The petitioner is seeking relief from: 9 NYCRR 705.2(b),which limits buildings of type 5 construction to a maximum height of two stories above a basement or a cellar, or above finished grade where there is no basement or cellar. [The petitioner requests a building of type 5 construction three stories in height.] 9 NYCRR 711.2(b), which requires that bathrooms, toilet rooms, kitchenettes, corridors and recreation rooms have a minimum height of seven feet. [The petitioner requests a bathroom with a sloped ceiling height less than seven feet.] 9 NYCRR 714.1(a), which requires that in addition to the primary exit from a recreation room, or a habitable space except kitchens, there shall be provided in each such space at least one opening for emergency use. [The petitioner requests a third story habitable space not having at least one opening for emergency use.] FINDINGS OF FACT 1. The building that is the subject of this petition is properly classified as a Group A-1 (one-family dwelling) occupancy, three stories in height, of Type 5b (wood frame- unprotected)construction. According to the petitioner, this room is to be used as an observation tower. 3. The 225 square foot observation tower is not open to the floor below and is greater than one-third of the floor area immediately below, therefore the tower cannot be classified as a mezzanine. 4. 9 NYCRR 705.2(b) limits buildings of type 5 construction to a maximum height of two stories above a basement or a cellar, or above finished grade where there is no basement or cellar. 9 NYCRR 705.2(c), effective May 1999, allows buildings of type 5A(wood frame - protected)construction to have a maximum height of three stories above a basement or cellar, or above finished grade where there is no basement or cellar,when equipped throughout with an automatic sprinkler system installed in accordance with NFPA 13D- Installation of Sprinkler Systems in One-and Two-Family Dwellings and Mobile Homes (Reference Standard RS-57-7). 5. The Town of Southold permits two-and-a-half, but not three, story single-family dwellings. The owners applied to the Town of Southold Zoning Board of Appeals to allow a third story. The Zoning board approved the variance with the condition that the room in question (the observation tower) not be used now, or at any time in the future, for sleeping purposes and that the applicant install a sprinkler system in the room. The applicant has offered in the testimony a copy of the Town of Southold Zoning Board of Appeals grant and minutes of that particular hearing. 6. The Town of Southold Zoning Board of Appeals does not have the authority to vary the New York State Uniform Fire Prevention and Building Code (Uniform Code)or require additional measures that may or may not be in that Code. 7. Before the Uniform Code was amended in May of 1999, the regional offices of the Department of State Division of Code Enforcement and Administration granted numerous routine variances for a third story in Group Al occupancies of type 5b construction. The conditions imposed upon those variances include an interconnected fire-and smoke-detecting system installed throughout the building, an automatic sprinkler system installed on the third story and in the stair or stairs leading to the third story, and the installation of a noncombustible exterior escape ladder from every room on the third floor. However, these variances were for existing buildings where the petitioner was finishing a pre-existing attic or expanding a pre-existing nonconforming third story. No routine variances were ever granted for entirely new three story dwellings. 8. Per the testimony of the applicant, a sprinkler supply pipe was installed in the observation room only. It is not active, no sprinkler head has been installed in the observation room, and the pipe is not connected into the domestic water system. Petition No. 2002-1285 Page 3 9. Because the first and second stories are finished, the petitioner argues that it will be economically and physically impractical to install a sprinkler system throughout the house. An estimate in the amount of $49,800 for the installation of a sprinkler system in the egress areas only was submitted with the application. 10. The petitioner has stated that the building has an interconnected fire-and smoke-detection system that is tied into a central station supervisory service. 11. The windows located in the observation tower may not have the minimum opening areas or dimensions for openings for emergency use as required in Subdivision 714.1(c)of the Uniform Code. 12. The state adopted the Residential Code of New York State in July of 2002, effective January 1, 2003. This Code,while not applicable in this instance, still requires that one-and two-family dwellings having a height of three stories be equipped throughout with an automatic sprinkler system installed in accordance with NFPA 13D. Construction type and protection of structural elements, however, are no longer addressed. 13. As part of the new dwelling, a bathroom has been constructed under the sloping roof area of the second floor. 14. The ceiling has a height of approximately 7 feet 10 inches, sloping down to approximately 6 feet on the opposite side, where the lavatories are located in the bathroom. 15. With the placement of the plumbing fixtures,the ceiling height is adequate for normal useage. 16. While not applicable in this instance, Section R305.1 exception 4 of The Residential Code of New York State stipulates that not more than 50 percent of the required floor area of a room or space is permitted to have a sloped ceiling less than the required height with no portion of the required floor area less than 5 feet in height. The bathroom, if constructed today, would comply with the Code and would not require a variance. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would entail practical difficulties or unnecessary hardship, would create an excessive and unreasonable economic burden, and would be unnecessary in light of alternatives which ensure the achievement of the Code's intended objective. DETERMINATION WHEREFORE IT IS DETERMINED that the application for variance from 9 NYCRR 705.2(b), 711.2(b), and 714.1(a), be and are hereby GRANTED with the following conditions: 1.
