations which is what we have been doing. I had my head handed to me by the public who, the problem is as soon as you start a service, people say cut services, cut services to save money but there are peopl~ out there that don't view wh'at services ought to be cut and what shouldn't. I had received a lot of public criticism .... MR. SCHWARTZ: Do you have a problem with finding out how much the program costs? SUPERVISOR RUSSELL: No, I actually was just going to get to that in a second. I think your answer deserved a much broader answer than it got today and I will ask both gentlemen to calculate their costs, which is gas, fuel, employees etc. On the total cost of collection of garbage, the three times a week we are collecting it. It deserved a broader answer than the cost of the barrel. MR. SCHWARTZ: Maybe it was last year, maybe before that, there was discussion of choosing a new name for the dump. The Cutchogue dump. I mean, I still like, I know we are not using that anymore, there is a sign that says Southold Town transfer station, there is another sign that says Southold Town solid waste management something, I don't know, it sounds like a lot bm to me but anyway, I thought of a name, re, re, re, de. Sounds like an interesting place, re, re, re, de. Why re, re, re, de? Because we have reduce, reuse, recycle, and finally dispose. And at least I would like to see some signs at the dump to remind people of the priorities and those are environmental and economic and some explanation for people of what the difference is between reduction, reuse, recycling, why they are in that preferred order. I wrote a little poem about the landfill, as you may or may not remember, I have been trying to get someone appointed and I have even volunteered to do it myself to the unpaid position of recycling coordinator. I think you, believe you made some appointments before I got here today and you make appointments all the time but the position of recycling coordinate at the dump has been vacant for as long as I can remember. I think that might help. I remember when the new facility opened, the first time I drove in there the traffic pattern bothered me. It still bothers me. Very short poem. Below zero miles per gallon, not to mention the waste of time. Twist my neck, car and truck wreck. Nobody is talking about it. The traffic entering the transfer station crosses over the traffic exiting the transfer station going in the first driveway. Then as you exit the second driveway, you again cross over the incoming traffic. There is no need for that. The traffic going in could go in the second driveway, drop their things, go out the first driveway and there would be no intersection, no possibility of collision and maybe, but you would still need to turn your neck but I don't figure you would have to twist it quite as far. Might make the elderly people a little more comfortable going there. Very briefly, the Suffolk County Aqua cultural lease program was on the agenda this morning, they talked about 110,000 acres in the bays and how they eliminated areas on which there were conflicting uses, where there was eelgrass beds and eliminated the foreshore within 1,000 feet of the mean high water mark, ending up with approximately 3,000 acres that could be leased out by Suffolk County. Suffolk County doesn't lease that out by December of 2010, the law will expire and they will lose their right that they, their authority from New York State to do that. It was described as a drop in the bucket, small scale aquaculture program to grow oysters, clams and scallops, I am very much in support of this program. I think for the most part, they are talking about growing oysters. But I don't know if June 30, 2009 Southold Town Board Meeting Minutes Page 40 this Town Board made a resolution tonight or not to approve, to support that program but what I tried to tell you this morning and I don't believe I was heard, was I have two specific concerns about that program. Number one, very nice that we have, you know we are avoiding conflict of uses but I think we need some areas which we don't use, some mar/he reserves. They have been established all over the world, they have been extremely important in not just maintaining but and protecting and preserving but in recovering the health of marine estuaries and marine habitats such as the Peconic Estuary, which we have here. I think we need to create some marine reserves. After the work session this morning, I spoke with the representatives from the county, they said that for example the Kevin, the bay keeper program, it doesn't lease but they actually have some lands that were granted to them that might be available for a marine reserve. But I think that is very important that we should have some areas for the wildlife, for the marine wildlife. That is number one. Number two, the hard clams, the proposal for the aquaculture of the hard clams is not only to grow clams but also to bring clams from polluted areas. Polluted waters. To bring them here and let them drink our cleaner waters. I don't think we have any clean waters left but cleaner waters until they are safe to eat. My concern is what happens to the contamination and is there any chance of that contaminating our clean waters? COUNCILMAN ORLANDO: Well, that is a valid question, you know bringing in contaminated clams to purge themselves in our water, that is a valid question. COUNCILMAN KRUPSKI: Well, that is called a relay system. That has been going on for a long, long time. SUPERVISOR RUSSELL: And it goes on with our without the aqua cultural lease program. I mean, that goes on every day. COUNCILMAN KRUPSKI: Right. MR. SCHWARTZ: I understand that but I am just, you know, since this lease program that is going to be part of it, I think maybe it is an opportunity to examine that issue. Last thing, there was an article recently on Hamptons.com which I highly recommend the Hamptons.com local news section although it is south fork, it has some relevance to the north fork. There was an article there about the recent decision by the federal court on the 1997 law that East Hampton passed restricting high speed and vehicle ferries. East Hampton won the lawsuit, they won the right to restrict the ferries. Viking ferry company was suing them and lost the lawsuit, I would like to know why Southold Town hasn't passed any similar laws. Is, does Southold Town, is it maybe going to consider such a law now that we know that it has passed legal examination? And in addition to the ferry traffic, we have also got traffic coming from the west. I don't know how many people are aware, I don't think the Suffolk Times covered the fact that in September of 2009 Route 58 in Riverhead is scheduled to be intensified with a 5th lane, similar to what was done in Southampton on Route 39, the main road into the Hamptons. According to the supervisor, Linda Kabot, she said the 5th lane speeds up traffic and eliminates traffic jams but the road design is insufficient. There are no shoulders, fire hydrants and telephone poles are close to the curb. It is hard for pedestrians to cross, so we had to lower the speed limit to 35. I drive that road regularly as part of a job and nobody drives 35 on that road. But how does that affect us? June 30, 2009 Page 41 Southold Town Board Meeting Minutes Well, there was testimony at the trial by the planning consultant in East Hampton Lisa Liquori, she testified that the history of Long Island can almost be characterized as soon as you build more roads going further east, development accompanies them to the point where roads get congested almost as soon as they are opened~ passed the point of capacity. So, you know, that road tums into Route 25, two lanes, goes from now four lanes, now it is going to be going from five lanes to two lanes. How is that going to impact us? How is that going to impact downtown Riverhead? I for one believe that even though that is Riverhead, there is going to be an affect on Southold Town and if I had the authority I would do whatever I could to try and stop that. Building that new lane. Thank you for your consideration. COUNCILMAN KRUPSKI: One thing about the shellfish program that you mentioned. MR. SCHWARTZ: Yes. COUNCILMAN KRUPSKI: We had a long discussion today, a very good discussion with Suffolk County about it and they clarified a lot of things which is why we reversed our stand on the support for the aquaculture program. There are some aquaculture people in the room. I don't know if they want to address your concerns just to clarify it so that people will understand the issue. Karen Rivara KAREN RIVARA: Hi, Karen Rivara again. The one question about habitat and marine reserves. Part of the program does allow for leasing for groups such as the Nature Conservancy, who by the way also supports the program, so if they want to set aside an area for reserve they can do that for the purpose of preserving shellfish population. So they could set aside an area and plant it with shellfish. Most of the underwater land in the Peconic has been fanned in the past. It is rather like fallow farmland, so it is not untouched, virgin underwater lands and it is also, as with all the underwater land in the Peconic's is heavily impacted by watershed activities that affect the water quality, sedimentation for instance. As far as they relay program is concerned and this is, as you pointed out, has been going on for I believe 30 years now. the clams that come from Raritan Bay come from an area that has been tested by the DEC, the clams do not have heavy metals or any kind of organics in them that would pollute our waters or bring that kind of material here. They are simply animals that have too high of a bacteria count in them to make them acceptable for harvest and shipment direct to market. In other words, they are not fit for human consumption because of the bacteria level in the animals. The animals can purge themselves of the bacteria but when they do, they bind the bacteria in their feces and I hope I can say that word here, and so it goes into the sediment and is bound in with the sediment, so it is not being ejected from the clam and polluting the surrounding water by the rest or the relay area. So, and most of them, I think all of them now are actually relayed in cages, so anything that the clam might bring a disease that would affect clams and not humans, first of all they are tested to make sure they don't have that disease but second of all, the animals are entirely removed from our estuary when they are, after three weeks after they have cleansed. So I don't know if that answers your question. SUPERVISOR RUSSELL: Thank you. Benja, I will get back to one issue you mentioned with regard to the landfill. I actually, you were looking for a new name. I kind of like the name June 30, 2009 Page 42 Southold Town Board Meeting Minutes money pit but as a practical reality it is a good facility but we, the building that you mentioned before, that is part of our problem. We spent too much money redoing the building. And if the Town Board at the time, prior to our getting here, had just listened to the workers that work t'here, who had very good ide//s, we needed an investment down there, we needed to upgrade the facility. We didn't need a $4,000,000 solution. And that is certainly part of the problem. Past spending adds up. I am not a big fan of the facility either, I do like the fact that, you know recycling is a little easier now. I think we could have accomplished that for a lot less money when the decisions were being made years ago. COUNCILMAN WICKHAM: Well, the decisions that were made years ago where along the lines of what Benja Schwartz said. And that is that they were designed to promote maximum recycling. And the way we did it was to put in place a system that would provide free recycling to a resident and the only cost to a resident is to get rid of the stuff that couldn't be recycled. That was a tremendous, at the time, I think some other municipalities have done it but it was an innovation at the time to try to reduce our waste stream and it was very successful. Southold Town has one of the more successful reductions in the total amount of stuff that we have to ship out of town. Shipping out of town may not be the best long term solution but we needed a facility to do it. Some years ago the Town put a bond into place and we have now a facility that allows us now to do it efficiently. I don't share the Supervisor's view of that. Of course, it would be nice to look back and say I wish we could have done that cheaper. We can say that of a lot of town government today. I think that building, the structure and the system that we have in place does serve the needs of this town and the residents of this town and I think it does it in an environmentally appropriate way. Benja Schwartz MR. SCHWARTZ: Tom, if recycling, reuse and reduction is still a priority, then I don't see that being demonstrated by for one, the lack of a recycling coordinator or two, the oh, the set up there, although, no, I appreciate that there is the ability to recycle. But I think we have fallen backward in many regards and gone from being a leader in that area to being a laggard. COUNCILMAN WICKHAM: It is true. We don't talk so much about it now, we haven't done as much outreach or publicity and probably there is more that we could do in that direction. And perhaps, we did have a very effective recycling coordinator for years, and perhaps the time is appropriate for another one. SUPERVISOR RUSSELL: Let me just say, also by the way, I don't know if you know this but the landfill was Lord Byron's favorite subject for poetry as well. Melanie? Melanie Norden MS. NORDEN: Yeah, let me just say, I agree with you from an environmental standpoint but we have lost a lot of ground and we need to gain ground in terms of really generating income from our recyclables. And we are falling short, way short, there were lots of promises here about how the dump was going to pay for itself, how the new trammel screen this, how the, you know, none of that has really, we really need a task force to look at how many opportunities we are losing or on the other hand, how much revenue we could generate. There are many, many different schemes out there, we are falling way short of that. It is a money pit but the point is June 30, 2009 Page 43 Southold Town Board Meeting Minutes (inaudible) is going in than obviously you are attracting and that is going out. And we can do everything that is great environmentally but if it is at the cost of the taxpayer and at significant cost because we are not exploring opportunities to be competitive, to combine regionally; to look at the ways ~e need to. Now there were many promises that we would be doing that this year and all I can see is that we are just losing money. SUPERVISOR RUSSELL: Well, we... MS. NORDEN: And now we are talking about another .25 on yellow bags and I know the electorate is not going to be remotely happy with that initiative, so before we do that and before we think of all of the expenses that we have approved in the last year, now we also find that some of that stuffisn't going to work because the buildings aren't the right size or the foundation or whatever, I still recommend that we look at the revenue generating capabilities of the landfill, dump whatever you want to call it. Nomenclature has no significance. What has a significance is if it is a competitive institution, is a competitive department of the town or do we need to close the whole thing and ship everything out here? And I would love to hear from the Town Board, I mean, not today but at some point that we have established some committee or some task force to look at the ways in which we are losing money and not generating income. Because I think it is really significant and it is a major expenditure year after year after year. SUPERVISOR RUSSELL: I appreciate that. We actually are doing quite a bit, we talked about that at the work session today. We had a meeting with the solid waste coordinator just a few days ago. That has been an issue. We actually are exploring opportunities to increase our revenue. There are all sorts of issues to consider when you do that. Union contracts, all of those things come on the table. We have to consider everything. That is exactly what we are doing. With regard to recyclables, we have actually just cut a very nice deal with Islip in terms of the terms of our paper and our cardboard. So you know, we are out shopping that market every day. COUNCILMAN WICKHAM: I would just like to add, there is tremendous price volatility in the prices that you fetch for these things. Several years ago, there were very good prices for all kinds of waste products. Today you can hardly get rid of the stuff. It costs money to get rid of some of the things that we were actually being paid for before. These things go through cycles and now we are in a down turn. MS. NORDEN: Inaudible. I know there is quite a bit of money in (inaudible) and paper but (inaudible) really be looking innovatively, combining and working with the county, combining and working with other townships. And I just really recommend that, I am sure there are (inaudible) concerns but I haven't really heard of that kind of forward thinking coming out of that department. COUNCILMAN WICKHAM: We will look into that. SUPERVISOR RUSSELL: Would anybody else like to address the Town Board on any issue? Benja Schwartz MR. SCHWARTZ: If I may just very briefly add and reply to what was said about the marine June 30, 2009 Southold Town Board Meeting Minutes Page 44 preserves. While I am appreciate that the lease program does allow that to happen, it doesn't prevent that, it doesn't, it is not part of the program. There was discussion about maybe they should have separate lease programs from each of the five towns, maybe not but maybe each of the five towns should have a section of marine reserve. Not only, the fact that there has been activity in the bays and that the bottom of the bay is similar to a farm field that has been abandoned or fallow, is all the more reason to create a preserve. There have been preserves created in New Zealand where it took 25 years for the preserves to establish themselves with a natural balance of the marine organisms which not only supported the marine organisms within the preserve but generated a surplus that was then available to the fisherman and the lobstermen and all who have their pots on the edges of that reserve and they are catching mom and bigger lobsters then they ever did and there is a lot people who don't like the way the regulations are trying to control how many fish you can catch and well, you know, if we can just put aside some places for the fish and the clams and then you know, we can have our places where we can take them .... SUPERVISOR RUSSELL: We actually have already done that. Only we refer to them as spawner sanctuary's. And we have several mapped areas of Southold Town, of the bay, with the Trustee's and Mark Terry that are declared spawner sanctuaries, where you can't get a mooring permit, where you can't get a dock permit, where you can't get the types of intrusions that you are allowed in the other parts of the bay. We already have that, we are in the process now... MR. SCHWARTZ: I appreciated the efforts that have been made. I watch every day the marsh islands die and the creek where I live has been closed to shell fishing for the last five years all year along including 100 feet out from the mouth of the creek. Not that I ever ate the shellfish in the creek, I prefer the ones in the bay anyway since I was a kid 40 years ago. But it would be nice to know that there was some healthy, more healthy shellfish around and we didn't have to worry about it. SUPERVISOR RUSSELL: Just for everybody's sake, I have talked more about aquaculture in the past two weeks than I ever thought I would in my life. Would anybody else like to comment on any issue of mutual interest? COUNCILMAN WICKHAM: At the beginning of the meeting, the Supervisor mentioned the passing of Ruth Oliva, who was a long term public servant in the Town of Southold. Her family is planning a tribute to Ruth Oliva, one week from tomorrow. That is July 8th, at the Horton- Mathie Funeral Home in Greenport. It will be, tentatively scheduled from 3-5 and many of you out there who knew Ruth might want to be there. JUSTICE EVANS: It is not definite yet, so you should check with someone in Town Hall.
