WITNESSETH, that the party of the first part, to whom letters testamentary were issued by the Surrogate's
Court, Suffolk County, New York on June 30, 1989 and by virtue of the power and authority given in and by said
last will and testament, and/or by Article 11 of the Estates, Powers and T~rusts Law, and in consideration of
($843,000.00) dollars, lawful money of the United States, paid by the party of the second part, does hereby gran~
and release unto the party of the second part, the distributees or successors .and assigns of the party of the second.

ALL that certain plot, piece or parcel of land, situate, lying and being at Sbuthold, in the Town of Southold,
county of Suffolk and State of New York, being known and designated as Lot #4 on a certain Map known as
"Plan of Lots owned by George H. Wells, situate at Southold, Suffolk County, New'York, dated November 10,
1927, Otto W. Van Tuyl, Professional Engineer and Land Surveyor, Greenport, N.Y.", which said Map was filed
in the Suffolk County Clerk's Office on November 28th, 1927, as Map Number 859, said Lot being bounded and
described as follows;
BEGINNING at a point on the southerly side of Wells Avenue distant 280.00 feet easterly from the coruer
formed by the intersection of the easterly side of Oaklawn Avenue and the southerly side 0f Wells Avenue;
THENCE along the southerly side of Wells Avenue, North 73 degrees 20 minutes 00 seconds East, 100.00
feet to the division line of Lot 4 and Lot 5 on the hbove mentioned Map;
THENCE along said division line, South 16 degrees 40 minutes 00 seconds East, 206.92 feet to the mean high
· water line of Jockey Creek;
THENCE along the mean high water line of Jockey Creek, South 77 degrees 01 minute 16 seconds West,
98.75;
THENCE North 16 degrees 40 minutes 00 seconds West, 204.82 feet to the southerly side of Wells Avenue
and the point or place of BEGINNING;
BEING AND INTENDED TO BE the same premises conveyed in deed dated 12/13/49 and recorded on
13/13/49 in Liber 3026, page 378.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of
decedent's death in said premises, and also the estate therein, which the party of the first part has or has power to
convey or dispose of, whether individually, or by virtue of said will or otherwise,
TO HA VE AND TO HOLD the premises herein granted unto the party of the second par~, the heirs or
successors and assigns of the p ,a?'ty of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenan'~s that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration as
a trust fund to be applied first for the purpose of paying the costs of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
