Site Plan Approval for San Simeon by the Sound
Located on the south side of CR 48, approximately 700 feet east of Chapel Lane, in
Greenport
SCTM#1000-45-2-2 Zoning District: HD Zone
Dear Ms. DeMasi:
The Southold Town Planning Board, at a meeting held on Monday, September 22, 2008
adopted the following resolutions:
WHEREAS, the applicant, Priscilla DeMasi, submitted an amended site plan application
on May 14, 2008 for alterations to an existing nursing home facility to include change of
room lay-out in existing buildings and additions of stairs, a canopy, a generator, a
freezer and adding two new parking areas for an out-patient care area; and
WHEREAS, on June 30, 2008, the Planning Board accepted this application; and
WHEREAS, on July 2, 2008, the Planning Board, pursuant to Southold Town Code
§280-131 C., distributed the application to agencies for their comments, and the
following agencies responded: Town Engineer, Architectural Review Committee, LWRP
Coordinator; Suffolk County Planning Commission, Greenport Fire Commissioners; and
WHEREAS, the comments from those agencies referenced above were received and
accepted by the Planning Board, discussed with the applicant, and incorporated into the
site plan to the satisfaction of the Planning Board; and
WHEREAS, on September 22, 2008, the Southold Town Building Inspector reviewed
the plan and certified that the proposed use as an adult day care is a permitted use in
the Hamlet Density Zoning District; and

WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code §280-131 B
(5), has the discretion to waive some of or all of the parking requirements for those
applications where the change proposed will not have an effect on the public health, safety, or
general welfare. The Planning Board has found that the parking for this application may be
relaxed for the following reasons: the alterations proposed are not changing the size of the
building as the proposed is to alter the configuration of the interior, and the proposed project is
providing for sufficient additional parking to serve the new use of adult daycare; and
WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code §280-131H,
has the discretion to waive the public hearing requirement for applications involving
modification to existing structures with no substantial change to the existing footprint, and not
requiring significant changes to the existing site design features. The Planning Board has
found that the public hearing for this application may be waived for the following reasons: this
is an existing site that had previously been before the Board for a related site plan application
approved on December 23, 1996, the uses on site have not changed; it has been determined
that the overall proposal would not have an adverse effect on surrounding properties; and
WHEREAS, the Southold Town Planning Board, pursuant to §280-133 C. of the
Southold Town Code, has the discretion to waive any or all of the requirements in §280-
133 for those applications involving modifications to existing structures with no
substantial change to the existing footprint. The Planning Board has found that requiring
the entire set of site plan application requirements for this site is not necessary to further
the objectives set forth in Town Code §280-129 and maintain public health, safety, and
welfare for the following reasons: the application is for an amended site plan previously
approved by the Board, and the parcel has been used in the same configuration as
previously reviewed and approved; therefore, be it
RESOLVED, that the Southold Town Planning Board, pursuant to State Environmental
Quality Review (SEQR) (6 NYCRR, Part 617.5 (c) (3), has determined that the
proposed action is a Type II Action, and not subject to review under SEQR; and be it
further
RESOLVED, that the Southold Town Planning Board hereby waives the public hearing
requirement, and site plan application requirements, except for the following items:
§280-133 A. (1), (2), (3), (4), (5), B. (1)(a), (b), (c), (d), (e), (f), (g), (h), (j), (k), (3)
(a),(b),(c partial), (d), (4) (a),(b), (c), (e-partial),(f), (g-partial), (h), and (i); and be it

RESOLVED, that the Southold Town Planning Board has reviewed the proposed action
under the policies of the Town of Southold Local Waterfront Revitalization Program and
determined that the action is consistent as outlined in the September 15, 2008 memo

RESOLVED, that the Southold Town Planning Board grants approval, and authorizes
the Chairperson to endorse the site plan entitled "San Simeon by the Sound Inc."
prepared by Howard Young, Land Surveyor, dated August 21, 2008.
Please also note the following required by Town Code:
1. Any outdoor lighting shall be shielded so the light source is not visible from
adjacent properties and roadways. Lighting fixtures shall focus and direct the
light in such a manner as to contain the light and glare within property
boundaries.
2. All storm water run-off from grading, driveways and gravel areas must be
contained on site.
3. Approved site plans are valid for three years from the date of approval, within
which time all proposed work must be completed, unless the Planning Board
grants an extension.
4. Any changes from the approved site plan shall require Planning Board approval.
5. Prior to the issuance of a Certificate of Occupancy, the Planning Board must
inspect the site to ensure it is in conformity with the approved site plan, and issue
a final site inspection approval letter. Should the site be found not in
conformance with the approved site plan, no Certificate of Occupancy may be
issued unless the Planning Board approves the changes to the plan.
A copy of the approved site plan is enclosed for your records. One copy will also be
sent to the Building Department and the Town Engineer/Highway Department.

Failure to meet the 60-day deadline could result in this project being deemed

Pursuant to the provisions of 10 NYCRR Parts 86 and 710, you may not begin the
construction or operation of any aspect of this project, or receive reimbursement for costs
associated with this project, unless all required written approvals are obtained. Before
beginning any aspect of this project, you must complete the following steps:
submit written materials to satisfy the enclosed contingencies and receive written
approval from the Division of Health Facility Planning (DHFP) indicating the satisfaction of
all contingencies;
after receiving a letter from DHFP confirming that all contingencies have been met,
submit a written request to, and receive written approval from, the Bureau of Architectural
and Engineering Facility Planning to begin construction, and;
develop a plan to ensure the health and safety of all patients and staff during
construction. This plan must comply with all applicable sections of the National Fire
Prevention Association (NFPA) 101 Life Safety Code (1997 Edition) and all applicable
sections of the State Hospital Code during construction. The plan may require you to
separate residents, patients, staff and essential support services from the construction
site and/or provide them with an alternative means of egress. Please have the plan
available to regional office staff at the time of their on-site visit.
You are responsible for ensuring that this project complies with all applicable statutes,
codes, rules and regulations. Should violations be found when reviewing documents, or at
the time of on-site inspections or surveys, you will be required to correct them. Additional
costs incurred to address any violations will not be eligible for reimbursement without the
prior approval of the Department. Aisc, in accordance with 10 NYCRR section 710.5, any
change in the scope of this project requires prior approval from the Department and may
require a new or amended application.

The following list provides more detailed descriptions of the requirements in Section 4 of the Mechanical Compliance
Certificate.
Requirements Specific To: HVAC System I:
I. The specified heating and/or cooling equipment is covered by the 2007 New York Energy Conservation Construction Code and must
meet the following minimum efficiency: Packaged Terminal DX Unit: 11.0 EER
2. Each zone of a multiple-zone system must have its own temperature control device,
3. The specified cooling equipment is covered by Federal minimum efficiency requirements. New equipment of this type can be assumed to
meet or exceed 2007 New York Energy Conservation Construction Code requirements for equipment efficiency.
4. Hydronic heating and cooling coils must be equipped with a way to pressure test connections and measure and balance water flow and
pressure.
5. Systems serving multiple thermostatic control zones must be variable-flow systems Zone terminal controls must reduce the flow of
primary supply air before reheating, recooling, or mixing air streams.
6. The specified system includes both warm-air and cool-air ducts. Zone terminal devices must be installed that reduce the flow of air
through each duct to a minimum before mixing with air from the other duct,
7. Multiple-zone systems must include controls capable of resetting the supply air temperature by at least 25% of the difference between
the design supply air temperature and the design room temperature.'

4. Systems with multiple boilers have automatic controls ~apable of sequencing the operation of the boilers.

Generic Requirements: Must be met by all systems to which the requirement is applicable:
1. Design heating and cooling loads for the building must be determined using procedures in the ASHRAE Handbook of Fundamentals or
an approved equivalent calculation procedure,
2. All equipment and systems must be sized to be no greater than needed to meet calculated loads A single piece of equipment providing
both heating and cooling must satisfy this provision for one function with the capacity for the other function as small as possible, within
available equipment options.
Exception: The equipment and/or system capacity may be greater than calculated loads for standby purposes. Standby equipment
must be automatically controlled to be off when the primary equipment and/or system is operating.
Exception: Multiple units of the same equipment type whose combined capacities exceed the ca[culated load are allowed if they are
provided with controls to sequence operation of the units as the load increases or decreases,
3. Each heating or cooling system serving a single zone must have its own temperature control device
4. Each humidification system must have its own humidity control device,
5. Thermostats controlling both heating and cooling must be capable of maintaining a 5 degrees F deadband (a range of temperature
where no heating or cooling is provided).
Exception: Deadband capability is not required if the thermostat does not have automatic changeover capability between healing and
cooling.
6. Outdoor-air supply systems with design airflow rates >3,000 cfm of outdoor air and all exhaust systems must have dampers that are
automatically closed while the equipment is not operating.

7. The system must supply outside ventilation air as required by Chapter 4 of the Mechanical Code for New York State. tf the ventilation
system is designed to supply outdoor-air quantities exceeding minimum required levels, the system must be capable of reducing
outdoor-air flow to the minimum required levels.
8. Air ducts must be insulated to the following levels:a) Supply and return air ducts for conditioned air located in unconditioned spaces
(spaces neither heated nor cooled) must be insulated with a minimum of R*5. Unconditioned spaces include attics, crawl spaces,
unheated basements, and unheated garages.b) Supply and return air ducts and plenums must be insulated to a minimum of R-8 when
located outside the building.c) When ducts are located within exterior components (e.g., floors or roofs), minimum R-8 insulation is
required only between the duct and the building exterior.
Exception: Duct insulation is not required on ducts located within equipment.
Exception: Duct insulation is not required when the design temperature difference between the interior and exterior of the duct or
plenum does not exceed 15 degrees F.
9. All joints, longitudinal and transverse seams, and connections in duciwork must be securely sealed using weldments; mechanical
fasteners with seals, gaskets, or mastics; mesh and mastic sealing systems; or tapes. Tapes and mastics must be listed and labeled in
accordance with UL 181A or UL 181B.
Exception: Continuously welded and locking-type longitudinal joints and seams on ducts operating at static pressures less than 2
inches wg pressure classification.
10. Mechanical fasteners and seals, mastics, or gaskets must be used when connecting ducts to fans and other air distribution equipment,
including multiple*zone terminal units.
11. All pipes serving space-conditioning systems must be insulated as follows: Hot water piping for heating systems: 1 in. for pipes <=1
1/2-in. nominal diameter 2 in. for pipes >1 1/2-in. nominal diameter. Chilled water, refrigerant, and brine piping systems: 1 in. insulation
for pipes <=1 1/2-in. nominal diameter 1 1/2 in. insulation for pipes >1 1/2-in. nominal diameter. Steam piping: 1 1/2 in. insulation for
pipes <=1 1/2-in. nominal diameter 3 in. insulation for pipes >1 1/2-in. nominal diameter.
Exception: Pipe insulation is not required for factow-installed piping within HVAC equipment.
Exception: Pipe insulation is not required for piping that conveys fluids having a design operating temperature range between 55
degrees F and 105 degrees F.
- Exception: Pipe insulation is not required for piping that conveys fluids that have not been heated or cooled through the use of fossil
fuels or electric power.
Exception: Pipe insulation is not required for runout piping not exceeding 4 ff in length and 1 in. in diameter between the control valve
and HVAC coil
12. Operation and maintenance documentation must be provided to the owner that includes at least the following information:a) equipment
capacity (input and output) and required maintenance actionsb) equipment operation and maintenance manualsc) HVAC system
control maintenance and calibration information, including wiring diagrams, schematics, and control sequence deschptions; desired
or field-determined set points must be permanently recorded on control drawings, at control devices, or, for digital control systems, in
programming commentsd) complete narrative of how each system is intended, to o~erate. ~ ' ,
13. Each supply air oufiet or diffuser and each zone terminal device (such as V,~V or mixing box) must have its own balancing device,
Acceptable balancing devices include adjustable dampers located within the ductwork, terminal devices, and supply air diffusers.
14. Hot water space-heating systems with a capacity exceeding 300 kBtu/h supplying heated water to comfort conditioning systems must
include controls that automatically reset supply water temperatures by representative building loads (ibcluding return water temperature)
or by outside air temperature. Exceptions: - Where the supply temperature'reset controls cannot be implemented without causing
improper operation of heating, cooling, humidification, or dehumidification systems. - Hydronic systems that use variable flow to reduce
pumping energy.
15. Stair and elevator shaft vents must be equipped with motorized dampers capable of being automatically closed during normal building
operation and interlocked to open as required by fire and smoke detection systams, All gravity outdoor air supply and exhaust hoods,
vents, and ventilators must be equipped with motorized dampers that will automatically shut when the spaces sen/ed are not in use.
Exceptions: - Gravity (non-motorized) dampecs are acceptable in buildings less than three stories in height above grade. - Ventilation
systems serving unconditioned spaces.
16. Hydronic systems that use a common return system for both hot water and chiJled water must not be used.
