Testament of Catherine Van Z. Odhner dated November 27, 2001, residing 2733

WITNESSETH:
That the Party of the First Part, in consideration of Ten Dollars ($10.00), lawful
money of the United States, and other good and valuable considerations, paid by the
Party of the Second Part, does hereby grant and release unto the Party of the Second
Part, the heirs or successors and assigns of the Party of the Second Part forever,
ALL that certain plot, piece or parcel of land, with the buildings and ~
improvements thereon erected, situate, lying and being at Indian Neck, Peconic, in the
Town of $outhold, County of Suffolk, and State of New York, known and designated as
Lot No. 2 on a certain Map entitled "Map of Peconic Bay Oaks" filed in the Suffolk
County Clerk's Office on October 18, 1961 as Map No. 3434, excepting therefrom a
strip of land 15 feet in width immediately adjacent to the northerly line of said Lot No. 2,
the premises herein conveyed being more particularly bounded and described as
follows:
BEGINNING at a point on the westerly line of Robinson Lane at the easterly or
southeasterly corner of said lot No. 2 (which point is North 29 degrees 53 minutes 30
seconds west, a distance of 16.39 feet from ordinary high water mark as shown on said
map); from said point of Beginning
RUNNING South 36 degrees 43 minutes 40 seconds West, a distance of 143.08 feet to
land now or formerly of Messenger;
RUNNING THENCE North 61degrees 01 minutes 40 seconds West a dist'a~ce"of 69.86
feet;
RUNNING THENCE still along land of Messenger North 12 degrees 33 minutes 50
seconds West, a distance of 285.0 feet to land conveyed or about to be conveyed to
Mary Van Zyverden Barnitz;
RUNNING THENCE along said land conveyed or about to be conveyed to Mary Van
Zyverden Barnitz, North 77 degrees 26 minutes 10 seconds East a distance of 140 feet,
more or less, to the westerly line of said Robinson Lane;
RUNNING THENCE in a southerly direction along the westerly line of Robinson Lane
on a curve to the right having a radius of 725 feet, a distance of 60 feet, more or less, to
a point which is North 29 degrees 53 minutes 30 seconds East, a distance of 200.24
feet from the point of beginning;
RUNNING THENCE South 29 degrees 53 minutes 30 seconds East, a distance of
200.24 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises as conveyed to the Grantor herein
by deed dated September 8, 1964and recorded in the Suffolk County Clerk's Office on
September 10, 1964 in Liber 5611 Page 411 as confirmed by confirmation deed dated
May 23, 1966 recorded June 2, 1966 in Liber 5966 Page 185.

TOGETHER with the right to the use (in common with others) of a strip of beach land
approximately 15 feet in width extending along the southerly or southeasterly line of
said premises to ordinary high water mark of Peconic Bay.
TOGETHER with the right to the use (in common with others) of the existing roadway
15 feet in width extending southerly from the southerly line of the public highway known
as Robinson Lane southerly over said existing roadway (also known as Robinson Lane)
to the southeasterly corner of the premises above described for the purpose of ingress
and egress to and from said premises and to and from Indian Neck Road.
TOGETHER with all right, title and interest, if any, of the party of the first part in arid to
any streets and roads abutting the above described premises to the center lines '
thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the Party of the Second
Part, the heirs or successors and assigns of the Party of the Second Part forever.
AND the Party of the First Part covenants that the Party of the First Part has not done
or suffered anything whereby the said premises have been encumbered in any way
whatsoever, except as aforesaid.
AND the Party of the First Part, in compliance with Section 13 of the Lien Law,
covenants that the Party of the First Part will receive the consideration for this
conveyance and will hold the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the improvement and will apply the
same before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.

day and year first above written.
