This lot line change has no significant negative environmental effects, and will not make future planning of the affected parcels more difficult or impossible; be it therefore RESOLVED, that the Southold Town Planning Board, acting under the State Environmental Quality Review Act pursuant to 6 NYCRR Part 617, Section 617.7, perform an uncoordinated review of this Unlisted Action. Any land being transferred by such re-subdivision shall be deeded to the owner of the property in Identical name so the new area merges with the existing parcel and shares therewith a common identification number on a Suffolk County Tax Map. Name of Action: Proposed Lot Line Change of Clark's Beach, Village of Greenport SCTM#: SCTMs#1000-40-1-23 Location: Located North of C.R. 48 in Greenport, NY SEQR Status: Type I ( ) Unlisted (X) Conditioned Negative Declaration:Yes ( ) No (X) Description of Action: This proposal is for a lot line change to subtract Lot 1 totaling 6.326 acres (275,537 square feet) from a total parcel area of 14.835 acres (646,205 square feet) of SCTM#1000-40-1-23 owned by the Village of Greenport for Suffolk County acquisition and inclusion into the adjacent Suffolk County preserved park land of Inlet Point Park. Reasons Supporting This Determination: An Environmental Assessment Form has been submitted and reviewed and it was determined that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. The determination was based upon the following: This lot line change is creating a lot which will become part of Suffolk County's preserved parkland. A total of 6.326 acres of land is being transferred from the Village of Greenport to Suffolk County to become part of Suffolk County's Inlet Point Park. By doing so, the total amount of buildable land is being reduced and is instead being preserved. Clark's Beach Ne~lative Declaration Page Two September 22, 2008 Therefore, the proposed application will have no bearing upon Article VI of the Suffolk County Sanitary Code and will therefore conform to Article VI of the Suffolk County Sanitary Code and will not be expected to adversely affect groundwater quality. No substantial adverse change in existing air quality, ground or surface water quality or quantity, traffic or noise levels, no substantial increase in solid waste production, potential of erosion, flooding, leaching or drainage problems will occur as a result of this action. No significant removal or destruction of large quantities of vegetation or fauna, no substantial interference with the movement of any resident or migratory fish or wildlife species, no significant impacts on a significant habitat area, no substantial adverse impacts on a threatened or endangered species of animal or plant or the habitat of such a species, and no other significant adverse impacts to natural resources will occur. 3. The proposed action is not in a material conflict with a community's current plans or goals as officially approved or adopted. The proposed action will not significantly impair the character or quality of impodant historical, archaeological, architectural, or aesthetic resources or of existing community or neighborhood character. 5. No major change in the use of either the quantity or type of energy will occur. The lot will continue to have only the pre-existing single family dwelling. 6. No creation of a hazard to human health will occur. The proposed action will not cause a substantial change in the use, or intensity of use, of land including agricultural, open space or recreational resources, or in its capacity to support existing uses. 8. Based upon such, no significant adverse impacts to the environment are expected to occur should the project be implemented as planned. The eastern 6.3 acre lot is in contract to be purchased by a municipality (Suffolk County) to be preserved. 2. The municipality owns a large preserved parcel ( ~'~/ acres) adjacent and intends to combine the new parcel with the existing park, used only for passive recreation. 3. The funding source the municipality is using to purchase the property guarantees the new parcel will protected as open space and parkland for passive recreation only (Suffolk County's 1/4% Drinking Water Fund) 4. It is incomplete right now, pending a letter from you that states what else they need to submit to make a complete application (including the fee, and how many copies of the map). Please make sure a copy of the work session agenda from 7/28 makes it into this file, if it isn't already. The file won't go into a blue folder until after we send them the letter and they submit the complete application. Chapter 240 allows certain parts of the subdivision requirements to be waived. I made the case in my memo dated 7/25/08 for why the Planning Board can do so and suggested generally which things could be waived. Please review the code and then meet with me to discuss what in particular you think we can waive. It will all need to be spelled out in a resolution when we approve it so that others can't do it unless they meet the same standards and situation. } know we can have a single public hearing, but there must be at least one public hearing. I think we can skip the Sketch Plan Approval stage, and go right to an application for Preliminary (see if you can think through why that might or might not work), and have the public hearing on the Preliminary map. We can then move right to the Final map if we make sure the Preliminary has everything we need. Health Department may not be an issue because the lots being created are greater than 5 acres, so I can't think of any conditions that would make us wait for Final Approval. We might be able to do final approval the same night as Preliminary approval. I wonder if we can go directly to Final Approval and have the public hearing on the final map? Please read through the code and see if you think its possible. We will also discuss this with Mark.
