(631) 765-1809 Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF NOVEMBER 4, 2004 ZBA File 5594 - WILLIAM and SUZANNE CONNELL Property Location: 550 Krause Road, Mattituck; CTM 122-4-38. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review fails under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 25,700 sq. ft. parcel has frontage along Camp Mineola Road and Kraus Road and is improved with a single-family dwelling as shown on the May 7, 1974 amended survey prepared by Roderick VanTuyl, P.C. BASIS OF APPLICATION: Building Department's August 18, 2004 Notice of Disapproval, citing Section 100-244B, in its denial of a building permit to construct additions, with alterations, to the existing dwelling at less than 50 feet from the rear lot line, as shown on the plans dated 8/19/04 prepared by F. Uellendahl, Architect. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 21, 2004 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a second floor alteration and addition, after demolishing the existing breezeway and garage for additional living space and garage/storage areas with a setback at 15 feet from the westedy lot line as shown on Option A, architectural plans dated 8/19/04. APPLICANTS' REQUEST FOR OPTION B; ADDITIONAL INFORMATION: During the October 21, 2004 public hearing, the applicants discussed design options, and during the headng, the applicants offered a revised plan (referred as Option B, with highlighted changes in red), prepared by Penny Lumber, moving floor space for the family's living area above the garage addition, thereby reducing the overall footprint of the addition. REASONS FOR BOARD ACTION: On the basis of testimony presented materials submitted and personal inspections, the Board makes the following findings: ~age 2 - November 4, 2004 ZBA Ref. 5594 -W. and S. Connell CTM Id: 122-4-38 1. Grant of the vadance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicants' property does not contain a defined side yard under the zoning code definition because of its frontages and three front yards. The code requirements for front yard setbacks are standard at 40 feet and the construction meets or exceeds this minimum setback requirement. The remaining yard gives the appearances of a side yard, however, the code defines this westerly line as a rear lot line. The standard requirement for a rear setback is 50 feet, and a side yard minimum is standard at 15 feet, requested by the applicant in this westedy yard. The addition which is the subject of this vadance involves more living and storage space, which can only be located along the west side of the home due to the definition of yard areas and layout of the existing home. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's home is a cape cod style, and expansion is better achieved for expansion along the west side of the home, rather than expanding into the front areas of the home facing a traveled road. 3. The variance granted herein is substantial. The code requires a minimum of 50 feet from the rear yard line, and this westerly addition is a 35 ft. reduction, resulting in total side yards of 22+- feet. 4. The difficulty was self-created. Although the addition was designed with a plan that does not meet the setback requirement of the code, the difficulty is related to the need for space within the home by their family members. 5. No evidence has been submitted to suggest that a vadance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Member Tortora, and duly carried, to GRANT the vadance as applied for.
