DECLARATION made this md day of September, 1976, by

York, hereinafter called the "Owner";

vlHEREAS, the Owner has ti tle to certain lands situate

lying and being at Arshamomoque, in the Town of Southold, County
of Suffolk and State of New York, said lands hereinafter being
more particularly described; and

VlHEREAS, it is the Owner's intention that the aforesaid
lands be subdivided into a minor subdivision consisting of not
more than four residential lots;
NOH, THEREFORE, the following described lands shall be
restricted as hereinafter set forth:
BEGINNING at a point on the easterly side of Albertson's
Lane where the division line between preI:1ises herein described
and land of Joseph F. Barsczewski intersects the easterly
side of Albertson's Lane; running thence North 190 03' 40"
West along the easterly side of Albertson's Land 862.72 feet
to land of Milton Renick; thence along said last mentioned
land the following two (2) courses and distances:
(1) North
710 39' 00" East 213.09 feet; (2) North 720 07' 00" East 446.78
feet to other land of Milton Renick; thence along said land
the following three (3) courses and distances:
(1) South
290 51' 00" Eas t 172.57 feet; (2) South 150 36' 30" East
125.19 feet; (3) South 30 34' 30" East 291. 92 feet to land of
Anthony Corazzini; thence South 160 04' 00" East along said
last mentioned land 508.20 feet; thence North 870 13' 30" West
along said land of Joseph Barsczewski, Sr., and land of Joseph F.
Barsczewski 624.86 feet to the easterly side of Albertson's
Lane, the point or place of beginning.

DECLARANT does hereby warrant, covenant and represent
that on approval of the aforesaid described lands as a minor
subdivision by the Planning Board of the Town of Southold, no
further application will be made to that Board or to any other
Board in the Town of Southold to further subdivide any of the
lots set forth in said minor subdivision.
DECLARANT does hereby further warrant, covenant and
represent that the aforesaid described lands within the minor
subdivision cannot be subdivided into more than four lots and
that each such lot shall comprise an area of not less than
2.897 acres;
DECLARANT does hereby further warrant, covenant and
represent that the foregoing restrictions and agreements shall
bind the undersigned, his heirs, successors and assigns, and
any and all person or persons who shall succeed to the owner-
ship of any of the lots shown on said aforedescribed premises
in said minor subdivision by transfer or otherwise.
IN WITNESS 1~EREOF, the Declarant has caused his hand
and seal to be affixed this 2nd day of September, 1976.
